HHS&rsquo;s argument that any type of treatment should be provided is outside EMTLA&rsquo;s purview,&rdquo; the ruling said.<\/p>\n<p>Although the subject of the case was abortion, the court said the underlying issue was <a href=\"https:\/\/www.westernjournal.com\/supreme-court-hands-hands-texas-major-win-biden-allows-border-law-enforced\/\" target=\"_blank\" rel=\"noopener\">control<\/a>.<\/p>\n<p>&ldquo;The question before the court is whether EMTALA, according to HHS&rsquo;s Guidance, mandates physicians to provide abortions when that is the necessary stabilizing treatment for an emergency medical condition. It does not. We therefore decline to expand the scope of EMTALA,&rdquo; the ruling said.<\/p>\n<p>As noted by <a href=\"https:\/\/www.nytimes.com\/2024\/10\/07\/us\/politics\/supreme-court-texas-abortion-biden.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>, the Texas law that outlaws most abortions allows abortion to prevent a serious risk of &ldquo;substantial impairment of a major bodily function.&rdquo;<\/p>\n<p>In June, the Supreme Court had supported allowing <a href=\"https:\/\/www.westernjournal.com\/left-wing-host-slammed-using-bible-justify-abortion-saying-hurricane-may-punishment-red-states\/\" target=\"_blank\" rel=\"noopener\">Idaho<\/a> hospitals to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-files-motion-to-dismiss-texas-abortion-lawsuit\/\" title=\"DOJ files motion to dismiss Texas abortion lawsuit\">perform emergency abortions<\/a> in emergency situations, regardless of what state law might say.<\/p>\n<p>However, in that case the court used a technicality to rule against the appeal that would have overturned that practice.<\/p>\n<p>The dispute began when, after the 2022 Supreme Court ruling that overturned Roe v.
