This legal\u200d action comes \u200bjust as the U.S. Supreme Court is\u200c poised to \u2063hear a significant case regarding mifepristone. The studies,\u200b which\u200d reportedly highlighted serious health risks \u200dassociated with \u2062the drug, \u2062including a reported 500% rise in abortion-related emergency \u2062room visits, were initially well-received, passing peer \u200creview without issue.<\/p>\n<p>The retractions followed a reader&#8217;s complaint alleging \u2062that the authors had conflicts of interest due to their affiliations with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/psaki-refuses-to-guarantee-that-taxpayer-money-in-stimulus-bill-wont-go-toward-abortions\/\" title=\"Psaki Refuses To Guarantee That Taxpayer Money In Stimulus Bill Won\u2019t Go Toward Abortions\">pro-life organizations<\/a>.\u200d The researchers argue that the retractions are unjust \u200dand detrimental to their\u200c professional \u2063reputations, leading to media attacks and\u2062 challenges\u2063 in getting their \u2064new research published.<\/p>\n<p>Legal representatives for the scientists assert that Sage&#8217;s\u2063 actions \u2063have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/navy-commander-warns-pentagons-handling-of-vaccine-mandate-will-result-in-massive-readiness-crash\/\" title=\"Navy Commander cautions Pentagon&#039;s vaccine mandate may cause significant readiness decline.\">caused irreparable\u2064 harm<\/a> and violated various legal protections, including contract \u2064and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-campus-anti-semitism-skyrockets-even-as-coronavirus-forces-remote-learning\/\" title=\"Report: Campus Anti-Semitism Skyrockets Even as Coronavirus Forces Remote Learning\">civil rights laws<\/a>.\u2064 The Charlotte Lozier Institute,\u200c which\u2063 supported \u200bthe research, has \u200ddefended the \u2062authors, stating that all required \u2063disclosures were made. \u2064In \u2064February 2024, the controversy surrounding the retracted studies \u2063garnered significant media coverage, particularly\u200b in outlets \u2064emphasizing skepticism towards the original findings and their implications for \u2064ongoing legal arguments regarding mifepristone&#8217;s safety and regulation.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Scientists are suing an academic publishing company for retracting three key studies exposing the dangers of the nation&rsquo;s <a href=\"https:\/\/www.guttmacher.org\/article\/2022\/02\/medication-abortion-now-accounts-more-half-all-us-abortions\" target=\"_blank\" rel=\"noreferrer noopener\">most popular<\/a> abortion drug regimen shortly before the U.S. Supreme Court was slated to <a href=\"https:\/\/thefederalist.com\/2024\/03\/26\/supreme-court-hears-challenge-to-fdas-reckless-approval-of-unsafe-mail-order-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">hear arguments<\/a> in a <a href=\"https:\/\/thefederalist.com\/2024\/06\/17\/what-the-supreme-courts-abortion-pill-ruling-means-for-the-future-of-mifepristone\/\" target=\"_blank\" rel=\"noreferrer noopener\">landmark mifepristone case<\/a>.<\/p>\n<p>Ten of the researchers responsible for producing the three scientific papers filed a <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/StudnickiPetitionToCompelArbitration.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">petition to compel arbitration<\/a> this week against Sage Publications for issuing what they called &ldquo;pretextual and discriminatory&rdquo; retractions of their findings on the abortion pill. One of the studies in question, which the lawsuit notes is &ldquo;the second most-read article&rdquo; in the journal&rsquo;s history, specifically determined mifepristone is responsible for a&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/23333928211053965\" target=\"_blank\" rel=\"noreferrer noopener\">500 percent increase<\/a>&nbsp;in abortion-related emergency room visits.<\/p>\n<p>The <a href=\"https:\/\/doi.org\/10.1177\/2333392819841211\" target=\"_blank\" rel=\"noreferrer noopener\">2019<\/a>, <a href=\"https:\/\/doi.org\/10.1177\/23333928211053965\" target=\"_blank\" rel=\"noreferrer noopener\">2021<\/a>, and <a href=\"https:\/\/doi.org\/10.1177\/23333928221103107\" target=\"_blank\" rel=\"noreferrer noopener\">2022<\/a> papers originally passed peer review for publication without a hitch. The editor-in-chief of Sage&rsquo;s Health Services Research and Managerial Epidemiology (HSRME) journal even emailed Dr. James Studnicki, the lead author of the 2021 and 2022 papers, to commend him for his &ldquo;fine contribution[s],&rdquo; according to the petition.<\/p>\n<p>In February 2024, however, Sage&rsquo;s tune changed over a &ldquo;reader&rsquo;s concern&rdquo; that the authors&rsquo; links to pro-life organizations &ldquo;present conflicts of interest that the authors should have disclosed as such in the article.&rdquo; <\/p>\n<p>  Abortion activist researchers publish <a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.2217\/WHE.10.70\" target=\"_blank\" rel=\"noreferrer noopener\">plenty<\/a> of <a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1258\/JRSM.2012.12K080\" target=\"_blank\" rel=\"noreferrer noopener\">papers<\/a> on the topic without scrutiny. Yet Sage, after what it called an &ldquo;independent review,&rdquo; ultimately followed through with the retractions. <\/p>\n<p>&ldquo;Sage&rsquo;s wrongdoing has been causing enormous and incalculable harm to the Authors&rsquo; professional reputations, as Sage intended. Because of Sage&rsquo;s retractions, the Authors and their research have been attacked by the media and by other authors, and the Authors have had new research proposals inexplicably turned away by other publications that now fear associating with them. The Authors have years &mdash; even decades &mdash; of fruitful research ahead of them, but they are now being treated as pariahs,&rdquo; the lawsuit, shepherded by Alliance Defending Freedom and Consovoy McCarthy PLLC attorneys, states.<\/p>\n<p>The publisher even removed Studnicki from his position on the HSRME journal editorial board, which the lawsuit alleges &ldquo;violated California contract, tort, and civil rights law.&rdquo;<\/p>\n<p>Charlotte Lozier Institute (CLI), whose scholars were responsible for the suddenly scrutinized paper, rejected Sage&rsquo;s accusations, noting that the publisher has &ldquo;no valid objection to their findings and has shown no evidence of any major errors, miscalculations, or falsehoods.&rdquo;<\/p>\n<p>&ldquo;The authors fully complied with Sage&rsquo;s conflict disclosure requirements,&rdquo; CLI <a href=\"https:\/\/lozierinstitute.org\/charlotte-lozier-institute-responses-to-sage-retractions\/\" target=\"_blank\" rel=\"noreferrer noopener\">said in a statement<\/a>. &ldquo;They reported their organizational affiliations, as well as CLI funding of the study, as part of the submission for publication. In fact, the ER study includes 10 mentions of CLI and the authors&rsquo; professional status or relationship there.&rdquo;<\/p>\n<p>CLI&rsquo;s objections to the &ldquo;unprecedented attack on our research,&rdquo; however, didn&rsquo;t stop pro-abortion corporate media from <a href=\"https:\/\/www.nytimes.com\/2024\/02\/09\/health\/abortion-pills-study-retraction.html\" target=\"_blank\" rel=\"noreferrer noopener\">quickly<\/a> <a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2024\/02\/09\/1230175305\/abortion-pill-mifepristone-retraction-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">amplifying<\/a> <a href=\"https:\/\/apnews.com\/article\/abortion-pill-mifepristone-redacted-studies-supreme-court-ebd60519fd44dc69c5ac213580d1c1ba\" target=\"_blank\" rel=\"noreferrer noopener\">Sage&rsquo;s<\/a><a href=\"https:\/\/www.cnn.com\/2024\/02\/07\/health\/journal-retractions-mifepristone\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">  decision<\/a>. Many outlets used it to cast doubts on U.S. District Judge Matthew Kacsmaryk&rsquo;s <a href=\"https:\/\/thefederalist.com\/2023\/04\/07\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">April 2023 ruling<\/a> declaring the Food and Drug Administration wrongfully approved mifepristone for chemical abortions for widespread use without studying the&nbsp;<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33939340\/\" target=\"_blank\" rel=\"noreferrer noopener\">detrimental and fatal effects<\/a>&nbsp;it has on women and babies.<\/p>\n<p>The researchers have tried for months to obtain arbitration, but the lawsuit alleges Sage has deliberately delayed the process with extra-contractual demands.<\/p>\n<p>&ldquo;Even more concerning, Sage has used its intransigence as a weapon to try to pressure the Authors into unilaterally surrendering their discovery rights. Sage&rsquo;s egregious actions require this Court&rsquo;s intervention to compel arbitration,&rdquo; the lawsuit concludes.<\/p>\n<p>The petition comes shortly after <a href=\"https:\/\/thefederalist.com\/2024\/09\/18\/media-democrats-blame-pro-lifers-after-the-abortion-pill-they-promote-killed-a-woman-and-her-babies\/\" target=\"_blank\" rel=\"noreferrer noopener\">corporate media<\/a> and <a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/the-abortion-lies-kamala-will-spew-in-atlanta-are-the-ones-that-killed-amber-thurman-and-candi-miller\/\" target=\"_blank\" rel=\"noreferrer noopener\">Democrats including Vice President Kamala Harris<\/a> tried to blame pro-lifers and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-vice-president-mike-pence-joins-the-heritage-foundation\/\" title=\"Former Vice President Mike Pence Joins The Heritage Foundation\">pro-life policies<\/a> for the deaths of women <a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/amber-thurman-died-from-the-abortion-pill-not-pro-life-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">caused by complications linked to the abortion pill<\/a>.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
