United States<\/em>,&rdquo; Trump&rsquo;s lawyers wrote, calling for the dismissal of all counts in the case.<\/p>\n<p>&ldquo;<em>Fischer<\/em> requires the dismissal of Counts Two and Three of the Superseding Indictment, and its logic fatally undermines Counts One and Four as well,&rdquo; his counsel added.<\/p>\n<p>Trump&rsquo;s 14-page <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.255.0_3.pdf\" target=\"_blank\" rel=\"noopener\" title>motion<\/a> is part of his broader defense strategy, focusing on the overreach of the prosecution under the obstruction statute, Section 1512(c)(2), which was originally designed to prevent document destruction. That motion sought to paint Trump as a mastermind behind a full-scale plan to sow doubt about the results of the 2020 election.<\/p>\n<p>The filing also served in part as Smith&rsquo;s response to the Supreme Court&rsquo;s immunity decision, which held that former presidents are not immune from actions undertaken in their private capacity. Trump lawyers say the immunity ruling and<em> Fischer <\/em>combined should be enough to dismiss the case entirely.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>U.S. District Judge Aileen Cannon, who oversaw Smith&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smith-pivots-strategy-in-trump-criminal-cases-washington-examiner\/\" title=\"Jack Smith pivots strategy in Trump criminal cases - Washington Examiner\">separate classified documents case<\/a>, has also presented another legal question involving the indictments against Trump after she ruled that Smith was improperly appointed under the Constitution&rsquo;s appropriations clause, dismissing the indictment there.
