J.D. Vance of Ohio and Democratic Gov. Tim Walz of Minnesota &mdash; a <a href=\"https:\/\/www.westernjournal.com\/msnbc-panelist-total-air-meltdown-tim-walzs-debate-disaster-stop-stop-stop\/\" target=\"_blank\" rel=\"noopener\">debate Vance dominated<\/a>.<\/p>\n<p>It also comes in the wake of <a href=\"https:\/\/www.westernjournal.com\/supreme-court-issues-highly-anticipated-ruling-trump-immunity-case\/\" target=\"_blank\" rel=\"noopener\">Trump&rsquo;s sweeping victory<\/a> over Smith July 1 in the Supreme Court presidential immunity case and District Judge Aileen Cannon&rsquo;s July 15 decision to dismiss charges against Trump in Florida related to his handling of classified documents after his presidency.<\/p>\n<p>Cannon, taking a cue from Supreme Court <a href=\"https:\/\/www.westernjournal.com\/court-ruling-justice-thomas-questions-legality-jack-smiths-appointment-special-counsel\/\" target=\"_blank\" rel=\"noopener\">Justice Clarence Thomas<\/a> in the immunity case, ruled that Smith was not properly appointed in the first place, as <a href=\"https:\/\/apnews.com\/article\/trump-classified-documents-smith-c66d5ffb7ba86c1b991f95e89bdeba0c\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a> reported. That leaves only his <a href=\"https:\/\/www.westernjournal.com\/jack-smith-introduces-new-indictment-trump-reason-revealed\/\" target=\"_blank\" rel=\"noopener\">election interference case<\/a> against Trump in D.C. Circuit Court.<\/p>\n<p>In a series of <a href=\"https:\/\/x.com\/JonathanTurley\/status\/1841576198113017917\" target=\"_blank\" rel=\"noopener\">posts on X<\/a>, George Washington University law professor Jonathan Turley &mdash; an <a href=\"https:\/\/www.westernjournal.com\/turley-jack-smith-stretched-law-new-trump-indictment\/\" target=\"_blank\" rel=\"noopener\">outspoken critic of Smith<\/a>&nbsp;&mdash; called Wednesday&rsquo;s move by Smith and District Judge Tonya Chutkan an effort to &ldquo;thread the needle&rdquo; of the Supreme Court&rsquo;s immunity decision while still going public with damaging charges against a political candidate &ldquo;despite Justice Department policies that encourage prosecutors to avoid acts that would be viewed as trying to influence an election&hellip;&rdquo;<\/p>\n<p>At the conservative website <a href=\"https:\/\/www.nationalreview.com\/corner\/one-month-before-election-day-judge-chutkan-allows-jack-smith-to-broadcast-his-evidence\/\" target=\"_blank\" rel=\"noopener\">National Review<\/a>, former federal prosecutor Andrew McCarthy &mdash; no fan of Trump in most circumstances &mdash; described the move to make the indictment public as even better for Democrats politically than a trial would be.<\/p>\n<p>McCarthy wrote:<\/p>\n<p>&ldquo;So no, the prosecutor and judge cannot get the case to trial, as they so ardently hoped to do; but Smith has been given the best substitute he can hope for: <em>A book-length recitation of the case against Trump, injected into public record and thus into the campaign less than five weeks before Election Day &mdash; and while people are already voting<\/em>.&rdquo; (Italics in the original.)<\/p>\n<p>&ldquo;In some ways, even though no conviction will result from it, Smith&rsquo;s public submission is better than a trial,&rdquo; McCarthy continued.<\/p>\n<p>&ldquo;Trials are messy and unpredictable; prosecutors&rsquo; written descriptions of what they hope to prove are often compelling and damning. That is why, at a trial, the judge routinely instructs the jury that an indictment and proffers by a prosecutor are only allegations; they are not evidence, they are not subject to cross-examination, and they prove nothing. Here, by contrast, there will be no cautionary instructions.
