Smith previously <a href=\"https:\/\/thefederalist.com\/2023\/08\/01\/biden-delivers-another-blow-against-his-primary-political-rival-with-latest-trump-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">indicted<\/a> Trump for <a href=\"https:\/\/thefederalist.com\/2023\/08\/03\/jack-smiths-jan-6-indictments-are-an-attack-on-political-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">questioning<\/a> the administration of the 2020 election.<\/p>\n<p>Writing in his <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258148\/gov.uscourts.dcd.258148.252.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">165-page screed<\/a> about Trump&rsquo;s legal efforts challenging the results of the 2020 contest, Smith claimed that Trump engaged in criminal activity by, among other alleged actions, &ldquo;manufacturing fraudulent electoral votes in the targeted states.&rdquo; This &ldquo;plan,&rdquo; the <a href=\"https:\/\/thefederalist.com\/tag\/merrick-garland\/\" target=\"_blank\" rel=\"noreferrer noopener\">Merrick <\/a><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"><a href=\"https:\/\/thefederalist.com\/tag\/merrick-garland\/\" target=\"_blank\" rel=\"noopener\">Garland&nbsp;<\/a>appointee<\/span> contended, was designed to &ldquo;cause&rdquo; Trump electors in these states to &ldquo;sign and send to [Vice President Mike Pence], as President of the Senate, certifications in which they falsely represented themselves as legitimate electors who had cast electoral votes for [Trump].&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-d93ea179a97bddefd3fd1d6fd6db6556 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-d93ea179a97bddefd3fd1d6fd6db6556\"><\/div>\n<p>&ldquo;Ultimately, the defendant and his co-conspirators would use these fraudulent electoral votes&mdash;mere pieces of paper without the lawful imprimatur of a state executive&mdash;to falsely claim that in his ministerial role presiding over the January 6 certification, Pence had the authority to choose the fraudulent slates over the legitimate ones, or to send the purportedly &lsquo;dueling&rsquo; slates to the state legislatures for consideration anew,&rdquo; the brief reads.<strong> <\/strong><\/p>\n<p>Contrary to Smith&rsquo;s claims, the naming of contingent Republican electors during the 2020 election cycle was neither unprecedented nor unlawful. In fact, the process conducted in contested states like&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/09\/01\/exclusive-fani-willis-possesses-evidence-exonerating-georgias-alternate-electors\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a>&nbsp;parallels a similar endeavor that occurred during the 1960 presidential contest between Democrat John F. Kennedy and Republican Richard Nixon.<\/p>\n<p>As The Federalist&rsquo;s Margot Cleveland&nbsp;previously&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Kennedy and Nixon electors cast their votes for their respective candidates when a disagreement arose over who won Hawaii&rsquo;s electoral votes. While the state&rsquo;s acting governor certified the election for Nixon initially, a legal challenge followed by a court decision ultimately resulted in Kennedy receiving the electoral votes.<\/p>\n<p>Had courts similarly ruled in Trump&rsquo;s favor in lawsuits disputing the election results in battleground states, the alternate electors would have been in place to ensure the will of the people was exercised, as was the case in the Kennedy-Nixon dispute.<\/p>\n<div class=\"fdrlst__b89e9-ba5c6714d9e7418d2da7a0b4c234081d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ba5c6714d9e7418d2da7a0b4c234081d\"><\/div>\n<p><strong>[RELATED: <a href=\"https:\/\/thefederalist.com\/2024\/07\/15\/judge-in-docs-case-throws-out-dojs-lawfare-against-trump-rules-jack-smiths-appointment-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">Judge In Docs Case Throws Out DOJ&rsquo;s Lawfare Against Trump, Rules Jack Smith&rsquo;s Appointment Unconstitutional<\/a>]<\/strong><\/p>\n<p>This historical precedent hasn&rsquo;t stopped radical left-wing prosecutors from filing charges against Republican electors who partook in the 2020 process, however. <\/p>\n<p>Democrat attorneys general in&nbsp;<a href=\"https:\/\/dailycaller.com\/2024\/04\/25\/kris-mayes-indictment-fake-election-scheme-18-charges-donald-trump-connections\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a>,&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/06\/05\/wisconsin-ag-files-phony-fake-elector-charges-anyway-after-admitting-gop-plan-was-legal\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wisconsin<\/a>,&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/06\/24\/judge-throws-out-leftist-nevada-ags-phony-fake-electors-case-against-trump-supporters\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nevada<\/a>, and&nbsp;<a href=\"https:\/\/www.foxnews.com\/politics\/michigan-ag-charges-16-false-electors-donald-trump-2020-presidential-election\" target=\"_blank\" rel=\"noreferrer noopener\">Michigan<\/a> have all filed such charges in the years since 2020. Fulton County DA Fani Willis also brought charges against&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/09\/01\/exclusive-fani-willis-possesses-evidence-exonerating-georgias-alternate-electors\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia Republicans<\/a>. A Nevada judge did, however, dismiss&nbsp;Democrat AG Aaron Ford&rsquo;s charges against the Silver State&rsquo;s 2020 GOP electors in June due to a jurisdiction error on the part of prosecutors, as The Federalist&rsquo;s Matt Kittle <a href=\"https:\/\/thefederalist.com\/2024\/06\/24\/judge-throws-out-leftist-nevada-ags-phony-fake-electors-case-against-trump-supporters\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n<p>It&rsquo;s worth mentioning that Democrats had no problem advocating for electors to vote differently during the 2016 election following Trump&rsquo;s victory against Hillary Clinton. As my colleague Jordan Boyd previously&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/07\/19\/as-michigan-charges-trump-electors-with-felonies-recall-how-leftists-everywhere-urged-2016-electors-to-defect-to-hillary\/\" target=\"_blank\" rel=\"noreferrer noopener\">highlighted<\/a>, corporate media ran &ldquo;[a]rticles demanding state electors &lsquo;prevent an irresponsible demagogue from taking office&rsquo; and overrule Americans to install Hillary Clinton as president&rdquo; as part of their efforts to keep Trump from taking office.<\/p>\n<div class=\"fdrlst__b89e9-4918862e22d629c5dd643561d04375df fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-4918862e22d629c5dd643561d04375df\"><\/div>\n<p>Smith&rsquo;s brief comes months after the U.S. Supreme Court <a href=\"https:\/\/thefederalist.com\/2024\/07\/01\/scotus-immunity-ruling-further-delays-trump-trial-in-jack-smiths-d-c-lawfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that presidents possess &ldquo;absolute immunity&rdquo; for &ldquo;actions within his conclusive and preclusive constitutional authority&rdquo; and &ldquo;at least presumptive immunity&rdquo; for &ldquo;official acts.&rdquo; The high court separately noted, however, that &ldquo;[t]here is no immunity for unofficial acts,&rdquo; and remanded the Biden-Harris Justice Department&rsquo;s get-Trump lawfare back to the lower courts to determine whether certain actions alleged by Smith constitute &ldquo;official acts.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-7c85c5175b907dcb7bb738128ee73f53 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-7c85c5175b907dcb7bb738128ee73f53\"><\/div>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">   Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
