Donald Trump&rsquo;s D.C. criminal case related to the Capitol riot on Jan. 6, 2021.<\/p>\n<p>Smith&rsquo;s 165-page <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258148\/gov.uscourts.dcd.258148.252.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> was published Wednesday, just over one month before Election Day, as a final Hail Mary to convince Americans of Trump&rsquo;s guilt while voters turn in ballots.<\/p>\n<div class=\"fdrlst__b89e9-13ab82ea9090d6b55bf14574b69fde4e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-13ab82ea9090d6b55bf14574b69fde4e\"><\/div>\n<p>&ldquo;The defendant asserts that he is immune from prosecution for his criminal scheme to overturn the 2020 presidential election because, he claims, it entailed official conduct,&rdquo; Smith wrote. &ldquo;Not so.&rdquo;<\/p>\n<p>The ensuing document outlines prosecutors&rsquo; case against the Republican presidential nominee, a case Chutkan&rsquo;s court was <a href=\"https:\/\/nypost.com\/2024\/09\/05\/us-news\/chutkan-confirms-trumps-jan-6-trial-wont-take-place-before-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">unable<\/a> to litigate before the election closes in November. Progress on the trial was delayed this summer when the Supreme Court ruled presidents enjoy broad immunity for official acts in office. While Chutkan repeatedly <a href=\"https:\/\/abcnews.go.com\/US\/judge-postpones-start-trumps-federal-election-interference-trial\/story?id=106909854\" target=\"_blank\" rel=\"noreferrer noopener\">postponed<\/a> the court&rsquo;s initial trial date this year because of the Supreme Court&rsquo;s decision to consider presidential immunity, the federal judge overseeing Trump&rsquo;s Jan. 6 trial <a href=\"https:\/\/thefederalist.com\/2024\/09\/05\/chutkan-laughs-off-supreme-court-immunity-ruling-in-d-c-trump-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">scoffed<\/a> at the high court&rsquo;s ruling earlier this month in court.<\/p>\n<p>In her Wednesday <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258148\/gov.uscourts.dcd.258148.251.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> that allowed prosecutors to release the source-redacted report, the judge, who has a well-documented animus toward the former president and his supporters, accused Trump&rsquo;s legal team of engaging in &ldquo;bad-faith partisan bias.&rdquo;<\/p>\n<p>&ldquo;These accusations, for which Defendant provides no support, continue a pattern of defense filings focusing on political rhetoric rather than addressing the legal issues at hand,&rdquo; Chutkan wrote. &ldquo;Not only is that focus unresponsive and unhelpful to the court, but it is also unbefitting of experienced defense counsel and undermining of the judicial proceedings in this case.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-56d2198ef6ca4efb9eaa011f549b6c1d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-56d2198ef6ca4efb9eaa011f549b6c1d\"><\/div>\n<p>Chutkan, however, was appointed to preside over the politically charged Jan. 6 case of the former president despite her <a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">reputation<\/a> as &ldquo;a tough punisher of Capitol rioters.&rdquo; According to the Associated Press, Chutkan presided over more than three dozen cases of those charged with crimes related to the Capitol chaos on Jan. 6, 2021.<\/p>\n<p>&ldquo;Other judges typically have handed down sentences that are more lenient than those requested by prosecutors,&rdquo; the AP reported. &ldquo;Chutkan, however, has matched or exceeded prosecutors&rsquo; recommendations in 19 of her 38 sentences. In four of those cases, prosecutors weren&rsquo;t seeking any jail time at all.&rdquo;<\/p>\n<p>Chutkan has since presided as a friendly judge for the prosecution, instating an unprecedented <a href=\"https:\/\/www.politico.com\/news\/2023\/10\/29\/trump-gag-order-reinstated-00124147\" target=\"_blank\" rel=\"noreferrer noopener\">gag order<\/a> amid a turbulent presidential campaign in addition to giving Smith permission to publish an anonymously sourced case against Trump with just over 30 days until the election.<\/p>\n<p>The federal judge <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> a request by Trump&rsquo;s legal team last fall that she recuse herself from the case and allow the former president be prosecuted outside of Washington, D.C., where far-left lawmakers have <a href=\"https:\/\/thefederalist.com\/2022\/01\/06\/one-year-ago-today-a-new-hoax-was-born\/\" target=\"_blank\" rel=\"noreferrer noopener\">endlessly amplified<\/a> the Capitol riot and compared it to 9\/11. Chutkan refused to allow the case to be moved beyond the Beltway despite her past <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">prejudicial statements<\/a> that portrayed the Jan. 6 turmoil as worse than the summer of rage that swept the country in 2020.<\/p>\n<div class=\"fdrlst__b89e9-20660a95e7f1d43e3b90ef816ef3811a fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-20660a95e7f1d43e3b90ef816ef3811a\"><\/div>\n<p>&ldquo;To compare the actions of people protesting, mostly peacefully, for civil rights,&rdquo;&nbsp;Chutkan <a href=\"https:\/\/apnews.com\/article\/black-lives-matter-texas-sentencing-courts-capitol-siege-675b12d0ddacb64d9030c444f8812a5c\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in one case, to those &ldquo;trying to overthrow the government&rdquo; &ldquo;ignores the very real danger that the Jan. 6 riots pose to the foundation of our democracy.&rdquo;<\/p>\n<\/p>\n<div class=\"fdrlst__b89e9-d055ffe4ee78a52efb8de026feb69738 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-d055ffe4ee78a52efb8de026feb69738\"><\/div>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">   Tristan Justice is the western correspondent for The Federalist and the author of Social Justice Redux, a conservative newsletter on culture, health, and wellness.
