Despite multiple challenges noting their lack of constitutionality and deliberate deception, the radical ballot initiatives have made it through certification to the Nov. 5 ballot.<\/p>\n<p>Here are the 10 states &mdash; many with decades of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/amber-thurman-died-from-the-abortion-pill-not-pro-life-laws\/\" title=\"Amber Thurman Died From The Abortion Pill, Not Pro-Life Laws\">pro-life laws &#038;mdash<\/a>; that could see unpopular abortion through all nine months of pregnancy become a gruesome reality this election season.<\/p>\n<h2>Arizona<\/h2>\n<p>Voters in the Grand Canyon State face a decision on a&nbsp;<a href=\"https:\/\/azsos.gov\/sites\/default\/files\/docs\/2024_0821_Final_2024_Ballot_Language_English.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a>&nbsp;that seeks to add a <a href=\"https:\/\/www.plannedparenthoodaction.org\/planned-parenthood-advocates-arizona\/arizona-for-abortion-access\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;fundamental right to abortion&rdquo;<\/a> to the state constitution. If passed, the amendment will usurp the state&rsquo;s current law banning abortion beyond 15 weeks.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/ballotpedia.org\/Arizona_Right_to_Abortion_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">sweeping language<\/a>&nbsp;in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/extreme-abortion-until-birth-amendments-make-ballot-in-az-mo\/\" title=\"Extreme Abortion Until Birth Amendments Make Ballot In AZ, MO\">proposed amendment hinges abortion availability<\/a> on &ldquo;viability,&rdquo; which it refuses to define and instead leaves up to the subjective judgment of a health care professional. The amendment also prevents the state from passing or&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/04\/09\/arizona-supreme-court-upholds-law-punishing-abortionists-as-unlimited-abortion-ballot-battle-rages\/\" target=\"_blank\" rel=\"noreferrer noopener\">enforcing laws<\/a>&nbsp;punishing abortionists for killing babies.<\/p>\n<h2>Colorado<\/h2>\n<p>Colorado currently&nbsp;<a href=\"https:\/\/coag.gov\/app\/uploads\/2022\/06\/Know-Your-Reproductive-Rights.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">offers unlimited abortion<\/a>&nbsp;through all nine months of pregnancy to anyone who wants it. Amendment 79, however, would not only hamper future efforts to limit abortion but also permit <a href=\"https:\/\/ballotpedia.org\/Colorado_Amendment_79,_Right_to_Abortion_and_Health_Insurance_Coverage_Initiative_(2024)#cite_note-quotedisclaimer-4\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;abortion to be a covered service under health insurance plans.&rdquo;<\/a><\/p>\n<p>Most Americans <a href=\"https:\/\/www.nationalreview.com\/corner\/marist-poll-60-percent-of-americans-oppose-taxpayer-funding-of-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">oppose taxpayer-funded abortion<\/a>. As <a href=\"https:\/\/marchforlife.org\/coloradospeakers2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-lifers<\/a> have noted, &ldquo;The only provision keeping Colorado from being the number one destination for unrestricted abortion in the United States is the 1984 Colorado constitutional prohibition against the use of public funding for abortion,&rdquo; which is what Amendment 79 seeks to replace. <\/p>\n<h2>Florida<\/h2>\n<p>Florida&rsquo;s Amendment 4, if passed, would <a href=\"https:\/\/initiativepetitions.elections.myflorida.com\/InitiativeForms\/Fulltext\/Fulltext_2307_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">effectively enshrine<\/a> abortion through birth in the Sunshine State&rsquo;s constitution and eliminate safeguards designed to protect women and children,<\/p>\n<p>The amendment itself is laced with vague terminology like &ldquo;viability,&rdquo; which can easily be exploited to ensure abortion at any point in gestation, and includes language that gets rid of parental consent. It also includes provisions for medical professionals to deem abortion at any stage of pregnancy necessary for a woman&rsquo;s &ldquo;health,&rdquo; physical, emotional, or mental. <\/p>\n<p>The path to the Sunshine State&rsquo;s ballot measure involved&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/florida-supreme-court-rules-to-allow-deceptive-abortion-amendment-on-november-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">deception<\/a>&nbsp;and even&nbsp;<a href=\"https:\/\/sbaprolife.org\/newsroom\/press-releases\/fl-pro-abortion-activists-arrested-for-phony-petition-signatures\" target=\"_blank\" rel=\"noreferrer noopener\">fraudulent signatures<\/a>. The &ldquo;Yes on 4&rdquo; campaign also features resources <a href=\"https:\/\/thefederalist.com\/2024\/09\/05\/fls-amendment-4-backers-show-underage-girls-how-to-get-abortions-without-parents-permission\/\" target=\"_blank\" rel=\"noreferrer noopener\">helping teens<\/a> who want to skirt current state laws obtain abortions without involving their parents.<\/p>\n<p>Even after warnings that the amendment&rsquo;s language could easily trick voters who don&rsquo;t believe in allowing <a href=\"https:\/\/thefederalist.com\/2024\/08\/22\/more-floridians-need-to-know-a-november-ballot-initiative-would-legalize-second-trimester-abortions\/\" target=\"_blank\" rel=\"noreferrer noopener\">second- and third-trimester abortions<\/a>, the Florida Supreme Court <a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/florida-supreme-court-rules-to-allow-deceptive-abortion-amendment-on-november-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in April to keep the amendment on the ballot.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\"><p>&mdash; Florida&rsquo;s Voice (@FLVoiceNews) <a href=\"https:\/\/twitter.com\/FLVoiceNews\/status\/1829619821107167572?ref_src=twsrc%5Etfw\">August 30, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<h2>Maryland<\/h2>\n<p>One of the most pro-abortion states in the United States hopes to pad its baby-killing record with a&nbsp;<a href=\"https:\/\/ballotpedia.org\/Maryland_Right_to_Reproductive_Freedom_Amendment_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">ballot measure<\/a>&nbsp;that would make its sweeping abortion provisions more permanent through an undefined &ldquo;right to reproductive freedom.&rdquo;<\/p>\n<p>The authors claim abortion is &ldquo;a central component of an individual&rsquo;s rights to liberty and equality&rdquo; and have declared the state &ldquo;may not, directly or indirectly, deny, burden, or abridge the right unless justified by a compelling state interest achieved by the least restrictive means.&rdquo;<\/p>\n<h2>Missouri<\/h2>\n<p>The&nbsp;Show-Me State&rsquo;s <a href=\"https:\/\/www.sos.mo.gov\/CMSImages\/Elections\/Petitions\/2024-086.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a>&nbsp;seeks to permanently permit abortion via the addition of a &ldquo;right to reproductive freedom&rdquo; to the state constitution.<\/p>\n<p>The ballot measure would not only rid Missouri of its current abortion limits, which prevent ending life in the womb except in a&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=188.017\" target=\"_blank\" rel=\"noreferrer noopener\">medical emergency<\/a>, but would also prohibit legislators from enacting or enforcing protections for women and unborn babies.<\/p>\n<p>Cole County Circuit Judge Christopher Limbaugh&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/09\/09\/missouris-radical-abortion-amendment-could-be-yanked-from-ballot-after-judge-rules-it-invalid\/\" target=\"_blank\" rel=\"noreferrer noopener\">found in early September<\/a>&nbsp;that the petition to put abortion through birth in front of voters did not meet the Disclaimer mandates outlined by&nbsp;<a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=116.050#:~:text=116.050.,pages%20of%20a%20uniform%20size.\" target=\"_blank\" rel=\"noreferrer noopener\">Missouri law<\/a>. Shortly after, however, the state supreme court <a href=\"https:\/\/cdn.prod.website-files.com\/63d954d4e4ad424df7819d46\/66e0a132e3f816ec4c4fbde6_SC100742%20-Coleman%20v.%20Ashcroft%20%20%209-10-24_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">overruled<\/a>&nbsp;his decision. <\/p>\n<h2>Montana<\/h2>\n<p>Montana law prohibits abortion beyond &ldquo;viability,&rdquo; which&nbsp;<a href=\"https:\/\/leg.mt.gov\/bills\/mca\/title_0500\/chapter_0200\/part_0010\/section_0040\/0500-0200-0010-0040.html\" target=\"_blank\" rel=\"noreferrer noopener\">the state<\/a>&nbsp;defines as beginning at 24 weeks gestation. A <a href=\"https:\/\/thefederalist.com\/2024\/08\/21\/push-to-enshrine-taxpayer-funded-abortion-until-birth-in-montana-constitution-makes-the-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a>, however, asks voters to amend their state constitution to &ldquo;expressly provide a right to make and carry out decisions about one&rsquo;s own pregnancy, including the right to abortion.&rdquo;<\/p>\n<p>The ballot initiative relies on vague language to deliberately prohibit the state from interfering with abortions at any point in pregnancy as long as a &ldquo;healthcare professional determines it is medically indicated to protect the pregnant patient&rsquo;s life or health.&rdquo; Under this sweeping modification, practically any abortion could be construed to meet&nbsp;<a href=\"https:\/\/leg.mt.gov\/bills\/mca\/title_0530\/chapter_0060\/part_0010\/section_0970\/0530-0060-0010-0970.html\" target=\"_blank\" rel=\"noreferrer noopener\">the &ldquo;medically necessary&rdquo; qualifier<\/a>&nbsp;required for taxpayer funding under Montana&rsquo;s Medicaid program.<\/p>\n<p>In addition to kneecapping the GOP legislature from passing any laws that limit abortion before the 24-week cutoff, the proposed amendment would also keep the government from holding abortionists accountable for misconduct, like ending life in the womb late in pregnancy.<\/p>\n<h2>Nebraska <\/h2>\n<p>Proponents of the &ldquo;Protect the Right to Abortion&rdquo; ballot initiative in Nebraska <a href=\"https:\/\/protectourrights.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">falsely purports<\/a> that doctors in the Cornhusker state are prevented &ldquo;from caring for patients whose pregnancies put their lives at risk&rdquo; because of the state&rsquo;s 12-week <a href=\"https:\/\/governor.nebraska.gov\/press\/governor-pillen-signs-lb574-law-abortion-ban-takes-effect-immediately\" target=\"_blank\" rel=\"noreferrer noopener\">abortion limit<\/a>.<\/p>\n<p>The Planned Parenthood- and American Civil Liberties Union-<a href=\"https:\/\/protectourrights.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">funded<\/a> amendment, which <a href=\"https:\/\/ballotpedia.org\/Nebraska_Right_to_Abortion_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">seeks to enshrine<\/a>&nbsp;abortion at any point in pregnancy in the state&rsquo;s constitution, however, would effectively eradicate protections for women, babies, and doctors.<\/p>\n<p>In addition to overriding the state&rsquo;s dismemberment ban, eliminating parental consent requirement, and preventing state legislators from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-slams-trump-for-calling-heartbeat-law-terrible-what-trump-said-was-terrible\/\" title=\"DeSantis criticizes Trump&#039;s &#039;terrible&#039; comment on Heartbeat Law.\">enacting pro-life protections<\/a> in the future, the proposed amendment leaves vague, undefined terms like &ldquo;viability&rdquo; up to the subjective judgment of a health care practitioner.<\/p>\n<p>Nebraska Secretary of State Bob Evnen approved the unlimited abortion amendment and its&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/08\/26\/abortion-and-pro-life-constitutional-amendments-duel-on-nebraska-ballots-this-fall\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-life rival<\/a>&nbsp;for the ballot in August but&nbsp;<a href=\"https:\/\/www.nbcnews.com\/news\/amp\/rcna167980\" target=\"_blank\" rel=\"noreferrer noopener\">paused<\/a>&nbsp;<a href=\"https:\/\/sos.nebraska.gov\/elections\/elections-division\" target=\"_blank\" rel=\"noreferrer noopener\">certification<\/a>&nbsp;until after the state supreme court <a href=\"https:\/\/cdn.prod.website-files.com\/63d954d4e4ad424df7819d46\/66e43fedcebf752072a0139f_N00011380PUB%20(2).pdf\" target=\"_blank\" rel=\"noreferrer noopener\">unanimously ruled it was legal<\/a> in September.<\/p>\n<h2>New York <\/h2>\n<p>New York already allows unpopular&nbsp;<a href=\"https:\/\/ag.ny.gov\/publications\/abortion-legal-and-protected-new-york-state\" target=\"_blank\" rel=\"noreferrer noopener\">unlimited abortion<\/a> as long as a medical professional deems the life or physical or mental health of the mother at risk. The proposed&nbsp;<a href=\"https:\/\/www.nyclu.org\/en\/press-releases\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">Equal Rights Amendment<\/a> on the ballot on Nov. 5, however, would further hamstring legislators who try to bring state law up to par with <a href=\"https:\/\/thefederalist.com\/2023\/06\/16\/poll-majority-of-americans-still-reject-democrats-unlimited-abortion-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">Americans&rsquo; desire to limit abortion<\/a>.<\/p>\n<p>The proposed amendment includes sweeping language and terms such as &ldquo;discrimination&rdquo; that would equip the New York Constitution with a&nbsp;<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2023\/S108\/amendment\/A\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;civil right&rdquo;<\/a>&nbsp;allowing men to play women&rsquo;s sports. Proponents of the ballot measure <a href=\"https:\/\/19thnews.org\/2023\/07\/new-york-novel-equal-rights-amendment-abortion-lgbtq-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">even<\/a>&nbsp;<a href=\"https:\/\/www.nyclu.org\/press-release\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">implied<\/a>&nbsp;that the amendment could stop the state from banning things like transgender mutilation and chemical castration for children.<\/p>\n<p>New York Supreme Court Justice Daniel Doyle&nbsp;<a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=BCfdWv_PLUS_L2PqNXxyimddw\/g==\" target=\"_blank\" rel=\"noreferrer noopener\">ruled in May<\/a>&nbsp;that the state legislature failed to satisfy the constitutionally outlined procedure for passing a ballot measure. <a href=\"https:\/\/www.nycourts.gov\/courts\/ad4\/Clerk\/Decisions\/2024\/0618T1600\/pdf\/0537.1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">By June<\/a>, however, the New York Appellate Division&rsquo;s Fourth Department Court overturned that ruling.<\/p>\n<h2>Nevada<\/h2>\n<p>Abortion in Nevada is&nbsp;currently <a href=\"https:\/\/dpbh.nv.gov\/Programs\/MIP\/AbortionInNevada\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted at any point in gestation<\/a>&nbsp;as long as &ldquo;the physician has reasonable cause to believe an abortion is necessary to preserve the life or health of the pregnant person.&rdquo; A&nbsp;<a href=\"https:\/\/www.nvsos.gov\/sos\/home\/showpublisheddocument\/12633\/638375592027970000\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a>, however, seeks to further shield abortion from any future regulation or limit by adding a&nbsp;<a href=\"https:\/\/www.nvsos.gov\/sos\/home\/showpublisheddocument\/12633\/638375592027970000\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;fundamental right to abortion&rdquo;<\/a>&nbsp;to the Nevada state constitution.<\/p>\n<p>If the amendment passes, it must&nbsp;<a href=\"https:\/\/www.nvsos.gov\/sos\/elections\/initiatives-referenda\/filing-a-constitutional-initiative\" target=\"_blank\" rel=\"noreferrer noopener\">undergo another vote in a subsequent general election<\/a>&nbsp;to achieve full ratification.<\/p>\n<h2>South Dakota<\/h2>\n<p>The pro-abortion proponents of South Dakota&rsquo;s&nbsp;<a href=\"https:\/\/ballotpedia.org\/South_Dakota_Right_to_Abortion_Amendment_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">Amendment G<\/a>&nbsp;pretend it&nbsp;<a href=\"https:\/\/www.dakotans4health.com\/abortion-rights-south-dakota\" target=\"_blank\" rel=\"noreferrer noopener\">would<\/a>&nbsp;&ldquo;restore the rights that women and girls of South Dakota had for fifty years under&nbsp;<em>Roe v. Wade<\/em>.&rdquo;<\/p>\n<p>In reality, the proposed amendment&rsquo;s vague and undefined language&nbsp;would allow the fatal practice through all nine months of pregnancy as long as a physician deems it necessary for women&rsquo;s &ldquo;health.&rdquo; It also opens the door for outside activists like Planned Parenthood and the American Civil Liberties Union <a href=\"https:\/\/sbaprolife.org\/newsroom\/press-releases\/aclu-sues-to-remove-informed-consent-in-ohio\" target=\"_blank\" rel=\"noreferrer noopener\">to sue to<\/a> eliminate&nbsp;<a href=\"https:\/\/x.com\/LilaGraceRose\/status\/1829272783148195918\" target=\"_blank\" rel=\"noreferrer noopener\">parental rights and conscience protections<\/a>&nbsp;for doctors who have moral or religious objections to abortion.<\/p>\n<p>Several&nbsp;<a href=\"https:\/\/atg.sd.gov\/docs\/Letters%20from%20AG%20Jackley%20to%20Sponsor%20R.%20Weiland%20to%20Dakotans%20for%20Health.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaints and allegations of misconduct<\/a>&nbsp;plagued the Amendment G petition process, including unattended petitions, duplicate signatures, and misleading information. Mike Rounds<\/a> and <a href=\"https:\/\/x.com\/lifedefensefund\/status\/1837692588029075777?s=46\" target=\"_blank\" rel=\"noreferrer noopener\">Gov.
