This situation started on March 5, when voters in Huntington Beach approved ballot measure 1, the Voter ID and Election Rules Amendment. Ballotpedia states that this charter amendment permitted the city to mandate voter identification for elections and establish necessary infrastructure for it. In 2023, then-Mayor Tony Strickland backed the measure despite pressure from local and state Democrats trying to undermine it. “Our democracy fails if people lack trust in election results,” Strickland told Voice of OC, emphasizing the importance of safeguards for public confidence in electoral outcomes.

Huntington Beach voters supported the measure with 53.4% approval against 46.6% opposition, with enhanced election security set to start in 2026. Following this approval, state legislators swiftly moved to nullify it entirely. In April, California Attorney General Rob Bonta and Secretary of State Shirley Weber filed a lawsuit against the city over what they termed an “unlawful” voter ID amendment, claiming without evidence that it would negatively impact low-income individuals, seniors, and people of color.

Afterward, California state Senator Dave Min proposed legislation prohibiting local governments from establishing their own voting requirements and dismissed citizens’ efforts as unfeasible: “[we] can’t have local jurisdictions implementing their own voting requirements.” Governor Newsom signed this bill into law on Sunday; it will take effect on January 1, 2025.

However, current Huntington Beach Mayor Gracey Van Der Mark is determined not to let Sacramento dictate her city’s future quietly. She questions whether the state has authority over charter cities like Huntington Beach and challenges Min’s legislation’s constitutionality. “The state cannot enact laws that infringe upon our constitutional rights,” Van Der Mark stated to LAist; thus she believes this law does not apply or affect their new election regulations.

Given Newsom’s recent signing of this law and Van Der Mark’s refusal to concede ground, a contentious legal battle between the city and state seems imminent.
