voters,&rdquo; a federal court ruled Friday.<\/p>\n<p>Writing on behalf of the U.S. District Court for the District of Arizona, Judge Michael Liburdi <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/07\/62-2024-09-27-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">placed<\/a> a preliminary injunction on a provision guiding election certification that was included in the state&rsquo;s <a href=\"https:\/\/apps.azsos.gov\/election\/files\/epm\/2023\/EPM_20231231_Final_Edits_to_Cal_1_11_2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Election Procedures Manual (EPM)<\/a> by Secretary of State Adrian Fontes. In Arizona, the EPM provides rules to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuit-both-the-how-and-the-what-of-democrat-election-chiefs-rulebook-violate-arizona-law\/\" title=\"Lawsuit: Democrat Election Chief&#039;s Rulebook Violates Arizona Law\">election officials relating<\/a> to mail ballots, voter registration, and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/alfa-bank-investigator-under-fbi-review\/\" title=\"Alfa Bank Investigator Under FBI Review\">election-related matters<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-e61c64c156b2a9a0d5a62a1d3aea1154 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-e61c64c156b2a9a0d5a62a1d3aea1154\"><\/div>\n<p>&ldquo;Given the widespread controversy surrounding elections, one would hope the last people responsible for disenfranchising voters and suppressing speech would be the very election officials tasked with ensuring fair and accurate elections,&rdquo; Liburdi wrote. &ldquo;But, according to Plaintiffs, that is precisely the case here.&rdquo;<\/p>\n<p>The <a href=\"https:\/\/americafirstpolicy.com\/assets\/uploads\/files\/DKT_01_07.08.2024_Complaint_2_.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> was filed by the America First Policy Institute, American Encore, and an Arizona resident against Fontes and Democrat Attorney General Kris Mayes.<\/p>\n<p>The canvass <a href=\"https:\/\/apps.azsos.gov\/election\/files\/epm\/2023\/EPM_20231231_Final_Edits_to_Cal_1_11_2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">provision<\/a> promulgated by Fontes and subsequently approved by Mayes and Democrat Gov. Katie Hobbs along with the rest of the EPM stipulates that if a county does not certify and submit its election results for final canvassing by the state-mandated deadline, then the secretary of state &ldquo;must proceed with the state canvass without including the votes of the missing county.&rdquo; In other words, electors whose county does not certify the results by the deadline will not have their votes counted during Fontes&rsquo; canvassing of the state&rsquo;s election results.<\/p>\n<p>The provision appears to have been aimed at preventing another certification dispute like that which occurred in Cochise County during the state&rsquo;s 2022 midterms. Republican members of the county&rsquo;s board of supervisors <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/arizona-judge-orders-cochise-county-officials-to-certify-election-results-by-end-of-day\" target=\"_blank\" rel=\"noreferrer noopener\">delayed<\/a> certifying the 2022 results after <a href=\"https:\/\/thefederalist.com\/2022\/11\/23\/maricopa-county-made-arizonas-elections-even-more-of-a-disaster-than-people-realize\/\" target=\"_blank\" rel=\"noreferrer noopener\">election misadministration<\/a> in Maricopa County disenfranchised an untold number of voters.<\/p>\n<div class=\"fdrlst__b89e9-69e90f11bf90b1c6da13946d4229cc7c fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-69e90f11bf90b1c6da13946d4229cc7c\"><\/div>\n<p>While the county&rsquo;s results were ultimately certified, Mayes <a href=\"https:\/\/dailycaller.com\/2023\/11\/29\/dem-ag-unveils-indictment-against-republican-election-officials-who-pushed-for-hand-counting-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> indictments against the GOP board members in November 2023 over their actions in the matter. <\/p>\n<p>In his decision, Liburdi eviscerated Fontes&rsquo; canvassing rule, writing that it is &ldquo;utterly without precedent.&rdquo; He further noted how, if enacted, it would give the secretary &ldquo;nearly <em>carte blanche<\/em> authority to disenfranchise the ballots of potentially millions of Arizona voters.&rdquo; <\/p>\n<p>&ldquo;If the right to vote &lsquo;is the right of qualified voters within a state to cast their ballots and have them <em>counted<\/em>&lsquo; &hellip; then the Canvass Provision imposes the most severe burden: state-sanctioned disenfranchisement,&rdquo; he wrote (emphasis Liburdi&rsquo;s). &ldquo;Defendants&rsquo; position is that it is better for election results to be final, as opposed to accurate, and, in true utilitarian fashion, it is better to disenfranchise &lsquo;a few&rsquo; (potentially millions), as opposed to all. But what value does finality accomplish when it is attained at the expense of democracy?&rdquo;<\/p>\n<p>Liburdi also issued a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-officially-asks-supreme-court-to-block-texas-pro-life-law\/\" title=\"DOJ Officially Asks Supreme Court To Block Texas Pro-Life Law\">preliminary injunction barring enforcement<\/a> of a separate EPM provision challenged by plaintiffs that attempted to govern Arizonans&rsquo; speech and conduct at polling locations. The district court judge noted how the EPM&rsquo;s speech provision &ldquo;broadly encroaches on a substantial amount of constitutionally protected speech&rdquo; and unlawfully empowers election officials &ldquo;to use their &lsquo;sound judgment&rsquo; to remove voters for using &lsquo;offensive&rsquo; or &lsquo;insulting speech.&rsquo;&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-e50d3a130b03ff7bc9f49f4d9293fa7a fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e50d3a130b03ff7bc9f49f4d9293fa7a\"><\/div>\n<p>A state district court previously <a href=\"https:\/\/thefederalist.com\/2024\/08\/08\/court-democrat-election-chiefs-rulebook-illegally-restricts-arizonans-free-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">placed<\/a> an injunction on the EPM&rsquo;s speech guidance in August. A state appellate court <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/02\/2024-09-27-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> a temporary partial stay &ldquo;pending appeal&rdquo; in the case on Friday.<\/p>\n<p>Liburdi&rsquo;s preliminary injunctions prohibit enforcement of the EPM&rsquo;s speech and canvassing provisions while litigation continues.
