The DNC, along with the Democratic Party \u2064of Georgia and supported by Vice President Kamala Harris&#8217;s campaign, \u200cargues that the decision\u2014made in a \u200bnarrow 3-2 vote on September 20\u2014could \u200ccause significant disruptions on Election Day, \u2064leading to delays in results and potential \u200dsecurity issues regarding the ballots. The lawsuit \u200dseeks to have the \u2062court declare the new Hand Count Rule as exceeding the board&#8217;s statutory authority,\u200c claiming \u2064it undermines the integrity \u2062of \u200bthe state&#8217;s election laws and poses a risk of \u200dchaos on election night. The requirement \u2062specifies that election workers \u2064must perform hand counts on November 5, in\u200b addition to the standard machine tallies. (AP Photo\/Mike Stewart, file)<\/figcaption><\/figure>\n<p>&ldquo;To protect the sanctity of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/no-spike-in-florida-coronavirus-cases-despite-no-mask-mandate\/\" title=\"No Spike in Florida Coronavirus Cases Despite No Mask Mandate\">state&#038;rsquo<\/a>;s laws and to prevent election night chaos, this Court should declare that the Hand Count Rule exceeds SEB&rsquo;s statutory authority,&rdquo; <a href=\"https:\/\/www.nytimes.com\/2024\/09\/30\/us\/politics\/georgia-election-board-hand-counting-ballots-lawsuit.html\" target=\"_blank\" rel=\"noopener\" title>according<\/a> to a copy of the lawsuit obtained by the <em>New York Times<\/em>. <\/p>\n<p>The lawsuit was not immediately available on the Fulton County Superior Court docket.<\/p>\n<p>Under the new rule, ballots in Georgia are to be hand-counted by election workers the night of Nov. 5 in addition to normal machine tallies that take place. <\/p>\n<p>The rule change was celebrated by allies of former President&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>, who believe the changes will help alleviate concerns about voter fraud the former president raised four years ago after President Joe Biden&rsquo;s narrow victory in the Peach State.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mailing-it-in-swing-state-ballot-lawsuits-could-shape-2024-presidential-race-washington-examiner\/\" title=\"Swing State Ballot Lawsuits May Impact 2024 Presidential Race - Washington Examiner\">state election board&#038;rsquo<\/a>;s chairman, John Fevier, previously warned the three members who voted to change the rules that their decision went against the advice of their legal counsel.<\/p>\n<p><strong><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/strong><\/p>\n<p>This is the second lawsuit to be filed by Democrats against the Georgia State Election Board in the past month, as more election-related litigation continues to pop up roughly a month before Election Day.<\/p>\n<p>The other lawsuit is against the state election board&rsquo;s &ldquo;reasonable inquiry&rdquo; and &ldquo;examination&rdquo; rule, which critics say could affect the timeliness of the state&rsquo;s election certification.
