The case\u200d was dismissed by a trial judge, leading the Buckeye Institute to\u200d intervene and file the appeal \u2064on behalf of the plaintiffs. Cleveland. There simply are no administrative remedies to exhaust, and the law is clear,&rdquo;&nbsp;said Jay R. Carson, senior litigator at The Buckeye Institute and an attorney representing Wos and Steffes. &ldquo;Cleveland owes Ms. Wos, Mr. Steffes, and any other affected taxpayers, interest for failing to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-a-big-tax-refund-shouldnt-excite-you\/\" title=\"Why a Big Tax Refund Shouldn\u2019t Excite You\">issue tax refunds<\/a> within 90 days.&rdquo;<\/p>\n<p>The institute initially filed the lawsuit&nbsp;<strong><a href=\"https:\/\/www.thecentersquare.com\/ohio\/article_cf1dc048-dbf7-11ee-9914-6fead1282aab.html\" target=\"_blank\" rel=\"noreferrer noopener\">in March<\/a><\/strong>.<\/p>\n<p>Cleveland&rsquo;s law says when the city owes a tax refund, it is subject to interest at the rate of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/despite-skyrocketing-inflation-janet-yellen-will-keep-pushing-for-biden-spending-agenda\/\" title=\"Despite Skyrocketing Inflation, Janet Yellen Will Keep Pushing For Biden Spending Agenda\">federal funds rate<\/a> of nearly 5% plus another 5% if it&rsquo;s not paid within 90 days after a return is filed.<\/p>\n<p>Ohio House Bill 110 allowed Ohioans to seek municipal income tax refunds for 2020 and 2021, and Wos filed her 2021 city return March 12, 2023, according to the&nbsp;<strong><a href=\"https:\/\/www.buckeyeinstitute.org\/library\/docLib\/2024-03-06-The-Buckeye-Institute-Complaint-in-Wos-v-Cleveland.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a><\/strong>.<\/p>\n<p>She received her refund six months later in September. It did not include any interest.<\/p>\n<p>Steffes filed his return for 2021 for a refund when his employer, Stantec, closed its Cleveland office during the COVID-19 pandemic and was told to work from home.<\/p>\n<p>The lawsuit says Steffes received his refund in late 2023, also without interest.
