Despite increasing calls for\u2063 his resignation, Adams remains defiant \u200dand\u2064 insists he will not step down. The city\u200c charter prohibits voter removal of the mayor, and an\u2062 indictment does not necessitate resignation. The only means for his removal lies with Governor Kathy \u200bHochul, who has acknowledged the indictment but \u2062has refrained from making further comments until more information emerges.<\/p>\n<p>Governor Hochul has \u200cthe authority to temporarily remove Adams for up to 30 days\u200d and potentially longer after an opportunity for him to defend himself. The New York City charter doesn&rsquo;t allow voters to remove Adams prematurely, and an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-russia-indictment-exists-to-associate-good-media-with-putin\/\" title=\"DOJ Russia Indictment Exists To Associate Good Media With Putin\">indictment doesn&#038;rsquo<\/a>;t require him to resign. Hochul is aware of these concerning news reports and is monitoring the situation,&rdquo; Hochul press secretary Avi Small <a href=\"https:\/\/www.nbcnewyork.com\/news\/politics\/kathy-hochul-eric-adams-resign-nyc-mayor\/5830872\/\" target=\"_blank\" rel=\"noopener\" title=\"told\">told<\/a> NBC New York. &ldquo;It would be premature to comment further until the matter is confirmed by law enforcement.&rdquo;<\/p>\n<p>Under the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bill-de-blasio-establishes-racial-justice-commission-stocked-with-aides-and-allies\/\" title=\"Bill De Blasio Establishes \u2018Racial Justice\u2019 Commission Stocked With Aides And Allies\">city charter<\/a>, Hochul has the authority to remove Adams for up to 30 days and then remove him &ldquo;after service upon him of a copy of the charges and an opportunity to be heard in his defense,&rdquo; the <em>New York Times<\/em> <a href=\"https:\/\/www.nytimes.com\/2024\/09\/25\/nyregion\/impeach-adams-governor-ny-city-charter.html\" target=\"_blank\" rel=\"noopener\" title=\"reported\">reported<\/a>.<\/p>\n<p>This power has not been used in New York City&rsquo;s history. The closest parallel was in 1931, when then-Gov. Franklin D. Roosevelt held 14 days of hearings regarding the alleged corruption of Mayor Jimmy Walker, which pushed him to resign before further action could be taken.<\/p>\n<p>James McGuire, who was counsel to former Gov. George Pataki, said the most likely course to remove Adams would be &ldquo;to use the removal power as a club to force resignations.&rdquo;<\/p>\n<p>&ldquo;When the Constitution, statutes, and City Charter are read together, the governor has broad latitude in deciding what actions or failures to act would justify removing a mayor from office,&rdquo; he said, adding that though some charges are required, courts haven&rsquo;t decided how specific they must be.<\/p>\n<p>However, a source <a href=\"https:\/\/nypost.com\/2024\/09\/25\/us-news\/what-happens-next-if-eric-adams-resigns-as-nyc-mayor-this-lefty-pol-takes-over-temporarily\/\" target=\"_blank\" rel=\"noopener\" title=\"speaking with\">speaking with<\/a> the <em>New York Post<\/em> cast doubt on the matter, as Public Advocate Jumaane Williams, a progressive Democrat, would replace Adams until a special election was held for the next mayor.<\/p>\n<p>An early special election would be sure to draw a slew of candidates in addition to those already declared for the 2025 race.<\/p>\n<p>Two of the leading candidates, City Comptroller Brad Lander and state Sen. Zellnor Myrie, were among the first to call on Adams to resign after the revelation of his indictment. Former City Comptroller Scott Stringer also called on the mayor to resign, though he is only &ldquo;exploring&rdquo; a mayoral bid after a failed attempt in 2021, the <em>New York Post<\/em> <a href=\"https:\/\/nypost.com\/2024\/09\/26\/us-news\/nyc-mayor-eric-adams-indictment-could-open-the-door-for-these-potential-2025-challengers\/\" target=\"_blank\" rel=\"noopener\" title=\"reported\">reported<\/a>.<\/p>\n<p>Recently announced mayoral candidate Assemblyman Zohran Mamdani, a Democratic Socialist, called on Adams to resign.<\/p>\n<p>Though he remained silent, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/opinion-desantis-derangement-syndrome-is-spreading\/\" title=\"OPINION: \u2018DeSantis Derangement Syndrome\u2019 Is Spreading\">dark horse candidate<\/a> to replace Adams is former Gov. Andrew Cuomo, who is eyeing a comeback after resigning in disgrace three years ago over sexual assault allegations.<\/p>\n<p>Despite the sharks circling, however, Adams has insisted that there&rsquo;s no chance he will resign.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong><\/strong><\/a><\/p>\n<p>&ldquo;I will fight these injustices with every ounce of my strength and my spirit. If I&rsquo;m charged, I know I am innocent, I will request intermediate trials so the New Yorkers can hear the truth,&rdquo; he said in a video statement on Wednesday night.<\/p>\n<p>&ldquo;Now, if I am charged, many may say I should resign because I cannot manage the city while fighting the case,&rdquo; Adams continued. &ldquo;I can also understand everyday New Yorkers would be concerned that I cannot do my job while I face accusation. But I have been facing these lies for months since I began to speak out for all of you and their investigation started, yet the city has continued to improve.
