Both candidates had only submitted one combined petition based on guidance from Georgia Secretary of \u2064State Brad Raffensperger. The court has instructed that notices be placed at polling locations to inform voters that ballots \u2062cast for West and De la Cruz will not be valid. <\/p>\n<p>West and De la Cruz\u200b have \u2063criticized the Democratic Party for what \u2064they\u200b describe as &#8220;lawfare&#8221; aimed at reducing voter choice and suppressing third-party candidates that\u200b could potentially harm Vice \u200bPresident\u200d Kamala Harris&#8217;s chances in the election. Following \u2063the\u2063 ruling,\u2064 the candidates expressed their intent to \u2063continue fighting the decision against the\u2063 Democratic Party&#8217;s legal challenges. This situation follows similar efforts by Democrats\u200c in \u2064other states, resulting in\u2062 candidates\u2064 like West being removed from ballots\u200d in Michigan and Pennsylvania, with \u200bGreen Party candidate \u200cJill\u200d Stein also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-lakers-expected-to-fire-head-coach-frank-vogel\/\" title=\"The Lakers Expected to Fire Head Coach Frank Vogel\">facing elimination<\/a> in Nevada.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Georgia Supreme Court unanimously ruled Wednesday that presidential candidates Cornel West and Claudia De la Cruz do not qualify to appear on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/no-spike-in-florida-coronavirus-cases-despite-no-mask-mandate\/\" title=\"No Spike in Florida Coronavirus Cases Despite No Mask Mandate\">state&#038;rsquo<\/a>;s ballot, meaning any votes cast for either candidate will not be counted. Democrats have launched lawfare efforts against the candidates in several states where they could potentially hurt Vice President Kamala Harris&rsquo; chances of winning.<\/p>\n<p>The court <a href=\"https:\/\/www.gasupreme.us\/wp-content\/uploads\/2024\/09\/s25a0177.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that the presidential electors for both <a href=\"https:\/\/thefederalist.com\/2024\/09\/13\/democrat-led-lawfare-campaign-gets-third-party-candidates-kicked-off-georgia-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">West and De la Cruz<\/a> failed to submit proper petitions with the required signatures after Democrats <a href=\"https:\/\/georgiarecorder.com\/2024\/08\/09\/third-party-candidates-still-battling-for-spot-on-georgia-ballot-as-alternative-to-trump-harris\/\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a> the candidates. The court ruled each elector was required to submit a separate petition with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/seven-states-where-democrats-plot-to-use-abortion-as-winning-strategy\/\" title=\"Seven States Where Democrats Strategize Using Abortion as a Winning Tactic\">required signatures needed<\/a> to qualify for the ballot. That means each of West and De la Cruz&rsquo;s 16 electors needed to file individual petitions with 7,500 signatures. But both West and De la Cruz submitted only one petition following guidance from Georgia Secretary of State Brad Raffensperger.<\/p>\n<p>&ldquo;We now hold that each presidential elector for an independent candidate running for the office of President of the United States is a &lsquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-debate-win-means-nothing-if-the-gop-doesnt-chase-ballots\/\" title=\"Trump&#039;s Debate Win Means Nothing If The GOP Doesn&#039;t Chase Ballots\">candidate&#038;rsquo<\/a>; required to file a notice of candidacy under [state law] applies to each presidential elector for an independent candidate running for the office of President of the United States; and, under [state law], each presidential elector is therefore required to file a nomination petition in his or her own name &lsquo;in the form prescribed in Code Section 21-2-170,&#8217;&rdquo; the court ruled. <\/p>\n<p>The court ordered Raffensperger to place notices in polling locations warning that votes cast for West and De la Cruz will not count since new ballots without the candidates&rsquo; names cannot be reprinted in time for the Nov. 5 election.<\/p>\n<p>West and De la Cruz have not yet released a statement on the ruling. Both previously decried Democrats&rsquo; lawfare efforts after Raffensperger permitted both candidates to appear on the ballot despite an administrative law judge ruling the duo were ineligible, according to <a href=\"https:\/\/georgiarecorder.com\/briefs\/judge-says-four-independent-and-third-party-presidential-candidates-should-not-be-on-georgia-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia Recorder<\/a>.  <\/p>\n<p>&ldquo;The Democratic Party wanted to restrict the choices available to Georgia voters because they didn&rsquo;t want to compete with a socialist campaign that offers real solutions to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-led-lawfare-gets-3rd-party-candidates-kicked-off-ga-ballot\/\" title=\"Dem-Led Lawfare Gets 3rd-Party Candidates Kicked Off GA Ballot\">huge problems facing working people<\/a>,&rdquo; De la Cruz said, according to Georgia Recorder. <\/p>\n<p>&ldquo;We are proud to have stood up for our rights and the right of everyone in Georgia to vote for the candidate of their choosing,&rdquo; De la Cruz reportedly continued. &ldquo;But this is not the end of the fight. ow, we are preparing to defend this legal victory from any appeal filed by the Democratic Party&rsquo;s well-funded army of lawyers who are waging war on third parties nationwide.&rdquo;<\/p>\n<p>Democrats have already booted <a href=\"https:\/\/thefederalist.com\/2024\/08\/19\/michigan-democrats-boot-third-party-candidate-cornel-west-off-november-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">West off the ballot<\/a> in Michigan after challenging his paperwork. Pennsylvania&rsquo;s Democrat-controlled supreme court <a href=\"https:\/\/thefederalist.com\/2024\/09\/17\/pennsylvanias-democrat-controlled-supreme-court-kicks-cornel-west-off-2024-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">also recently kicked<\/a> West off the ballot over a paperwork issue, according to the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/presidential\/3133707\/court-rules-cornel-west-cant-be-on-ballot-pennsylvania\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington Examiner<\/a>. The court also ruled that De la Cruz and third-party candidate James Clymer could also not appear on the ballot.<\/p>\n<p>But it&rsquo;s not just West, De la Cruz, and Clymer who have been victims of Democrats&rsquo; lawfare. Green Party candidate Jill Stein was kicked off the Nevada ballot after the state&rsquo;s Supreme Court &ldquo;agreed with state Democrats&rsquo; claims that the Green Party used incorrect affidavit language on its signature petition,&rdquo; as my colleague Shawn Fleetwood <a href=\"https:\/\/thefederalist.com\/2024\/09\/09\/nevada-supreme-court-grants-democrats-request-to-kick-green-party-off-2024-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>. But as Fleetwood explains, &ldquo;The affidavit language used by the third party, however, was provided by the office of Secretary of State Cisco Aguilar, a Democrat.&rdquo;<\/p>\n<p>Meanwhile, after fighting to get <a href=\"https:\/\/thefederalist.com\/2024\/09\/10\/north-carolina-supreme-court-orders-rfk-jr-s-removal-from-ballots\/\" target=\"_blank\" rel=\"noreferrer noopener\">Robert F. Kennedy Jr.<\/a> <em>off<\/em> the ballot, Democrats are now working overtime to keep his name on the ballot in key swing states. Kennedy announced he would be dropping out of the race in key swing states and <a href=\"https:\/\/thefederalist.com\/2024\/08\/23\/rfk-jr-drops-out-of-2024-race-endorses-trump-for-president\/\" target=\"_blank\" rel=\"noreferrer noopener\">endorsed<\/a> former President Donald Trump.
