The issue arose when it was discovered that these voters had not provided the required documentary proof of citizenship during ⁢the registration process, yet they were still ‍classified as ‌eligible ⁢to vote in full⁤ state contests. Chief Justice Ann Scott Timmer emphasized that disenfranchising these voters would not only⁢ be unjust but also inconsistent with state law. The registration error appears to stem ⁣from how the Motor Vehicle Division transmits driver’s license information to the⁣ voter registration system. The court’s ruling rejected a ‌request from Maricopa County Recorder Stephen Richer to classify these voters as “federal-only” voters, who would only be permitted to vote in federal elections, indicating that the administrative failure should‌ not penalize the voters. The decision reflects a broader concern about voter access and fairness in the electoral process.

                  Image CreditEdmond Dantès/Pexels

Share

                         Share Article on Facebook

                         Share Article on Twitter

                         Share Article on Truth Social

                         Copy Article Link

                         Share Article via Email

<a target="_blank" href="http://thefederalist.com/#" rel="nofollow noopener" onclick="window.print(); Chief Justice Ann Scott Timmer stated, “[W]e are unwilling on these facts to disenfranchise voters en masse from participating in state contests,” emphasizing that such action is not supported by state law and would breach due process principles.

The situation arose last week when state officials disclosed that approximately 97,000 individuals on the voter registration lists were categorized as full-ballot voters despite lacking documentary proof of citizenship (DPOC). According to Votebeat Arizona, a left-leaning outlet, this long-standing error seems to stem from how the Motor Vehicle Division shares driver’s license data with the state’s voter registration system. Secretary of State Adrian Fontes noted that these voters tend to be predominantly Republican and are aged between 45 and 60.

In Arizona, individuals registering through the state form must provide DPOC to vote in local and state elections; those who cannot do so are classified as “federal-only” voters and can only participate in federal races. Following last week’s findings, Maricopa County Recorder Stephen Richer filed a lawsuit urging the state supreme court to require Fontes to designate these 97,000 voters as federal-only until they submit DPOC. However, Fontes and prominent Republicans contended that these individuals should be allowed full voting rights this November.

Supporting Fontes and Republicans’ stance, Timmer rejected Richer’s request and concluded that Maricopa County’s recorder had not demonstrated any statutory authority for removing these affected voters from participating in the upcoming 2024 General Election for federal offices or matters on an Arizona ballot. She highlighted that it was particularly unjust given a state administrative failure allowed these individuals to register without confirming their DPOC when obtaining their driver’s licenses—especially with limited time before the election.

The high court also dismissed an intervention motion from Arizona’s GOP legislative leadership but approved their request to file an amicus curiae response while allowing them extra word count for their brief. Before Friday’s ruling, Strong Communities Foundation of Arizona—a conservative grassroots group—and resident Yvonne Cahill submitted an amicus brief asking the court for a solution balancing Richer’s proposals with those of Fontes and Republican leaders.
