According to the Detroit Free Press, county clerks must <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/elections\/2024\/09\/20\/robert-f-kennedy-ballot-fight-us-6th-circuit-court-of-appeals\/75309759007\/\" target=\"_blank\" rel=\"noreferrer noopener\">deliver<\/a> absentee ballots to local clerks by Saturday, and &ldquo;absentee ballots must be available to the general public by next Thursday.&rdquo;<\/p>\n<h2>The Ruling<\/h2>\n<p>Kennedy <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCOURTS-mied-2_24-cv-12375\/pdf\/USCOURTS-mied-2_24-cv-12375-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> the federal court for a preliminary injunction to keep Benson from &ldquo;improperly and illegally&rdquo; placing his name on the ballot, according to the ruling. He claimed violations of the Constitution&rsquo;s Article 2, Section 1 &mdash; which covers the selection of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-joy-reid-compare-trump-surviving-a-shooting-to-biden-surviving-covid-in-a-wild-segment\/\" title=\"Watch Joy Reid compare Trump surviving a shooting to Biden surviving COVID in a wild segment\">president &#038;mdash<\/a>; the First Amendment&rsquo;s guarantee of free speech, and the 14th Amendment&rsquo;s equal protection clause.<\/p>\n<p>Hood <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCOURTS-mied-2_24-cv-12375\/pdf\/USCOURTS-mied-2_24-cv-12375-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> against Kennedy, saying he was &ldquo;not likely to succeed on the merits of this case.&rdquo; Benson claimed Kennedy delayed raising his concerns, making her &ldquo;unable to meet statutory deadlines for providing ballots to the county clerks.&rdquo;<\/p>\n<p>But Kennedy argued that &ldquo;printing and mailing ballots with Mr. Kennedy&rsquo;s name appearing as a candidate for an office he no longer seeks cancels his statutory and constitutional rights,&rdquo; adding that &ldquo;his supporters will be left confused and potentially angry should they later learn that a vote cast for Mr. Kennedy in Michigan was an invalid, wasted vote,&rdquo; according to the ruling.&nbsp;<\/p>\n<p>Hood dismissed these arguments, saying Kennedy &ldquo;has not established a likelihood of irreparable harm.&rdquo;<\/p>\n<p>&ldquo;Plaintiff&rsquo;s only stated harm is to his reputation,&rdquo; Hood ruled. &ldquo;Reprinting ballots at this late hour would undoubtedly halt the voting process in Michigan and cause a burden to election officials. The Natural Law Party will also face harm.&rdquo;<\/p>\n<h2>Legal Battles<\/h2>\n<p>When Kennedy&rsquo;s campaign <a href=\"https:\/\/thefederalist.com\/2024\/09\/10\/michigan-supreme-court-lets-election-chief-add-rfk-jr-back-to-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> to take his name off the ballot, the Natural Law Party contacted the state director of elections, as The Federalist previously reported.&nbsp; The party opposed Kennedy&rsquo;s request, saying this would leave the party without a nominee before November&rsquo;s election.<\/p>\n<p>So Benson said she would keep Kennedy&rsquo;s name on the ballot over his objections. Her office claimed &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sarah-palin-advances-to-november-election-for-house-seat\/\" title=\"Sarah Palin Advances to November Election for House Seat\">minor party candidates<\/a> cannot withdraw&rdquo; and cited the Natural Law Party&rsquo;s concerns.&nbsp;<\/p>\n<p>Democrat election officials in other states posed <a href=\"https:\/\/thefederalist.com\/2024\/08\/28\/dems-are-fighting-to-keep-rfk-jr-on-swing-state-ballots-as-potential-spoiler-against-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">similar<\/a> obstacles to Kennedy&rsquo;s removal from the ballot, where his absence might open more voters for Trump and hurt Vice President Kamala Harris&rsquo; chances at victory.<\/p>\n<p>Kennedy filed a <a href=\"https:\/\/thefederalist.com\/2024\/09\/10\/michigan-supreme-court-lets-election-chief-add-rfk-jr-back-to-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a> in the court of claims on Aug. 30. The court denied Kennedy&rsquo;s request, so he escalated his case to the court of appeals.<\/p>\n<p>The court of appeals found Kennedy had a &ldquo;clear legal right to have his name removed from the ballot,&rdquo; according to its <a href=\"https:\/\/www.courts.michigan.gov\/4a4ff9\/siteassets\/case-documents\/uploads\/opinions\/final\/coa\/20240906_c372349_28_372349.opn.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a>. They <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/elections\/2024\/08\/16\/michigan-disqualifies-cornel-west-november-election\/74832390007\/\" target=\"_blank\" rel=\"noreferrer noopener\">cited<\/a> technicalities with his identity notarization and allegations his ballot petitions were &ldquo;<a href=\"https:\/\/www.detroitnews.com\/story\/news\/politics\/2024\/09\/09\/robert-kennedy-rfk-jr-name-stays-on-ballot-michigan-supreme-court-ruling-donald-trump-kamala-harris\/75141686007\/\" target=\"_blank\" rel=\"noreferrer noopener\">fraudulent<\/a>,&rdquo; according to the Detroit Free Press.<\/p>\n<div>\n<p>West would likely <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/republicans-are-central-in-an-effort-to-rescue-cornel-wests-ballot-hopes-in-arizona\" target=\"_blank\" rel=\"noreferrer noopener\">hurt<\/a> Harris&rsquo; chances with his presence on the ballot.
