On Wednesday, Republican Governor Jim Pillen convened with around twenty state senators and Secretary of State Bob Evnen at his residence to advocate for legislation that would allocate Nebraska’s five Electoral College votes to the presidential candidate who receives the highest number of votes statewide. South Carolina GOP Senator Lindsey Graham was also reportedly present at this meeting, as noted by the left-leaning Nebraska Examiner.

Nebraska is one of only two states—Maine being the other—that divides its Electoral College votes. According to the National Archives, these states assign individual electors based on popular vote outcomes in each Congressional district and then award two additional “at-large” electors based on overall statewide results. In the 2020 election, Joe Biden secured one electoral vote by winning Nebraska’s 2nd District, while Trump won Maine’s 2nd District and its corresponding electoral vote.

As previously highlighted by my colleague Brianna Lyman, the outcome in Nebraska’s 2nd District could significantly influence which candidate wins the presidential election. For instance, if Kamala Harris were to win Pennsylvania, Michigan, and Wisconsin but lose Georgia, Nevada, and Arizona—she could still reach 270 electoral votes if she obtained just one from Nebraska.

As it stands on Wednesday, Republicans have not yet reached the necessary 33 votes required to overcome a potential filibuster and enact legislation transitioning Nebraska to a winner-take-all system before November 5th. GOP Senators Tom Brewer and Loren Lippincott—the bill’s sponsors—estimate they currently have support from about 30-31 legislators.

Brewer stated that while he informed them that his committee is prepared if they can secure enough votes, he believes their chances are quite slim given their current standing (the Cornhusker State has a unicameral legislature where Republicans hold a supermajority of 33-15).

The meeting did not seem to sway Senator Mike McDonnell; according to his spokesperson who spoke with Examiner on Thursday after attending Wednesday’s gathering: “as of today,” McDonnell remains opposed to changing how Electoral College votes are allocated in Nebraska. However, some attendees mentioned that he was exploring ways to support it despite expressing concerns.

Governor Pillen will not call for a special session until Republicans confirm they have secured all necessary votes for passing this bill as per his statement released on September 13th.

In addition to backing from both Pillen and Trump himself, efforts within the legislature towards adopting this winner-take-all system have garnered support from members of Nebraska’s congressional delegation as well. They sent a letter expressing their collective endorsement for such changes directly addressed to both Governor Pillen and Speaker John Arch: “We need a President that will represent all of us… We urge you return Nebraska back toward apportioning electoral votes based solely upon winner-take-all.”

For further updates regarding elections news visit electionbriefing.com.
Shawn Fleetwood serves as staff writer at The Federalist; he holds an academic degree from University Mary Washington along with previous experience writing content related state issues through Convention States Action among others including RealClearPolitics & Conservative Review platforms where his work has been featured widely online!
