Arizona GOP Chair Gina Swoboda said in a <a href=\"https:\/\/mailchi.mp\/b06235c06866\/for-immediate-release?e=743589bf7c\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. &ldquo;Rushing to disenfranchise voters now would not only be illegal but would severely undermine confidence in our elections.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-bbcab015c66f678e31a0f8461f517665 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-bbcab015c66f678e31a0f8461f517665\"><\/div>\n<p>As my colleague Brianna Lyman <a href=\"https:\/\/thefederalist.com\/2024\/09\/18\/arizona-finds-100000-voters-lacking-citizenship-proof-on-wrong-list-after-catching-noncitizen-on-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the issue in question came to light earlier this week when state officials revealed they &ldquo;found approximately&nbsp;<a href=\"https:\/\/x.com\/stephen_richer\/status\/1836080041631121913\" target=\"_blank\" rel=\"noreferrer noopener\">97,000 voters<\/a>&nbsp;who are currently listed as full-ballot voters despite having not fulfilled the requirement to provide documentary proof of citizenship to vote in statewide elections.&rdquo; The error appears to have resulted &ldquo;from the way the Motor Vehicle Division provides driver&rsquo;s license information to the state&rsquo;s voter registration system,&rdquo; according to left-leaning <a href=\"https:\/\/www.votebeat.org\/arizona\/2024\/09\/17\/citizenship-proof-records-error-federal-only-voter-registration-eligibility\/\" target=\"_blank\" rel=\"noreferrer noopener\">Votebeat Arizona<\/a>.<\/p>\n<p>Secretary of State Adrian Fontes said these voters &ldquo;<a href=\"https:\/\/www.votebeat.org\/arizona\/2024\/09\/17\/citizenship-proof-records-error-federal-only-voter-registration-eligibility\/\" target=\"_blank\" rel=\"noreferrer noopener\">lean more heavily Republican<\/a>&rdquo; and are between 45-60 years old, as reported in the Votebeat article.<\/p>\n<p>In Arizona, <a href=\"https:\/\/azsos.gov\/elections\/about-elections\/elections-procedures\/vr-procedures\" target=\"_blank\" rel=\"noreferrer noopener\">voters<\/a> registering via state registration form must provide documentary proof of citizenship (DPOC) to vote in state and local races. Those who are unable to provide such proof are registered as &ldquo;federal-only&rdquo; voters and can only cast ballots in federal races.<\/p>\n<p>Maricopa County Recorder Stephen Richer filed a <a href=\"https:\/\/www.documentcloud.org\/documents\/25148627-county-to-sos-lawsuit\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> with the Arizona Supreme Court on Tuesday, asking that the secretary be forced to classify the 97,000 registrants as &ldquo;federal-only&rdquo; voters until they provide DPOC demonstrating their eligibility to vote in state and local elections. This is the opposite position of Fontes, who in a <a href=\"https:\/\/www.azcourts.gov\/Portals\/201\/2024_09_18_05270861-0-0000-ArizonaSecretaryOfStateAdrianF.PDF\" target=\"_blank\" rel=\"noreferrer noopener\">response<\/a> filed Wednesday argued the court &ldquo;should reject [Richer&rsquo;s] interpretation of the law, and order that the Affected Voters be permitted to vote a full ballot&rdquo; for the November contest. <\/p>\n<div class=\"fdrlst__b89e9-f72e4998867b841bfcb5ba2d3f2c875f fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-f72e4998867b841bfcb5ba2d3f2c875f\"><\/div>\n<p>Siding with Fontes, the Arizona GOP filed an <a href=\"https:\/\/drive.google.com\/file\/d\/1yKKhD8CqxkazJX99wfn5CG2E8R5WTSt1\/view\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a> with the high court on Wednesday, in which they argued the relief sought by Richer &ldquo;would violate both state and federal law and should be denied.&rdquo;<\/p>\n<p>&ldquo;Here, given the proximity to the election, it is less likely that voters will stay home than they will show up to vote without knowing that there is any problem with their registration,&rdquo; the brief reads. &ldquo;In other words, U.S. citizen voters who have lived in Arizona for decades and consistently participated in state elections without issue are likely to show up at their polling place on November 5 only to learn that they have been disenfranchised by a state government clerical error of which they had no prior knowledge.&rdquo;<\/p>\n<p>Arizona&rsquo;s GOP legislative leadership also <a href=\"https:\/\/www.azfamily.com\/2024\/09\/18\/arizona-gop-wants-full-ballots-97k-voters-affected-by-mvd-record-error\/\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> requested the Arizona Supreme Court allow the 97,000 voters in question to vote &ldquo;full-ballot&rdquo; this November in a brief, according to a Wednesday report. As described by local media, the lawmakers argued that &ldquo;the court should defer any fix until after the 2024 general election to avoid overlapping the early voting window and the notice-and-cure period.&rdquo;<\/p>\n<p>Strong Communities Foundation of Arizona, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-heritage-foundation-chuck-schumer-using-january-6-to-seize-permanent-power-by-breaking-filibuster\/\" title=\"Exclusive \u2014 Heritage Foundation: Chuck Schumer Using January 6 to Seize \u2018Permanent Power\u2019 by Breaking Filibuster\">conservative grassroots organization<\/a>, and state resident Yvonne Cahill similarly <a href=\"https:\/\/x.com\/merissahamilton\/status\/1836583202913411261\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> an <a href=\"https:\/\/acrobat.adobe.com\/id\/urn:aaid:sc:US:608e0d8f-9fed-4a11-96e4-8b3c287c7e91?viewer%21megaVerb=group-discover\" target=\"_blank\" rel=\"noreferrer noopener\">amicus brief<\/a> on Wednesday. In contrast, Fontes argued against Richer&#8217;s interpretation of the law and requested permission for these affected individuals to vote fully in November.<\/p>\n<p>Supporting Fontes&#8217; position, Arizona&#8217;s GOP submitted an amicus brief asserting that Richer&#8217;s request would violate both state and federal laws. The brief highlighted concerns about potential disenfranchisement due to a clerical error unknown to long-time residents who have consistently participated in elections.<\/p>\n<p>Additionally, Arizona&#8217;s GOP legislative leaders have also asked the Supreme Court for similar relief regarding these 97,000 voters while suggesting any resolution should wait until after the 2024 general election so it doesn&#8217;t interfere with early voting or notification periods.<\/p>\n<p>The Strong Communities Foundation of Arizona\u2014a conservative grassroots group\u2014and resident Yvonne Cahill filed another amicus brief proposing a balanced remedy between Richer\u2019s and Fontes\u2019 suggestions.
