The former “Empire” actor was convicted in 2019 for orchestrating and falsely reporting a hate crime against himself. Smollett, who identifies as Black and gay, claimed that his assailants, donning red MAGA hats, hurled racist and homophobic insults at him before placing a noose around his neck. In 2021, he was found guilty of five counts of disorderly conduct and received a sentence of 150 days in jail along with 30 months of probation, plus over $130,000 in restitution; however, he has only served six days of his sentence. His attorney Nenye Uche argued that the case should not have gone to trial due to an alleged agreement between Smollett and the Cook County State\u2019s Attorney\u2019s Office to dismiss the initial charges in exchange for community service and forfeiting his $10,000 bond. On the other hand, Sean Wieber, a special assistant attorney general, stated that there is no evidence supporting such a non-prosecution deal. He emphasized that Smollett had numerous lawyers throughout this process who were well-informed about the situation. In December, the Illinois Appellate Court upheld Smollett’s conviction with a 2-1 vote ruling that even though the original charges were dropped, there was never an agreement preventing their reintroduction.
