The Becket Fund for Religious Liberty, representing various plaintiffs facing challenges to their faith, has submitted petitions for several significant cases. One prominent case is Mahmoud v. Taylor, where a coalition of religious parents—comprising Muslims, Christians, and Jews—are advocating for the right to be notified about and opt their children out of reading materials in elementary schools that contradict their religious beliefs. This case originated in Montgomery County, Maryland, after the school board eliminated its opt-out policy regarding books on gender and sexuality, leading the parents to file a lawsuit. The Mahmoud petition coincides with an increase in LGBT curricula across school districts nationwide despite parental concerns.

Mark Rienzi, CEO of the Becket Fund, emphasized during a press call on September 4 that the plaintiffs are not attempting to alter the curriculum or remove books from classrooms; rather they seek transparency from the government regarding when it will introduce content related to sex and gender ideologies into education.

The Becket Fund filed its petition for Mahmoud on September 12; thus it may take until January at least for justices to decide whether they will hear oral arguments on this matter. Meanwhile, two other cases from the same group have been pending consideration longer and have better chances of being included in this fall’s docket.

One such case is Catholic Charities Bureau v. Wisconsin LIRC which aims to restore CCB’s tax-exempt status after it was revoked by Wisconsin authorities who claimed its activities were not “typical” religious work. Another case is Young Israel of Tampa v. HART involving an Orthodox Jewish synagogue challenging a transit authority’s prohibition against religious advertisements that affected their Chanukah celebration promotion.

Additional notable petitions supported by the Becket Fund include:
– Landor v. Louisiana: A Rastafarian man seeks compensation after prison officials forcibly cut his dreadlocks against protections under federal law.
– Apache Stronghold v. United States: Native American plaintiffs aim to protect their sacred Oak Flat site from destruction by mining operations.
– Diocese of Albany v. Harris: Religious organizations contest a New York law mandating abortion coverage in health plans as contrary to their beliefs.
– Moody Bible Institute v. Garrick: The Chicago-based institute defends its policy requiring faculty adherence to specific core religious tenets.

These cases highlight ongoing national discussions about balancing religious freedom with governmental regulations as the Supreme Court prepares to determine which cases it will address next term.

Rienzi noted that over recent decades there has been a significant increase in religious liberty cases arising from administrative actions at various government levels rather than legislative statutes alone. Justices have shown interest in more such cases recently and have ruled favorably towards advocates for religious freedom concerning issues like public prayer by school coaches or employees resisting Sunday work due to personal beliefs.

With recent changes eliminating Chevron deference—which previously allowed federal agencies broad rule-making power without explicit congressional approval—Rienzi suggested there might be fewer future conflicts over agency actions infringing upon religious liberties but acknowledged time would tell how these developments unfold.

Typically selecting around 60 cases each term based on recent patterns, more decisions are expected as justices reconvene following summer recess toward late September

[5152,32207,41110,41109,32275
post-2342657","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-education","tag-legal-cases","tag-lgbt-rights","tag-religious-liberty","tag-supreme-court
["GET
