The Second\u2064 Circuit \u2062noted that the adjourned sentencing made Trump&#8217;s emergency stay request unnecessary.\u2062 The trial has been scrutinized for perceived\u200c biases, especially following revelations\u2062 about Judge Merchan&#8217;s past political donations and \u200bhis daughter\u2019s ties to Democratic campaigns, \u200cprompting\u2063 calls\u200c for his\u200c recusal from the \u200ccase.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Second Circuit Court of Appeals on Thursday&nbsp;<a href=\"https:\/\/www.courtlistener.com\/docket\/69127181\/31\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a>&nbsp;a request from former President Donald Trump to pause his New York criminal prosecution brought by&nbsp;<a href=\"https:\/\/thefederalist.com\/2023\/04\/05\/alvin-braggs-trump-indictment-is-even-more-pathetic-and-partisan-than-we-could-have-imagined\/?utm_source=rss&amp;utm_medium=rss&amp;utm_campaign=alvin-braggs-trump-indictment-is-even-more-pathetic-and-partisan-than-we-could-have-imagined\">lawfare<\/a> artist Manhattan District Attorney Alvin Bragg.<\/p>\n<p>The federal court ruling came after <a href=\"https:\/\/thefederalist.com\/2024\/04\/08\/judge-who-gagged-trump-to-hide-rabid-pro-democrat-bias-must-recuse-immediately\/\" target=\"_blank\" rel=\"noreferrer noopener\">pro-Democrat<\/a> Judge Juan Merchan, acting justice of the New York State Supreme Court, decided to <a href=\"https:\/\/thefederalist.com\/2024\/09\/06\/ny-judge-prolongs-trump-trial-drama-by-delaying-sentencing-until-after-the-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">delay Trump&rsquo;s sentencing<\/a> until after the 2024 election, prolonging the case. Merchan is now set to reevaluate the case on Nov. 12. He then plans to sentence Trump only two weeks later on Nov. 26, nearly six months after a jury found him guilty on 34 counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/felon-in-the-white-house-sheriff-endorses-trump-following-verdict\/\" title=\"Sheriff Backs Trump After Verdict: Alleged Felon in White House\">falsifying business records earlier<\/a> this year. The former president faces <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2023\/08\/16\/trumps-total-charges-could-result-in-more-than-700-years-in-prison\/\" target=\"_blank\" rel=\"noreferrer noopener\">up to 136 years<\/a> in prison for these counts.<\/p>\n<p>Trump asked a federal district judge to move the case out of New York state courts and into the federal system, <a href=\"https:\/\/www.courtlistener.com\/docket\/67326478\/46\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">pointing<\/a> to the U.S. Supreme Court&rsquo;s decision <a href=\"https:\/\/thefederalist.com\/2024\/07\/01\/scotus-immunity-ruling-further-delays-trump-trial-in-jack-smiths-d-c-lawfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">granting<\/a> Trump &ldquo;at least presumptive immunity&rdquo; for all &ldquo;official acts.&rdquo; The district court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.598311\/gov.uscourts.nysd.598311.50.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a> the request on Sept. 3, and Trump ultimately asked the Second Circuit to block that decision.<\/p>\n<p>On Sept. 9, Trump&rsquo;s attorneys <a href=\"https:\/\/www.courtlistener.com\/docket\/69127181\/22\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> to the Second Circuit that such a motion for stay was &ldquo;appropriate &hellip; in order to preserve President Trump&rsquo;s right under [federal statute] to a fair and orderly litigation of the Presidential immunity defense in a federal forum.&rdquo;<\/p>\n<p>&ldquo;President Trump&rsquo;s ability to seek appellate review of the district court&rsquo;s ruling would be irreparably harmed, in the absence of a stay, because Justice Merchant could move forward with sentencing and a &lsquo;judgment of conviction,&rsquo; &hellip; before this appeal is resolved,&rdquo; the letter asserts. &ldquo;Furthermore, Justice Merchant&rsquo;s current schedule does not allow adequate time for interlocutory appellate review of a Presidential immunity ruling he is likely to issue before this appeal is resolved &hellip; .&rdquo;<\/p>\n<p>Nonetheless, the Second Circuit <a href=\"https:\/\/www.courtlistener.com\/docket\/69127181\/31\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> Trump&rsquo;s request for a stay on Thursday.<\/p>\n<p>&ldquo;In light of the state court&rsquo;s adjournment of sentencing until November 26, 2024, it is hereby ORDERED that the motion for an emergency administrative stay is DENIED,&rdquo; the federal three<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-throws-out-alabamas-gop-drawn-congressional-map-potentially-giving-democrats-another-seat\/\" title=\"Court Throws Out Alabama\u2019s GOP-Drawn Congressional Map, Potentially Giving Democrats Another Seat\">-judge panel wrote<\/a> in the decision.<\/p>\n<p>Bragg&rsquo;s office last week called on the Second Circuit to &ldquo;deny any stay pending appeal,&rdquo; <a href=\"https:\/\/www.courtlistener.com\/docket\/69127181\/23\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> the request from Trump was &ldquo;legally unavailable&rdquo; as well as &ldquo;unnecessary in light of the state criminal court&rsquo;s adjournment of the sentencing.&rdquo;<\/p>\n<p>Despite the immunity ruling from the Supreme Court, District Judge Alvin Hellerstein, <a href=\"https:\/\/ballotpedia.org\/Alvin_Hellerstein\" target=\"_blank\" rel=\"noreferrer noopener\">nominated<\/a> by Bill Clinton, argued in the Sept. 3 decision that the circumstances of Trump&rsquo;s case had not changed, <a href=\"https:\/\/www.courtlistener.com\/docket\/67326478\/50\/people-of-the-state-of-new-york-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">writing<\/a>, &ldquo;Nothing in the Supreme Court&rsquo;s opinion affects my previous conclusion that the hush money payments were private, unofficial acts, outside the bounds of executive authority.&rdquo;<\/p>\n<p>Trump&rsquo;s legal team also motioned for adjournment and argued evidence used by Bragg would have fallen under immunity, but Merchan <a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/Decision-Defendants-Motion-re-Presidential-Immunity.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">denied the request<\/a> earlier this year.<\/p>\n<p>The New York trial has been rife with controversy and corruption since the beginning.<\/p>\n<p>Merchan, for his part, apparently <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/judge-trumps-new-york-case-appears-donated-15-biden-president-2020-rcna78577\" target=\"_blank\" rel=\"noreferrer noopener\">donated<\/a> money to President Joe Biden&rsquo;s 2020 campaign. As The Federalist&rsquo;s John Daniel Davidson previously <a href=\"https:\/\/thefederalist.com\/2024\/05\/30\/judge-merchans-jury-instructions-prove-trumps-trial-is-about-power-not-the-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>, Merchan also &ldquo;issued bizarre and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-merchans-jury-instructions-prove-trumps-trial-is-about-power-not-the-law\/\" title=\"Judge Merchan&#039;s jury instructions reveal that Trump&#039;s trial revolves around power, not just the law\">plainly unconstitutional jury instructions<\/a> on Wednesday, telling jurors they&nbsp;<a href=\"https:\/\/x.com\/JonathanTurley\/status\/1795829624502681688\" target=\"_blank\" rel=\"noreferrer noopener\">need not agree on what crime Trump allegedly committed<\/a>&nbsp;to reach a unanimous guilty verdict.&rdquo;<\/p>\n<p>Trump and many others have <a href=\"https:\/\/www.cbsnews.com\/news\/trump-hush-money-case-judge-juan-merchan-recusal\/\" target=\"_blank\" rel=\"noreferrer noopener\">called for Merchan to recuse himself<\/a> after revelations that his daughter, Loren Merchan, is head of Democrat marketing firm Authentic Campaigns, boasting clientele like <a href=\"https:\/\/thefederalist.com\/2024\/06\/03\/loren-merchan-silent-as-her-clients-raise-millions-from-trump-conviction-her-dad-oversaw\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. Adam Schiff<\/a>, D-Calif., the lead prosecutor of Trump in the first <a href=\"https:\/\/thefederalist.com\/2019\/11\/12\/in-their-own-words-democrats-explain-why-this-impeachment-is-a-farce\/\" target=\"_blank\" rel=\"noreferrer noopener\">sham<\/a> Senate impeachment trial, and Vice President <a href=\"https:\/\/thefederalist.com\/2024\/05\/30\/rigged-biden-donor-judge-whose-daughter-raised-millions-to-defeat-trump-oversaw-soviet-show-trial-conviction\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kamala Harris<\/a>.<\/p>\n<p>Further questions about Merchan&rsquo;s motivations arose after he motioned to <a href=\"https:\/\/thefederalist.com\/2024\/04\/08\/judge-who-gagged-trump-to-hide-rabid-pro-democrat-bias-must-recuse-immediately\/\" target=\"_blank\" rel=\"noreferrer noopener\">gag<\/a> Trump, silencing him from being able to criticize prosecutors and court staffers involved in the case.<\/p>\n<p>Bragg initially indicted Trump <a href=\"https:\/\/thefederalist.com\/2024\/09\/06\/ny-judge-prolongs-trump-trial-drama-by-delaying-sentencing-until-after-the-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> he violated the Federal Election Campaign Act when Trump&rsquo;s former attorney &ldquo;Michael Cohen paid pornographic actress Stormy Daniels to keep quiet about an alleged affair,&rdquo; as The Federalist&rsquo;s Jordan Boyd previously reported. Despite nondisclosure agreements being legal (and at the very most potentially only reaching the level of a <a href=\"https:\/\/thefederalist.com\/2024\/04\/15\/trumps-strongest-new-york-defense-has-nothing-to-do-with-alvin-bragg-or-judge-merchan\/\" target=\"_blank\" rel=\"noreferrer noopener\">misdemeanor charge<\/a>) Bragg, promised <a href=\"https:\/\/www.nytimes.com\/2024\/04\/09\/magazine\/alvin-bragg-donald-trump-trial.html\" target=\"_blank\" rel=\"noreferrer noopener\">a political vendetta<\/a> against Trump, filing felony charges.
