In a statement, the town expressed its intention to contest the legal challenge brought forth by the Goldwater Institute and resident Deborah Rose, who claim that the emergency clause was unnecessary and deprived voters of their right to decide. This decision will result in a one-cent increase in sales taxes within the town. “The Town of Payson plans to vigorously defend against this lawsuit, as state law clearly states that courts cannot interfere with a legislative body’s choice to adopt measures with an emergency clause,” said a town spokesperson on Thursday, noting that such actions are “common” among municipalities in Arizona. Additionally, Councilmember Joel Mona referenced during the August 21 meeting—where the council voted 6-1—that this bond issue would facilitate reopening Taylor Pool, which he argued could be considered an emergency situation. “Taylor Pool closed in 2019 and has significantly limited children’s access to swimming lessons. Drowning is the leading cause of death for children aged one to four and second for those aged five to fourteen. Clearly, learning how to swim mitigates this risk,” Mona stated. He also highlighted various health benefits associated with aquatic activities for individuals facing different health challenges. However, Jon Riches from Goldwater Institute dismissed these justifications as inadequate: “The town of Payson has acted outside state law limits while infringing on citizens’ constitutional rights,” he remarked in a statement to The Center Square. He emphasized that local governments can only restrict citizens from voting on ordinances if it is essential for immediate health or safety preservation—a standard he believes has not been met here—and criticized any threats made against citizens seeking legal recourse as unlawful and potentially exposing further legal risks for the town.
