The counts were part of a broader 41-count indictment\u200c filed by Fulton County District\u200c Attorney Fani Willis, which accuses Trump and 18 co-defendants of\u200d violating Georgia&#8217;s\u200c Racketeer Influenced and Corrupt Organizations (RICO) Act, among other\u200b charges. <\/p>\n<p>Fulton\u200b County Superior Court \u2064Judge Scott\u2062 McAfee \u200bruled \u2063that \u200dthe dismissed counts\u2062 exceeded the state\u2019s jurisdiction, a decision \u200cresulting from arguments\u200c made by co-defendants\u2064 John Eastman \u200dand Shawn\u200d Still. Although Willis disputed\u200d these allegations, her actions \u200chave\u2063 led\u2062 to questions\u200c about \u2063the overall credibility \u2062of the prosecution.<\/p>\n<p>The outcome of the case may be influenced by a \u200crecent Supreme\u2064 Court\u200b ruling granting absolute\u2062 immunity to \u2064presidents for their official acts, which Trump asserts applies to\u2064 his\u2062 communication regarding the election with Georgia&#8217;s Secretary of State. and for the alleged &ldquo;solicitation of violation of oath by public officer.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-5420f5e0bcc06726381d9019cfa343ae fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-5420f5e0bcc06726381d9019cfa343ae\"><\/div>\n<p>Fulton County Superior Court Judge Scott McAfee (who <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2024\/02\/Fani-Willis-June-30-2020-CCDR-Amended.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">donated<\/a> to Willis&rsquo; campaign in 2020) dismissed three counts on Thursday &mdash; two of which named Trump &mdash; saying the allegations go beyond the &ldquo;State&rsquo;s jurisdiction.&rdquo; The motion to dismiss was brought by co-defendants John Eastman and Shawn Still.<\/p>\n<p>Eastman and Still argued &ldquo;the indictment is preempted by federal statute, that presidential electors fall outside the State&rsquo;s Appointment Power and Police Power, and that state action is prohibited because the subject of the indictment is inseparably connected to the functioning of the national government,&rdquo; according to the <a href=\"https:\/\/www.atlantanewsfirst.com\/2024\/09\/12\/three-charges-related-donald-trumps-georgia-indictment-dropped\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a>. <\/p>\n<p>&ldquo;Because Counts 14, 15, and 27 lie beyond this State&rsquo;s jurisdiction and must be quashed, the Defendants&rsquo; motions to dismiss the indictment under the Supremacy Clause are granted in part,&rdquo; McAfee ruled. The case will still proceed. <\/p>\n<p>Counts 14, 15 and 27 related to the alleged filing of false documents and conspiracy. <\/p>\n<div class=\"fdrlst__b89e9-2d5ca091ceb1b33135ec07279ca59cd0 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-2d5ca091ceb1b33135ec07279ca59cd0\"><\/div>\n<p>McAfee previously dismissed six other counts &mdash; three of which were against Trump &mdash; in March. Trump <a href=\"https:\/\/abcnews.go.com\/Politics\/georgia-judge-tosses-2-counts-donald-trump-election\/story?id=113642911\" target=\"_blank\" rel=\"noreferrer noopener\">now faces<\/a> eight charges.<\/p>\n<p>Willis&rsquo; lawfare case derailed after she <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-swalwells-attorneys-claim-they-cant-corner-rep-brooks-to-serve-him-lawsuit\/\" title=\"Rep. Swalwell\u2019s Attorneys Claim They Can\u2019t Corner Rep. Brooks To Serve Him Lawsuit\">allegedly hired<\/a> her lover, Nathan Wade, as a special prosecutor to help run the prosecution against Trump. Trump and his co-defendants alleged Willis should be disqualified from prosecuting them because she <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/long-shot-willis-challenger-hopes-to-remind-voters-lawfare-for-personal-gain-is-not-the-das-job\/\" title=\"Underdog Willis Challenger Aims to Reinforce Message: &#039;Using Legal Tactics for Personal Gain Isn&#039;t the DA&#039;s Duty\">allegedly financially benefited<\/a> from hiring Wade. Wade&rsquo;s law firm was paid more than $650,000 for his work over a two-year span while the firms of other special prosecutors on the case were each paid less than $100,000, 11 Alive <a href=\"https:\/\/www.11alive.com\/article\/news\/special-reports\/ga-trump-investigation\/nathan-wade-paid-substantially-more-than-fulton-special-prosecutors\/85-c1fa7418-7608-4417-a685-2fbab1c450aa\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n<p>Wade allegedly treated Willis to lavish vacations with the money he earned.
