The Senate confirmed President Joe Biden&rsquo;s 209th judge on Thursday, <a href=\"https:\/\/www.heritage.org\/judicialtracker\" target=\"_blank\" rel=\"noopener\" title>in line with<\/a> the number Senate Republicans had confirmed by this point in Trump&rsquo;s term.<\/p>\n<p>But Durbin expects Democrats will fall behind by the end of September. They need to match the 16 judges Republicans confirmed in 2020 that month but are on track to fall short.<\/p>\n<p>&ldquo;He had the cooperation of the Democrats to get it done,&rdquo; Durbin said of Trump. &ldquo;I don&rsquo;t think we&rsquo;ll get near that number in September. So, we&rsquo;ll have to have good fortune in the remaining months.&rdquo;<\/p>\n<p>Democrats have several factors working against them. They only control a 51-49 majority, and one member of their caucus, Sen. Joe Manchin (I-WV), has vowed to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/2960352\/manchin-roadblock-sotomayor-supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>oppose any judicial nomination<\/a> that cannot attract a Republican vote.<\/p>\n<p>The overwhelming majority of nominees receive at least some level of bipartisan support, but election season has complicated Democrats&rsquo; ability to move more <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senators-gear-up-for-chaotic-post-recess-return-to-washington\/\" title=\"Senators prepare for tumultuous return to Washington after recess.\">controversial judicial picks<\/a>.&nbsp;<\/p>\n<p>In December, Kamala Harris <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2620686\/harris-sets-vice-presidential-senate-tiebreaker-record-with-32nd-and-33rd-votes\/\" target=\"_blank\" rel=\"noopener\" title>broke the record<\/a> for the number of tiebreaking votes cast in the Senate as vice president, most of them to approve party-line nominees. Mitch McConnell (R-KY), then the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-ends-negotiations-with-nancy-pelosi-on-coronavirus-relief\/\" title=\"Donald Trump Ends Negotiations with Nancy Pelosi on Coronavirus Relief\">majority leader<\/a>, <a href=\"https:\/\/www.politico.com\/story\/2018\/06\/05\/mcconnell-cancels-most-of-august-recess-625905\" target=\"_blank\" rel=\"noopener\" title>canceled<\/a> the August recess to confirm additional Trump judges.<\/p>\n<p>But Democratic leadership, facing an unfavorable map this year, will be reluctant to keep vulnerable incumbents from returning to their home states to campaign.&nbsp;<\/p>\n<p>Judicial appointments will go down as one of the crowning achievements of Biden&rsquo;s term. Democrats have diversified the federal bench, including the confirmation of a record number of black women to the circuit courts.<\/p>\n<p>Still, Schumer has his eye on beating Trump&rsquo;s top-line record. He spoke with Jeff Zients, the White House chief of staff, last Friday to discuss how to accelerate the pace of appointments, <a href=\"https:\/\/www.axios.com\/2024\/09\/10\/schumer-judges-confirmation-biden-trump\" target=\"_blank\" rel=\"noopener\" title>according to<\/a> <em>Axios<\/em>.<\/p>\n<p>Asked how Democrats can get to Trump&rsquo;s 234, Durbin did not want to speak for Schumer.
