Kennedy’s name. Initially, Kennedy aimed to run as a third-party candidate for the presidency but has since endorsed former President Donald Trump. He is now fighting to have his name taken off the ballots in states where he had previously gained access, aiming to prevent voters who are reluctant to support Democratic candidate Vice President Kamala Harris from considering him as an alternative, which could potentially enhance Trump’s chances.

As reported by ABC, Kennedy is no longer listed on the ballot in ten other states: Arizona, Florida, Georgia, Maine, Nevada, New Hampshire, Ohio, Pennsylvania, Texas and South Carolina. Although he will still appear on about 30 state ballots overall, only Wisconsin and Michigan have denied his request for removal among swing states.

Kennedy filed an appeal on Monday seeking removal from the ballot. Meanwhile, North Carolina’s decision was countered by a ruling from Michigan that allowed him to remain listed. The North Carolina Supreme Court’s 4-3 ruling supported an appeals court decision that reversed a lower court’s ruling. Justice Trey Allen noted in the majority opinion that while reprinting new ballots would require significant time and resources from election officials and incur costs for the state—this expense is necessary under North Carolina’s Constitution to safeguard voters’ rights.

The court expressed concern that keeping Kennedy on the ballot could mislead many voters into thinking he is still a candidate when he is not. This situation has delayed the timeline for mailing out ballots; they were originally scheduled for distribution on September 6 but were postponed due to ongoing legal proceedings regarding Kennedy’s candidacy.

In rejecting Kennedy’s lawsuit in Michigan aimed at removing him from their ballot as well, the state’s Supreme Court stated he did not demonstrate entitlement to such extraordinary relief. Aaron Siri—Kennedy’s attorney—countered this assertion by claiming it was unrelated to maintaining election integrity and suggested it was intended instead for unwitting voters in Michigan who might waste their votes on a withdrawn candidate.

Two justices nominated by Republicans dissented against this order while noting that most judges currently serving were appointed by Democrats; they expressed hope that this “misguided action” would not lead to broader national consequences

[40540,32458,32275,25081,3634
post-2339130","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-ballot-battle","tag-rfk-jr","tag-supreme-court","tag-swing-state","tag-trump
["GET
