Cole County Circuit Judge Christopher Limbaugh ⁤determined that the⁢ measure, which aims to overturn the state’s restrictive abortion law—permitting‍ abortions only in medical emergencies—was not properly qualified ⁢due to issues in the signature-gathering process. Specifically, signers were not‌ adequately informed about the existing state laws ‍that the measure would modify. The Missouri Supreme Court⁣ is expected⁤ to review the case shortly.

Missouri abortion ballot measure in jeopardy after court ruling

Ballot measures on abortion will appear before voters in various states in November, but in Missouri, the qualified measure could be booted from the ballot before Election Day.

On Friday, Cole County Circuit Judge Christopher Limbaugh ruled that a ballot measure seeking to overturn the state’s current abortion law that only allows abortion for medical emergencies was not qualified to be placed on the ballot because it did not follow state law in its signature process. While several states will present abortion-related measures to voters in November, Missouri’s qualified measure may be removed from the ballot prior to Election Day. On Friday, Cole County Circuit Judge Christopher Limbaugh determined that the initiative aimed at reversing the state’s current abortion law— which permits abortions only in medical emergencies—was not eligible for the ballot due to noncompliance with state signature requirements. Specifically, those who signed were not adequately informed about all state laws that would be affected by this measure. Limbaugh has temporarily paused his ruling until Tuesday, allowing for an appeal before Missouri’s secretary of state must finalize ballots for the upcoming election.

The primary organization supporting this measure, Missourians for Constitutional Freedom, has appealed the decision and is seeking a quick resolution to these legal issues before Tuesday’s deadline. Campaign manager Rachel Sweet expressed that blocking Amendment 3 from appearing on the ballot is a significant injustice and undermines the rights of over 380,000 Missourians who signed in support of it.

The Missouri Supreme Court is set to hear arguments regarding this appeal on Tuesday morning, just ahead of the cutoff time when measures can still be removed from November’s ballot. If it remains on and is approved by voters, this measure would limit state government authority over abortion laws while permitting legislation that bans abortions after fetal viability with exceptions concerning maternal health or life.

Opponents argue that provisions allowing abortions based on mental health could lead to minimal restrictions on pregnancy terminations. The measure requires only a simple majority vote if it stays on the ballot. Other states voting on abortion measures include Arizona, Nevada, Maryland, Colorado, South Dakota, and Florida.
