Kennedy Jr.&rsquo;s request that his name be removed from the general election ballots in the two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-two-states-count-their-delegates-differently-in-presidential-elections\/\" title=\"Explore the reasons why two states tally their delegates uniquely in presidential contests\">highly contested swing states<\/a>.<\/p>\n<p>The moves in both states are legal wins for the former independent candidate, who recently dropped out to <a href=\"https:\/\/thefederalist.com\/2024\/08\/23\/rfk-jr-drops-out-of-2024-race-endorses-trump-for-president\/\" target=\"_blank\" rel=\"noreferrer noopener\">endorse<\/a> President Donald Trump. The endorsement marked a significant shift for Kennedy, who has a lifelong legacy as a Democrat and a member of one of America&rsquo;s most powerful political dynasties.<\/p>\n<p>Since endorsing Trump, Kennedy has been trying to thread the needle, seeking to remove his name from ballots in some states in order to benefit Trump while remaining on ballots in others. But so far, Democrats have had success <a href=\"https:\/\/thefederalist.com\/2024\/08\/30\/dems-keep-rfk-jr-on-north-carolina-ballot-as-swing-state-spoiler-to-hurt-trump-campaign\/\" target=\"_blank\" rel=\"noreferrer noopener\">keeping him on the ballots<\/a> where he has requested to be removed, while <a href=\"https:\/\/thefederalist.com\/2024\/08\/13\/rfk-jr-blocked-from-new-york-ballot-after-challenge-from-democrat-aligned-pac\/\" target=\"_blank\" rel=\"noreferrer noopener\">removing<\/a> him from the ballots on which he wishes to remain. All of this follows other hard-fought legal fights Kennedy had with Democrats in his effort to obtain ballot access in the first place.<\/p>\n<p>In July Democrats in North Carolina sued to keep Kennedy off the ballot out of fears he might sap more votes from Vice President Kamala Harris. But it now appears that his remaining on the ballot could take more votes from Trump &mdash; which has prompted both Democrat-led efforts to keep Kennedy on the ballot and Kennedy&rsquo;s legal actions to get his name removed. <\/p>\n<p>Kennedy requested&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/08\/30\/dems-keep-rfk-jr-on-north-carolina-ballot-as-swing-state-spoiler-to-hurt-trump-campaign\/\" target=\"_blank\" rel=\"noreferrer noopener\">last week<\/a>&nbsp;that his name be removed from the ballots, but the request was denied by the Democrat-run North Carolina State Board of Elections, prompting Kennedy to turn to the courts. On Thursday a lower court judge <a href=\"https:\/\/www.ncsbe.gov\/news\/press-releases\/2024\/09\/05\/judge-denies-request-remove-robert-f-kennedy-jr-nc-ballot-pauses-sending-ballots-until-noon-friday\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> Kennedy&rsquo;s request to be removed from the ballots, but a unanimous <a href=\"https:\/\/appellate.nccourts.org\/orders.php?t=&amp;court=2&amp;id=439732&amp;pdf=1&amp;a=0&amp;docket=1&amp;dev=1\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> from the state court of appeals on Friday granted Kennedy&rsquo;s petition and ordered that the ballots with his name not be distributed for use. The appeals court order was issued without legal explanation.<\/p>\n<p>North Carolina election officials had planned to begin mailing ballots Friday, but the North Carolina State Board of Elections (NCSBE) subsequently issued guidance to all 100 county election directors telling them not to disseminate ballots. According to the NCSBE, 135,559 North Carolinians had already requested absentee ballots as of Friday afternoon.<\/p>\n<p>The guidance from NCSBE General Counsel Paul Cox, obtained by The Federalist, is as follows:<\/p>\n<blockquote>\n<p>The Court of Appeals just issued an order reversing the denial of the restraining order that was requested by Kennedy. It is attached. The court has ordered a further pause to ballot distribution.&nbsp;<strong>Do&nbsp;<u>not<\/u>&nbsp;send any ballots out today<\/strong>.<\/p>\n<p>The court has also ordered that the We The People party&rsquo;s ballot line be removed (including Kennedy and Shanahan). Obviously, this will be a major undertaking for everyone. Our attorneys are reviewing the order and determining how to move forward. No decision has been made on whether this ruling will be appealed.<\/p>\n<p>Bottom line:&nbsp;<strong>continue to hold your outgoing absentee ballots<\/strong> &mdash; both military and overseas citizen ballots, and ballots for civilian voters. We will update you immediately with any further developments.<\/p>\n<\/blockquote>\n<p>The North Carolina order means that ballots will have to be reprinted and mailed, a process that could take days, or even weeks. Friday evening, the NCSBE <a href=\"https:\/\/www.ncsbe.gov\/news\/press-releases\/2024\/09\/06\/state-board-appeals-decision-take-robert-f-kennedy-jr-nc-ballots\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> that it had filed an appeal with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/9-key-points-from-trump-campaign-press-conference-on-challenges-to-election-results\/\" title=\"9 Key Points from Trump Campaign Press Conference on Challenges to Election Results\">state supreme court<\/a> asking that the court of appeals&rsquo; ruling be overturned. North Carolina elects its supreme court judges, and Republican justices currently outnumber Democrat justices 5-2.<\/p>\n<p>The Michigan Court of Appeals also unanimously <a href=\"https:\/\/www.courts.michigan.gov\/4a4ff9\/siteassets\/case-documents\/uploads\/opinions\/final\/coa\/20240906_c372349_28_372349.opn.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> that Kennedy&rsquo;s name be removed from state ballots on Friday, reversing a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-throws-out-challenge-to-president-trumps-bid-to-exclude-illegal-aliens-from-being-counted-in-determining-congressional-seats\/\" title=\"SCOTUS Throws Out Challenge to President Trump\u2019s Bid to Exclude Illegal Aliens from Being Counted in Determining Congressional Seats\">lower court opinion<\/a> to retain his name on the ballots. According to <a href=\"https:\/\/www.detroitnews.com\/story\/news\/politics\/2024\/09\/06\/michigan-appeals-court-orders-robert-f-kennedy-rfk-jr-removed-from-november-election-ballot\/75103927007\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Detroit News<\/a>, however, Michigan Secretary of State Jocelyn Benson&rsquo;s office filed an emergency appeal Friday evening, asking the state supreme court to pause the decision that removes Kennedy from Michigan ballots. Democrat-appointed justices maintain a 4-3 advantage on the Michigan Supreme Court.<\/p>\n<p>Friday also marked a <a href=\"https:\/\/www.detroitnews.com\/story\/news\/politics\/2024\/09\/06\/michigan-appeals-court-orders-robert-f-kennedy-rfk-jr-removed-from-november-election-ballot\/75103927007\/\" target=\"_blank\" rel=\"noreferrer noopener\">significant deadline<\/a> for ballots in Michigan, where <a href=\"https:\/\/www.legislature.mi.gov\/documents\/mcl\/pdf\/mcl-chap168.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">state law<\/a> requires Benson&rsquo;s office to submit the names of candidates that will appear on the ballots to county clerks. Election law also requires that absentee ballots be ready to send to voters who are in the military or overseas by Sept. 21, or 45 days before Election Day.<\/p>\n<p>The week after Kennedy suspended his campaign, a <a href=\"https:\/\/www.detroitnews.com\/story\/news\/politics\/2024\/09\/03\/how-minor-shifts-could-swing-a-close-presidential-race-in-michigan\/75054306007\/\" target=\"_blank\" rel=\"noreferrer noopener\">poll<\/a> of likely voters in Michigan showed the independent retaining 5 percent support from likely voters, and showed Trump with a 1 percent edge on Harris.<\/p>\n<p>The Kennedy campaign did not respond to a request for comment from The Federalist.<\/p>\n<hr>\n<p>      Breccan F. A lower court judge initially rejected his request; however, on Friday a unanimous ruling by the state court of appeals granted his petition and ordered that no ballots featuring his name be distributed until further notice\u2014though no legal reasoning was provided for this order.<\/p>\n<p>North Carolina election officials had intended to start mailing out ballots on Friday but were subsequently instructed by NCSBE not to distribute them following this new ruling. Later on Friday evening, NCSBE announced it would appeal this decision at the state supreme court level; currently Republican justices hold a 5-2 majority over their Democratic counterparts there.<\/p>\n<p>Similarly in Michigan, its Court of Appeals unanimously ruled for removing Kennedy\u2019s name from state ballots as well\u2014overturning an earlier lower court&#8217;s decision which allowed it remain listed. However according to The Detroit News report late Friday evening Michigan Secretary of State Jocelyn Benson\u2019s office filed an emergency appeal requesting suspension against this ruling before it takes effect; here too Democrat-appointed justices hold a slight edge at 4-3 within their Supreme Court system.<\/p>\n<p>Additionally noteworthy is that September 21 marked an important deadline under Michigan law requiring Benson\u2019s office submit candidate names appearing on upcoming elections\u2019 official lists while ensuring absentee voting materials are ready ahead time especially concerning military personnel or overseas voters needing them sent out promptly prior Election Day itself approaching soon thereafter.<\/p>\n<p>Following suspension announcement made last week regarding campaign activities conducted previously polling data indicated independent support retained around five percent among likely voters within Michigan alongside showing Trump leading Harris
