In that decision a concurring opinion from Justice Clarence Thomas <a href=\"https:\/\/www.newsweek.com\/clarence-thomas-jack-smith-supreme-court-ruling-donald-trump-immunity-1919643\" target=\"_blank\" rel=\"noreferrer noopener\">questioned<\/a> the legitimacy of Jack Smith&rsquo;s appointment as special counsel. <\/p>\n<div class=\"fdrlst__b89e9-42f959721417c24820f08f5c404304a0 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-42f959721417c24820f08f5c404304a0\"><\/div>\n<p>U.S. District Judge Aileen Cannon <a href=\"https:\/\/apnews.com\/article\/trump-classified-documents-smith-c66d5ffb7ba86c1b991f95e89bdeba0c\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed<\/a> Trump&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/from-witch-hunt-to-happy-birthday-trumps-busy-arraignment-day-in-miami\/\" title=\"Trump&#039;s eventful day in Miami: From &#039;Witch Hunt&#039; to &#039;Happy Birthday&#039;\">classified documents case brought<\/a> by Smith in Florida after the former president&rsquo;s attorneys called the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-debate-performance-renews-spotlight-on-hur-tapes-washington-examiner\/\" title=\"Biden debate performance renews spotlight on Hur tapes - Washington Examiner\">special counsel&#038;rsquo<\/a>;s appointment illegal. D.C. District Judge Tanya Chutkan, however, <a href=\"https:\/\/x.com\/kyledcheney\/status\/1831708474536776056\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in Thursday&rsquo;s hearing that Cannon&rsquo;s argument for dismissal was not &ldquo;particularly persuasive,&rdquo; according to Politico reporter Kyle Cheney.<\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/live\/2024\/09\/05\/us\/trump-election-interference-hearing\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that Chutkan &ldquo;chuckle[d]&rdquo; and slightly rolled her eyes in the courtroom Thursday when Trump&rsquo;s attorneys argued the Supreme Court was &ldquo;crystal clear&rdquo; in rulings on immunity. Trump&rsquo;s legal team had <a href=\"https:\/\/thefederalist.com\/2023\/09\/28\/of-course-judge-chutkan-wont-recuse-herself-from-trumps-j6-case-she-has-a-narrative-to-prove\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously<\/a> <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/09\/14\/special-counsel-chutkan-recusal-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">petitioned<\/a> to remove the Obama-appointed judge from the case over her prejudicial statements against the former president and his supporters, particularly in rulings related to the Capitol riot on Jan. 6, 2021. Chutkan, however, denied requests to recuse herself from the case and allow the prosecution to proceed outside of the nation&rsquo;s capital.<\/p>\n<p>Smith <a href=\"https:\/\/apnews.com\/article\/trump-jack-smith-jan-6-186c874404912578e44d5781c8267e2d\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> an updated indictment against Trump last week after a series of Supreme Court decisions this summer threatened to derail the entire prosecution. In June, the nine-justice panel knocked out two of the four charges brought against Trump in the D.C. district court by <a href=\"https:\/\/thefederalist.com\/2024\/06\/28\/supreme-court-tosses-obstruction-charges-for-j6-defendants\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> the Department of Justice (DOJ) had used an overly broad interpretation of a 2002 law related to the &ldquo;obstruction of an official proceeding.&rdquo;<\/p>\n<p>Chutkan concluded the hearing without a trial date and said one was unlikely to come for &ldquo;<a href=\"https:\/\/x.com\/kyledcheney\/status\/1831696557088907340\" target=\"_blank\" rel=\"noreferrer noopener\">months<\/a>.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-8e10abf4afc445996a8886eafef17dca fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-8e10abf4afc445996a8886eafef17dca\"><\/div>\n<p>Smith&rsquo;s new indictment &ldquo;keeps the same criminal charges but narrows the allegations against him,&rdquo; <a href=\"https:\/\/apnews.com\/article\/trump-jack-smith-jan-6-186c874404912578e44d5781c8267e2d\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to the Associated Press. The case is among a cascade of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-probe-into-border-patrol-agents-accused-of-whipping-migrants-ends-charging-decision-imminent\/\" title=\"EXCLUSIVE: Probe into Border Patrol Agents Accused of \u2018Whipping\u2019 Migrants Ends \u2013 Charging Decision Imminent\">criminal charges filed<\/a> against the former president in an effort to thwart Trump&rsquo;s return to the White House this fall. Only one out of the four trials, however, has reached a criminal conviction so far. In May, a Manhattan jury unanimously <a href=\"https:\/\/thefederalist.com\/2024\/05\/31\/guilty-trump-verdict-will-keep-good-people-from-running-for-office\/\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> to find Trump guilty on all 34 felony charges of falsifying business records in a &ldquo;hush money&rdquo; trial previously declined by local prosecutors.<\/p>\n<p>On Tuesday, prosecutors in New York <a href=\"https:\/\/www.axios.com\/2024\/09\/03\/trump-sentencing-hush-money-delay\" target=\"_blank\" rel=\"noreferrer noopener\">objected<\/a> to a <a href=\"https:\/\/apnews.com\/article\/trump-hush-money-delay-sentencing-new-york-8797407266a8d7562298e894fcd8d80b\" target=\"_blank\" rel=\"noreferrer noopener\">request<\/a> from Trump&rsquo;s legal team to delay sentencing until after Election Day in November.
