Plaintiffs are represented by America First Legal (AFL) and a law firm headed by former Arizona Assistant Attorney General Jennifer Wright.<\/p>\n<div class=\"fdrlst__b89e9-9714f8c3009056fced09601c949d2ed0 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-9714f8c3009056fced09601c949d2ed0\"><\/div>\n<p>&ldquo;This lawsuit seeks to restore public trust in our State&rsquo;s electoral system by holding the Defendants accountable for their failures and to ensure that the list maintenance required by the law&mdash;and common sense&mdash;is performed,&rdquo; the filing reads.<\/p>\n<p>Tuesday&rsquo;s challenge is an &ldquo;amended&rdquo; version of a <a href=\"https:\/\/thefederalist.com\/2024\/08\/07\/lawsuit-maricopa-countys-election-chief-is-unlawfully-refusing-to-undertake-proper-voter-list-maintenance\/\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a> filed against Maricopa County Recorder Stephen Richer early last month, according to a press release from AFL regarding the lawsuit.<\/p>\n<p>Plaintiffs similarly alleged that Richer &ldquo;ignored&rdquo; his legally mandated obligation to &ldquo;ensure&rdquo; the removal of noncitizens from the locality&rsquo;s voter rolls. A representative from Richer&rsquo;s office previously told The Federalist that, while Richer had yet to be served the suit at that point, the Maricopa County Recorder&rsquo;s Office &ldquo;prioritizes and prides itself on maintaining accurate, up-to<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/4-devastating-consequences-of-the-democrat-for-the-people-act\/\" title=\"4 Devastating Consequences Of The Democrat \u2018For The People Act\u2019\">-date voter rolls<\/a>,&rdquo; and &ldquo;will continue to follow the letter of the law.&rdquo;<\/p>\n<p>Richer&rsquo;s office did not respond to The Federalist&rsquo;s request for comment on Wednesday. <\/p>\n<div class=\"fdrlst__b89e9-5db1582a7b5a6ff98f430b34640d92b4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5db1582a7b5a6ff98f430b34640d92b4\"><\/div>\n<p>The &ldquo;amended&rdquo; complaint adds Arizona&rsquo;s 14 other county recorders as defendants in the suit.<\/p>\n<p>The entire saga seemingly began in July, when AFL sent&nbsp;a <a href=\"https:\/\/aflegal.org\/america-first-legal-sends-legal-demand-letter-to-all-15-arizona-counties-threatening-legal-action-if-they-do-not-take-action-to-stop-illegal-aliens-from-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> &ldquo;to all 15 of Arizona&rsquo;s county recorders&rdquo;&nbsp;demanding &ldquo;that the recorders immediately start using existing federal law to verify the citizenship of all of Arizona&rsquo;s federal-only voters.&rdquo;<strong> <\/strong>In Arizona, individuals who do not provide documentary proof of citizenship (DPOC) when registering to vote are&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a>&nbsp;to do so as &ldquo;Federal-Only Voters&rdquo; and cast ballots in federal elections. That allowance is due to a 2013 U.S. Supreme Court ruling known as&nbsp;<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/570\/1\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Arizona v. Inter Tribal Council of Ariz., Inc<\/em>.<\/a><\/p>\n<p>State law, however, mandates individuals provide DPOC when registering via a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">state voter registration form<\/a>.
