The incident occurred on August 20 during \u2062a City Council meeting when Massie was interrupted by Mayor Skip Hall, who accused her of personal attacks. now I&rsquo;m teaching that lesson to the city,&rdquo; lead plaintiff Rebekah Massie said in a <a href=\"https:\/\/www.thefire.org\/news\/lawsuit-arizona-mom-sues-city-after-arrest-criticizing-government-lawyers-pay\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. &ldquo;It&rsquo;s important to fight back to show all of my children that the First Amendment is more powerful than the whims of any government official.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-965f1407fd16c6c018a586bae91b3f4b fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-965f1407fd16c6c018a586bae91b3f4b\"><\/div>\n<p>The incident in question occurred during the city of Surprise&rsquo;s Aug. 20 City Council meeting. Massie used the public forum as an opportunity to criticize the conduct of the city attorney. <\/p>\n<p>During her testimony, Massie was cut off my Mayor Skip Hall, who <a href=\"https:\/\/thefederalist.com\/2024\/08\/29\/first-amendment-group-says-it-plans-to-support-arizona-resident-arrested-for-speaking-at-city-meeting\/\" target=\"_blank\" rel=\"noreferrer noopener\">accused<\/a> her of &ldquo;attacking the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/free-speech-group-says-it-plans-to-sue-az-city-over-arrest\/\" title=\"Free Speech Group Says It Plans To Sue AZ City Over Arrest\">city attorney personally&#038;rdquo<\/a>; and violating&nbsp;<a href=\"https:\/\/radiofreehubcity.com\/2024\/08\/25\/surprise-arizona-resident-detained-during-council-meeting-raising-first-amendment-concerns\/\" target=\"_blank\" rel=\"noreferrer noopener\">rules<\/a>&nbsp;governing public meetings. After a short verbal back and forth, Hall called on the law enforcement official overseeing the meeting to arrest Massie, despite her protests the guidelines were &ldquo;unconstitutional&rdquo; and violated her &ldquo;First Amendment rights.&rdquo; <\/p>\n<p>The Arizona mom was subsequently detained and charged. <\/p>\n<p>Filed in the U.S. District Court for the District of Arizona, the <a href=\"https:\/\/www.thefire.org\/research-learn\/massie-v-city-surprise-complaint\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> challenges the constitutionality of Surprise&rsquo;s &ldquo;Council Criticism Policy,&rdquo; which prohibits residents giving remarks at public meetings from leveling &ldquo;charges or complaints against any employee of the City or members of the body.&rdquo; Massie and co-plaintiff Quintus Schulzke, a Surprise resident, allege the policy &ldquo;violates the First Amendment.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-ec00259b1f990960ecd565c4b2b859c6 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ec00259b1f990960ecd565c4b2b859c6\"><\/div>\n<p>&ldquo;When Massie exercised her constitutional right to criticize officials at a City Council meeting, a right &lsquo;high in the hierarchy of First Amendment values,&rsquo; &hellip; the Council Criticism Policy and Mayor Hall ensured she left the meeting in handcuffs,&rdquo; the lawsuit reads. &ldquo;That might be how repressive regimes treat government critics, but it&rsquo;s an affront to our Constitution.&rdquo;<\/p>\n<p>In addition to alleged First Amendment violations, plaintiffs cite Arizona law, which, as summarized in the suit, &ldquo;permits members of the public to criticize members of a public body during a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-canvassers-rescind-their-votes-to-certify-wayne-county-michigan-results\/\" title=\"Republican Canvassers Rescind Their Votes to Certify Wayne County, Michigan, Results\">public comment period<\/a>, providing that at &lsquo;the conclusion of an open call to the public, individual members of the public body may respond to criticism made by those who have addressed the public body.&rsquo;&rdquo;<\/p>\n<p>Hall, the city of Surprise, and Steven Shernicoff, the officer who arrested Massie during the Aug. 20 meeting, are named as defendants in the lawsuit.<\/p>\n<p>Massie is represented by attorneys with the Foundation for Individual Rights and Expression (FIRE). The First Amendment advocacy group <a href=\"https:\/\/thefederalist.com\/2024\/08\/29\/first-amendment-group-says-it-plans-to-support-arizona-resident-arrested-for-speaking-at-city-meeting\/\" target=\"_blank\" rel=\"noreferrer noopener\">indicated<\/a> shortly after Massie&rsquo;s arrest its plans to sue Surprise on her behalf, writing on X it would &ldquo;see [the city] in court.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-9a425242de4c3c80521b4dea9e2db140 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-9a425242de4c3c80521b4dea9e2db140\"><\/div>\n<p>&ldquo;No American should be told to &lsquo;stop talking&rsquo; or go to jail simply for speaking their minds at a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mayor-of-charlottesville-pens-vulgar-poem-likening-city-to-rapist\/\" title=\"Mayor Of Charlottesville Pens Vulgar Poem Likening City To Rapist\">city council meeting<\/a>,&rdquo; FIRE attorney Adam Steinbaugh said in a <a href=\"https:\/\/www.thefire.org\/news\/lawsuit-arizona-mom-sues-city-after-arrest-criticizing-government-lawyers-pay\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. &ldquo;Public officials are elected to serve the people &mdash; not silence them.&rdquo;<\/p>\n<p>Massie has requested the court to issue a preliminary and permanent injunction barring Surprise from enforcing the Council Criticism Policy during future meetings.
