This was &ldquo;improper&rdquo; for Smith to include based on the Supreme Court&rsquo;s view of presidential immunity, Trump&rsquo;s attorneys argued.<\/p>\n<p>The attorneys also said that the Supreme Court&rsquo;s ruling this summer in <em>Fischer v.
