In the name of &ldquo;equity,&rdquo; America&rsquo;s top health care <a href=\"https:\/\/www.newsweek.com\/rankings\/worlds-best-hospitals-2023\/united-states\" target=\"_blank\" rel=\"noreferrer noopener\">systems<\/a> are now segregating or excluding some patients from life-saving programs based on race. These new programs mark a dangerous turn for American health care, where picking and choosing among preferred racial groups is the new standard of care. &nbsp;&nbsp;&nbsp;<\/p>\n<p>Take Cleveland Clinic, for instance. This world-class health care system runs a &ldquo;<a href=\"https:\/\/my.clevelandclinic.org\/-\/scassets\/files\/org\/urology-kidney\/minority-mens-health-fact-sheet-2016.ashx?la=en\" target=\"_blank\" rel=\"noreferrer noopener\">Minority Men&rsquo;s Health Center&rdquo;<\/a> and a &ldquo;<a href=\"https:\/\/my.clevelandclinic.org\/departments\/neurological\/depts\/cerebrovascular\/minority-stroke-program\" target=\"_blank\" rel=\"noreferrer noopener\">Minority Stroke Program<\/a>&rdquo; for addressing numerous medical conditions, including stroke, diabetes, and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/this-common-condition-greatly-increases-your-risk-of-stroke\/\" title=\"This Common Condition Greatly Increases Your Risk of Stroke\">stroke risk factors<\/a>; men&rsquo;s health conditions; and various mental health issues. These programs tout a range of benefits from disease prevention and treatment to specialized providers, transportation assistance, prescription assistance, support groups, and education events.<\/p>\n<p>These are top-notch programs. But they&rsquo;re &ldquo;tailored&rdquo; to minorities. For example, the Minority Stroke Program&rsquo;s stated focus and goal is &ldquo;preventing and treating stroke in racial and ethnic minorities.&rdquo; And so minorities (and only minorities) are encouraged to reach out to the &ldquo;Minority Stroke Program team&rdquo; to set up an appointment.<\/p>\n<p>While a <a href=\"https:\/\/will-law.org\/will-files-federal-civil-rights-complaint-against-cleveland-clinics-racially-discriminatory-patient-programming\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent challenge<\/a> to these race-based programs apparently prompted Cleveland Clinic to quietly remove all traces of the Minority Men&rsquo;s Health Center from its <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2024\/08\/Cleveland-Clinic-Minority-Mens-Health-Center-Webpage-Capture-Aug-8-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">website<\/a>, the clinic&rsquo;s Minority Stroke Program appears to remain otherwise intact at this time.<\/p>\n<p>Cleveland Clinic defends its racially distinctive stroke program by saying that it helps patients &ldquo;<a href=\"https:\/\/consultqd.clevelandclinic.org\/tailoring-stroke-treatment-and-prevention-to-populations-who-need-it-most\" target=\"_blank\" rel=\"noreferrer noopener\">who need it most<\/a>&rdquo; and that the programs are necessary to combat racial disparities. Black and Latino patients, for example, see worse stroke outcomes on average.<\/p>\n<p>But if treating these racial disparities is a valid goal, then why not other disparities? Whites are more likely to suffer from <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2865395\/\" target=\"_blank\" rel=\"noreferrer noopener\">Parkinson&rsquo;s<\/a>, <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC3143259\/\" target=\"_blank\" rel=\"noreferrer noopener\">macular degeneration<\/a>, <a href=\"https:\/\/www.nbcnews.com\/id\/wbna19441218\" target=\"_blank\" rel=\"noreferrer noopener\">Type 1 diabetes<\/a>, <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/35099333\/\" target=\"_blank\" rel=\"noreferrer noopener\">COPD<\/a>, <a href=\"https:\/\/www.medicalnewstoday.com\/articles\/skin-cancer-by-race\" target=\"_blank\" rel=\"noreferrer noopener\">skin cancer<\/a>, <a href=\"https:\/\/www.sciencedaily.com\/releases\/2015\/12\/151216081929.htm\" target=\"_blank\" rel=\"noreferrer noopener\">cystic fibrosis<\/a>, <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC3111798\/\" target=\"_blank\" rel=\"noreferrer noopener\">osteoporosis<\/a>, and <a href=\"https:\/\/medicalxpress.com\/news\/2023-05-whites-highest-prevalence-multiple-sclerosis.html\" target=\"_blank\" rel=\"noreferrer noopener\">MS<\/a>, just to name a few. Should Cleveland Clinic open an MS clinic for white persons? Of course not.<\/p>\n<p>The problem with such racial health equity models is that they use race as a proxy for legitimate health risks. A higher incidence of stroke in a given race does not necessarily mean that race itself is causing strokes. A leading <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC3226886\/\" target=\"_blank\" rel=\"noreferrer noopener\">study<\/a> of racial disparities in stroke outcomes identifies various risk and potential factors: diabetes; hypertension; heart disease or other cardiovascular-related conditions; smoking; low socioeconomic status (such as education level); obesity or physical inactivity; inflammation; vascular factors; sleep apnea; and mental health. Race is not on the list.<\/p>\n<p>Race-based health equity initiatives, like Cleveland Clinic&rsquo;s programs (among others at <a href=\"https:\/\/www.mayoclinic.org\/about-mayo-clinic\/minority-health-wellness\/services\" target=\"_blank\" rel=\"noreferrer noopener\">Mayo Clinic<\/a>, and <a href=\"https:\/\/www.childrenscolorado.org\/community\/community-health\/black-health-initiative\/\" target=\"_blank\" rel=\"noreferrer noopener\">other<\/a> <a href=\"https:\/\/www.brighamandwomens.org\/about-bwh\/newsroom\/addressing-heart-admission-disparities\" target=\"_blank\" rel=\"noreferrer noopener\">leading systems<\/a>), treat disparities, not patients. These programs aim to filter and view health outcomes through a racial lens and assume that one&rsquo;s race says all the doctor needs to know about who needs medical care the most.<\/p>\n<p>But beyond race, <em>any number<\/em> of demographic filters could be applied concerning almost any characteristic to compare and address health outcomes &mdash; to name a few, height, eye color, birth order, handedness, where one lives, and so forth. The mere availability of any given demographic factor does <em>not<\/em> make it a relevant or lawful standard for evaluating health outcomes.<\/p>\n<p>Indeed, studies have <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC7153978\/\">indicate<\/a><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC7153978\/\" target=\"_blank\" rel=\"noreferrer noopener\">d<\/a> that the appearance of racial disparities is explained <em>not<\/em> by race, but by other factors relating to social support systems, neighborhood factors, education, employment, and other novel variables that must be understood and accounted for &mdash; barriers that can transcend racial lines and be responsible for causing disparities in health outcomes.<\/p>\n<p>Discounting relevant and legitimate factors and variables for health risks and outcomes in exchange for simple, blind deference to skin pigmentation for no other purpose than balancing broad racial disparities does <em>not<\/em> help those who need care most. Rather, this approach invokes guesswork that is the product of broad racial stereotyping.<\/p>\n<p>Racial health equity schemes are not only wrongheaded, but also illegal. Under the <a href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/45\/part-80\" target=\"_blank\" rel=\"noreferrer noopener\">broad<\/a> <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/18116\" target=\"_blank\" rel=\"noreferrer noopener\">protections<\/a> of the <a href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/45\/part-92\" target=\"_blank\" rel=\"noreferrer noopener\">Affordable Care Act<\/a> and <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/2000d\" target=\"_blank\" rel=\"noreferrer noopener\">Title VI<\/a> of the Civil Rights Act of 1964, health care entities receiving federal health care dollars may not discriminate based on race. This means that health care providers may not segregate care, impose racial preferences, or implement programs that are racially motivated to provide services to some in a different manner from those provided to others.<\/p>\n<p>Unsurprisingly, the Biden-Harris administration has been on this bandwagon from the get-go. On his first day in office, President Biden signed <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/01\/20\/fact-sheet-president-elect-bidens-day-one-executive-actions-deliver-relief-for-families-across-america-amid-converging-crises\/\" target=\"_blank\" rel=\"noreferrer noopener\">several<\/a> executive orders <a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/01\/25\/2021-01753\/advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government\" target=\"_blank\" rel=\"noreferrer noopener\">mandating<\/a> race-based initiatives. In alignment with this <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/race-based-bailouts-in-covid-stimulus-bill-face-legal-setbacks\/\" title=\"Race-Based Bailouts In COVID Stimulus Bill Face Legal Setbacks\">racial equity agenda<\/a>, recently, the Centers for Medicare and Medicaid Services (CMS) released a <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/05\/17\/2024-09989\/medicare-program-alternative-payment-model-updates-and-the-increasing-organ-transplant-access-iota\" target=\"_blank\" rel=\"noreferrer noopener\">proposed rule<\/a> that would permit and incentivize a racially discriminatory system for allocating kidney transplants and related services. We&rsquo;ve condemned this proposed rule in a <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2024\/07\/WILL-Public-Comment-CMS-Proposed-Rule-IOTA-Model-CMS-5535-P.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">public comment<\/a>.<\/p>\n<p>Unfortunately, however, for the last decade, the race-conscious 2014 Kidney Allocation System has been working to reduce racial disparities in organ transplantation. And according to studies, this system has <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC5681858\/\" target=\"_blank\" rel=\"noreferrer noopener\">worked<\/a> exactly as intended &mdash; increasing transplant rates for certain racial minorities while reducing them for whites.<\/p>\n<p>While some may call these efforts &ldquo;progress,&rdquo; in truth, race-based equity initiatives are nothing more than an illegal endeavor to balance mortality and morbidity according to an individual&rsquo;s skin pigmentation. Patients are not treated as individuals, but as mere representatives of their race.<\/p>\n<p>No matter how well-intentioned, racial balancing in health care is not medicine &mdash; it is politics. Whether a particular patient should be prioritized or included for medical treatment and care does not change simply because a patient is the wrong color. Empty balancing efforts resulting from identity politics have no place in medicine.<\/p>\n<p>Patients and their families should be on alert for these programs, and reject programs that undermine individualized medicine in favor of racially balanced outcomes. This approach assumes that knowing someone&#8217;s race provides all necessary information about their medical care requirements.<\/p>\n<p>Moreover, many demographic factors could be used similarly\u2014height or eye color could also serve as filters when assessing health outcomes\u2014but simply having access to demographic data doesn&#8217;t justify its use in evaluating healthcare needs appropriately.<\/p>\n<p>Studies suggest that apparent racial disparities stem from social support systems and other variables beyond just race itself\u2014factors which can affect everyone regardless of their background. Ignoring relevant determinants of health risks while relying solely on skin color perpetuates stereotypes rather than providing effective care where it&#8217;s needed most.<\/p>\n<p>Racial equity initiatives are misguided\u2014and potentially illegal\u2014as they violate protections under the Affordable Care Act and Title VI of the Civil Rights Act by discriminating based on race within federally funded healthcare settings. Such practices cannot segregate treatment or impose preferences based on an individual&#8217;s ethnicity without breaching legal standards.<\/p>\n<p>The Biden-Harris administration has actively supported these initiatives since taking office; President Biden signed executive orders promoting racially focused policies right away.
