href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/08\/donald-trump-dc-superseding-indictment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filed a superseding indictment<\/a> on Tuesday against former President Donald Trump alleging, in part, that Trump&rsquo;s First Amendment right to question the outcome of an election created &ldquo;mistrust and anger&rdquo; and eroded &ldquo;public faith in the administration of the election.&rdquo;<\/p>\n<p>&ldquo;Each of these conspiracies &mdash; which built on the widespread mistrust the Defendant was creating through pervasive and destabilizing lies about election fraud &mdash; targeted a bedrock function of the United States federal government: the nation&rsquo;s process of collecting, counting, and certifying the results of the presidential election,&rdquo; the indictment alleges.<\/p>\n<div class=\"fdrlst__b89e9-fb8c72f7d903dad2d58fd87b8a3bebc0 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-fb8c72f7d903dad2d58fd87b8a3bebc0\"><\/div>\n<p>Smith alleges Trump &ldquo;erode[d] public faith in the administration of the election&rdquo; despite the fact that Smith&rsquo;s own Justice Department has <a href=\"https:\/\/thefederalist.com\/2024\/03\/04\/biden-department-of-justice-declares-war-on-voter-id-and-other-election-security-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">vowed<\/a> to undermine secure elections, <a href=\"https:\/\/thefederalist.com\/2024\/08\/20\/biden-doj-asks-scotus-to-squash-arizonas-proof-of-citizenship-voter-requirements-for-2024-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> Arizona for trying to require people prove they are citizens to register to vote, and used a federal statute to charge hundreds of protesters that the Supreme Court later <a href=\"https:\/\/thefederalist.com\/2024\/06\/28\/supreme-court-tosses-obstruction-charges-for-j6-defendants\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> was used in an over-broad capacity.<\/p>\n<p>The superseding indictment comes weeks after the <a href=\"https:\/\/thefederalist.com\/2024\/07\/01\/scotus-immunity-ruling-further-delays-trump-trial-in-jack-smiths-d-c-lawfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> issued a 6-3 ruling in June finding that presidents have &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wake-up-with-the-washington-examiner-child-tax-credit-crunch-waiting-for-harris-to-knife-biden-and-why-smith-is-stalling-washington-examiner\/\" &ldquo;actions within his conclusive and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rejects-trumps-motion-to-dismiss-jan-6-case-washington-examiner\/\" title=\"Judge rejects Trump\u2019s motion to dismiss Jan. 6 case - Washington Examiner\">preclusive constitutional authority&#038;rdquo<\/a>; and &ldquo;at least presumptive immunity&rdquo; for all &ldquo;official acts.&rdquo; The court remanded several questions relating to Smith&rsquo;s initial indictment against Trump back to the lower court to determine whether they <a href=\"https:\/\/thefederalist.com\/2023\/10\/06\/why-trumps-presidential-immunity-defense-may-just-lead-to-an-election-indictment-dismissal\/\">constitute an official act<\/a>.<\/p>\n<p>The new indictment is nine pages shorter than Smith&rsquo;s original, 45-page indictment that had the same charges. The indictment changes the allegations that underpin the charges to comport with the Supreme Court&rsquo;s ruling, striking its language about Trump&rsquo;s alleged conspiracy with the Department of Justice (DOJ) to send letters inquiring about potential voter fraud to select states. The Supreme Court found Trump is &ldquo;absolutely immune from prosecution for the alleged conduct involving his discussions with Justice Department officials.&rdquo;<\/p>\n<p>The new indictment charges Trump with conspiracy to defraud, conspiracy to obstruct an official proceeding, obstruction and attempted obstruction of an official proceeding, and conspiracy against rights.<\/p>\n<div class=\"fdrlst__b89e9-808ffbf9852ac4d570220aea5b8576dd fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-808ffbf9852ac4d570220aea5b8576dd\"><\/div>\n<p>But what underpins the new indictment is Smith&rsquo;s claim that Trump and his co-conspirators &ldquo;made knowingly false claims&rdquo; that were &ldquo;unsupported&rdquo; and &ldquo;objectively unreasonable&rdquo; about alleged fraud in the election. <\/p>\n<p>Smith then claims Trump didn&rsquo;t heed the DOJ&rsquo;s warning not to exercise his right to free speech. <\/p>\n<p>&ldquo;The Defendant was on notice that his claims were untrue,&rdquo; the indictment further alleges. &ldquo;The Defendant continued to make false claims nonetheless, with deliberate disregard for the truth, including through his Twitter account.&rdquo;<\/p>\n<p>As I previously <a href=\"https:\/\/thefederalist.com\/2024\/07\/01\/scotus-immunity-ruling-further-delays-trump-trial-in-jack-smiths-d-c-lawfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>, Smith&rsquo;s entire argument is that &ldquo;Trump <em>knew<\/em> his claims that the 2020 election was stolen were false&rdquo; and therefore Trump deserves jail time.<\/p>\n<div class=\"fdrlst__b89e9-259f8868f2f082b6ad3296bda4e4debe fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-259f8868f2f082b6ad3296bda4e4debe\"><\/div>\n<p>President Joe Biden&rsquo;s Justice Department is hellbent on chilling political-related speech, further evidenced by Attorney General Merrick Garland&rsquo;s <a href=\"https:\/\/thefederalist.com\/2024\/08\/27\/garland-makes-an-example-of-j6-protesters-to-shut-up-anyone-else-who-might-question-elections\/\">boast<\/a> last Friday that his office has prosecuted nearly 1,500 Americans for protesting the 2020 election.
