This⁢ decision came after the law was previously halted by a federal district court, citing conflicts with the National Voting Registration Act, which allows for registering without such proof. The ruling allows Arizona to enforce its voter registration requirements, although some aspects of the ⁤law remain contested, particularly⁤ concerning voting in presidential or mail-in elections for those who registered using a federal form without proof. This law stipulates that documents such as a birth certificate, passport, driver’s license, or naturalization number are necessary for voter registration, according to Courthouse News Service. The Biden administration, along with Mi Familia Vota and other voting rights organizations, filed a lawsuit in federal court aiming to block the enforcement of this law. In September 2023, a federal district court ruled that the National Voting Registration Act superseded state law and issued an injunction against the new Arizona regulation.

Following this ruling, the Republican National Committee (RNC) requested an emergency stay on the injunction from the 9th U.S. Circuit Court of Appeals; however, this court upheld the lower court’s decision. Last week, RNC officials and GOP leaders from Arizona submitted an emergency petition to the U.S. Supreme Court seeking to lift the injunction. In a narrow 5-4 decision, the Supreme Court supported Arizona’s requirement for proof of citizenship in order for voters to register using state forms and participate in elections for both state and federal offices.

While celebrating this ruling as a significant win for election integrity in Arizona—asserting that voters must provide proof of citizenship—the court maintained restrictions challenged by the Biden administration which would bar individuals without such proof from voting in presidential elections or by mail if they registered using a different federal form.

Five conservative justices sided with Arizona on some aspects; however, Justice Amy Coney Barrett joined three liberal justices in dissenting against any enforceable provisions within Arizona’s law. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch favored enforcing all aspects related to both federal and state elections but were only joined by Chief Justice John Roberts and Brett Kavanaugh regarding upholding specific voter registration requirements.

The case may return to the Supreme Court depending on how it is ultimately resolved by the 9th Circuit since both courts made their decisions based on temporary emergency considerations due to impending elections. The Biden administration contended that Arizona’s legislation violated federal regulations concerning voter registration.

Currently under existing laws governing federal election registrations only require individuals affirm their U.S. citizenship without needing documentary evidence; thus allowing those who register federally without providing proof of citizenship still able to vote in presidential races according to Democratic Secretary of State Adrian Fontes among others who have opted not enforce this particular aspect of state legislation.

In response after ruling RNC Chairman Michael Whatley stated his organization has been committed towards maintaining electoral integrity while opposing efforts perceived as undermining these safeguards aimed at preventing non-citizen voting—a sentiment echoed through social media posts celebrating what he termed “a seismic win.”

Arizona Senate President Warren Petersen remarked about ongoing legal challenges ahead despite recent victories emphasizing concerns over illegal residents being able register via alternative methods lacking documentation leading them potentially participating congressional contests moving forward asserting continued litigation will pursue ensuring only lawful citizens cast ballots

[33651
4472,5052,37752,32275,39028
post-2329600","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-the-western-journal","tag-arizona","tag-enforcement","tag-proof-of-citizenship","tag-supreme-court","tag-voting-law
["GET
