request to allow for the 2024 election an Arizona law requiring voters to provide documentary proof of citizenship.<\/p>\n<p>In a <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/082224zr_n75p.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">5-4 decision<\/a>, the high court granted in part an emergency request by the Republican National Committee and Arizona&rsquo;s GOP legislative leadership to place a stay on a lower court ruling that prohibited the law&rsquo;s enforcement. Chief Justice John Roberts and Associate Justices Clarence Thomas, Neil Gorsuch, Samuel Alito, and Brett Kavanaugh comprised the majority, while Associate Justices Elena Kagan, Sonia Sotomayor, Ketanji Brown Jackson, and Amy Coney Barrett dissented.<\/p>\n<div class=\"fdrlst__b89e9-7c92937428424fec8db4720c7b881a85 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-7c92937428424fec8db4720c7b881a85\"><\/div>\n<p>As The Federalist previously&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/08\/10\/republicans-ask-scotus-to-greenlight-arizonas-proof-of-citizenship-requirement-for-voter-registration\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the 2022 statute mandated residents to show documentary proof of citizenship (DPOC) when registering via state voter registration forms. It also required such proof for individuals submitting mail-in ballots and voting in presidential contests. (In Arizona, individuals who do not provide DPOC when registering to vote are&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a>&nbsp;to do so as &ldquo;federal-only voters&rdquo; and only cast ballots in federal elections).<\/p>\n<p>Thursday&rsquo;s SCOTUS order allows the law&rsquo;s DPOC requirement for registering via state voter registration forms to take effect for the 2024 election. The high court did not, however, grant Republicans&rsquo; request to place a stay on the part of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-moves-up-deadline-for-supreme-court-briefing-in-pennsylvania-lawsuit-to-flip-the-election\/\" title=\"Justice Alito Moves Up Deadline For Supreme Court Briefing in Pennsylvania Lawsuit to Flip the Election\">lower court&#038;rsquo<\/a>;s ruling prohibiting enforcement of the provisions requiring DPOC for individuals voting in presidential contests and casting ballots via mail. <\/p>\n<p>Thomas, Alito, and Gorsuch would have granted Republicans&rsquo; request for stay &ldquo;in full,&rdquo; according to the order. <\/p>\n<p>According to&nbsp;<a href=\"https:\/\/azfreenews.com\/2021\/09\/over-11600-no-proof-of-citizenship-required-federal-ballots-cast-in-2020-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">AZ Free News<\/a>, more than 11,600 individuals voted via &ldquo;federal-only&rdquo; ballots during the Grand Canyon State&rsquo;s 2020 election. That&rsquo;s larger than Joe Biden&rsquo;s&nbsp;<a href=\"https:\/\/www.cnn.com\/election\/2020\/results\/state\/arizona\" target=\"_blank\" rel=\"noreferrer noopener\">margin of victory<\/a>&nbsp;(10,457 votes) over Donald Trump.<\/p>\n<div class=\"fdrlst__b89e9-bb0e9abe2832bc1e8e02f640da7899e7 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-bb0e9abe2832bc1e8e02f640da7899e7\"><\/div>\n<p>&ldquo;Huge win: the Supreme Court just ruled that the state of Arizona must REJECT state voter registration forms without proof of US citizenship,&rdquo; RNC Chair Michael Whatley <a href=\"https:\/\/x.com\/ChairmanWhatley\/status\/1826695899676115325\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> on X. &ldquo;A seismic win in the fight to stop non-citizens from voting &mdash; more to come!&rdquo;<\/p>\n<p>The Biden-Harris Department of Justice and Arizona&rsquo;s attorney general and secretary of state, both Democrats, <a href=\"https:\/\/thefederalist.com\/2024\/08\/20\/biden-doj-asks-scotus-to-squash-arizonas-proof-of-citizenship-voter-requirements-for-2024-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> motions asking SCOTUS to deny Republicans&rsquo; request.
