The court ruled 6-1 against the group Floridians Protecting Freedom, which challenged the statement, stating that they had participated in and did not object to the Financial Impact Estimating Conference’s process prior to their lawsuit. The majority opinion noted that because the petitioners engaged in this process without raising concerns about its authority to issue a revised financial impact statement, they forfeited their claim for extraordinary relief from the court.

The approved financial statement cautions that if Amendment 4 is passed, it could result in an increase in abortions and a decrease in births within the state. It also raises concerns about potential state-funded abortions and parental consent laws for minors seeking abortions. The statement indicates that litigation over these uncertainties could lead to additional costs for state government and courts, negatively affecting the budget. Furthermore, it suggests that an increase in abortions might adversely impact state and local revenue growth over time.

Supporters of Amendment 4 have condemned this financial statement as “deceptive” and politically motivated, claiming it misleads voters regarding the ballot measure. Conversely, opponents represented by Vote No on 4 Florida welcomed the court’s decision as correct. They argue that voters should be informed about potential taxpayer-funded abortions and lack of parental consent requirements for minors under Amendment 4.

If passed, Amendment 4 would prevent any legislation aimed at prohibiting or restricting abortion before viability or when necessary for protecting a patient’s health as determined by their healthcare provider. Critics assert that its vague language could lead to minimal restrictions on abortion access.

To become law, this measure requires approval from at least 60% of voters—more challenging than states where only a simple majority is needed for constitutional amendments. Democrats view this measure as an opportunity to enhance voter turnout following significant losses during Florida’s 2022 midterm elections.
