In Georgia, voters have the ability to contest another voter’s eligibility, which is particularly important when the state fails to maintain accurate lists. However, the Cobb County Board of Elections and Registration recently implemented a rule that requires individuals who challenge a potentially ineligible voter to cover the costs of notifying that voter. This decision was made with a 4-1 vote, where Republican Debbie Fisher was the only dissenting voice. According to ABC News, challengers will now need to pay for both printing and mailing the challenge notice; this new rule has not yet been publicly announced.

Cobb County Republican Chairwoman Salleigh Grubbs criticized this regulation as “ridiculous,” stating that it unfairly places financial burdens on citizens when it is the government’s responsibility to maintain clean voter rolls—something taxpayers already fund.

State law permits voters to contest another voter’s eligibility if they suspect that person no longer resides in the county. Democrats have often targeted election integrity advocates in Georgia for their efforts to keep voter rolls accurate. A judge appointed by Barack Obama ruled earlier this year that challenging potentially ineligible voters is lawful after a lawsuit backed by Stacey Abrams’ nonprofit sought to eliminate this option.

This legal action followed True The Vote’s announcement in 2020 about plans to challenge over 364,000 Georgia voters before Senate runoff elections. A more refined list with around 39,000 challenges was later compiled by former Marine Derek Somerville and expert Mark Davis; Judge Steve Jones noted their approach was more careful than TTV’s and aimed at minimizing unnecessary challenges while ensuring valid reasons for those pursued.

As reported by The Federalist, over 12,000 individuals who moved within-state confirmed they had voted illegally from an incorrect county during the 2020 elections by updating their registration after voting from their previous addresses—indicating legitimate grounds for challenging these votes.

However, it has been private citizens stepping up to rectify inaccuracies on voter rolls due to state negligence regarding its responsibilities. Now Cobb County seeks to undermine public accountability by requiring Georgians advocating for fair elections to personally finance these efforts.

Davis remarked on Facebook that filing a challenge is essentially petitioning government authorities for redress—a right protected under the First Amendment—and questioned whether next steps might involve charging citizens simply for voicing concerns at school board meetings.

Brianna Lyman serves as an elections correspondent at The Federalist and holds a degree in International Political Economy from Fordham University.
