They asked the court to grant a request for a stay on an Aug. 2 decision by the 9th Circuit Court of Appeals. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2024\/08\/10\/republicans-ask-scotus-to-greenlight-arizonas-proof-of-citizenship-requirement-for-voter-registration\/\">reported<\/a>, that ruling halted enforcement of provisions in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-asks-scotus-to-approve-azs-proof-of-citizenship-mandate\/\" title=\"GOP Asks SCOTUS To Approve AZ&#039;s Proof Of Citizenship Mandate\">2022 state law requiring individuals<\/a> to provide documentary proof of citizenship (DPOC) when registering via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">state voter registration forms<\/a>.<\/p>\n<p>&ldquo;The Constitution gives states the power to set voter qualifications, and AZ is leading the charge to ensure ONLY CITIZENS vote in our elections,&rdquo; the Arizona Republican Party <a href=\"https:\/\/x.com\/AZGOP\/status\/1824225704231440522\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> on X. &ldquo;This case has the potential to prevent non-citizen voting once and for all, which should have been the case all along.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-fca0f573072f43012345f5cb2260d6af fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-fca0f573072f43012345f5cb2260d6af\"><\/div>\n<p>The amicus was filed in support of an <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/Emerg._App._for_Stay_1723155858.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency application for stay<\/a> brought by the Republican National Committee and Arizona&rsquo;s GOP legislative leadership last week, which similarly asked SCOTUS to uphold Arizona&rsquo;s DPOC law. The parties also asked the high court to permit Arizona to require such proof for individuals submitting mail-in ballots and voting in presidential contests.<\/p>\n<p>&ldquo;Thus, while Amici States support Applicants in full, they focus here on the district court&rsquo;s decision that the [National Voter Registration Act] preempts Arizona&rsquo;s election integrity rules as it relates to voting in presidential elections and mail-in voting,&rdquo; the attorneys general brief reads. &ldquo;That determination is a direct threat to the States&rsquo; ability to police voter fraud and their sovereign right to define their political communities. It is erroneous, and this Court should grant the requested relief.&rdquo;<\/p>\n<p>The Honest Elections Project and Restoring Integrity and Trust in Elections (RITE) also filed <a href=\"https:\/\/honestelections.org\/honest-elections-project-files-amicus-brief-urging-arizona-supreme-court-to-reject-ranked-choice-voting-ballot-measure\/\" target=\"_blank\" rel=\"noreferrer noopener\">separate<\/a> <a href=\"https:\/\/riteusa.org\/wp-content\/uploads\/2024\/08\/RNC-v.-Mi-Familia-Vota-Amicus-SCOTUS.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">briefs<\/a> on Thursday asking SCOTUS to issue a stay on the 9th Circuit&rsquo;s ruling. The latter group argued that the lower court&rsquo;s decision &ldquo;poses special harms to Arizona&rsquo;s own significant interest in protecting the integrity of its elections.&rdquo;<\/p>\n<p>&ldquo;Like most States, Arizona has long provided opportunities for voters to cast a ballot by mail &mdash; with safeguards to ensure that the absentee ballot process maintains its integrity,&rdquo; the RITE brief reads. &ldquo;One of those safeguards is that applicants must provide documentary proof of citizenship to vote by mail. Other voters who have properly registered may still vote in-person, either during Arizona&rsquo;s generous early voting period or on Election Day.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-1d2c0273ae23b7c75a473b01c302c31b fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-1d2c0273ae23b7c75a473b01c302c31b\"><\/div>\n<p>Justice Elena Kagan is the &ldquo;circuit justice&rdquo;&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/about\/circuitassignments.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">tasked<\/a>&nbsp;with handling emergency stay applications from western states.
