The former president will have the power to pardon Meadows in a federal, but not state, case if he is reelected.

U.S. District Judge John Tuchi, who was nominated to the bench by former President Barack Obama, has scheduled a Sept. 5 hearing to consider Meadows’s request. This marks Meadows’ second effort in this regard; his legal team will argue that his actions were conducted while he was serving as a federal official under Trump and will aim for the charges to be dismissed. Additionally, it appears that Meadows may wish to move his case to federal court as a precautionary measure in case of a conviction—if Trump is re-elected, he could potentially pardon Meadows for federal offenses but not for state ones. U.S. District Judge John Tuchi, appointed by Barack Obama, has set a hearing for September 5th to review Meadows’ request. He faces charges in both Arizona and Georgia related to an alleged scheme aimed at overturning the results of the 2020 election.

Mel McDonald, a former county judge and U.S. attorney for Arizona during Ronald Reagan’s presidency, expressed belief that Meadows has the strongest chance among defendants in the Arizona electors case of successfully moving their trial to federal court due to its connection with a federal election and Meadows’ role as a federal official. Although prosecutors allege that Meadows did not directly collaborate with fake electors, they claim he coordinated with other members of Trump’s campaign regarding submitting names of fake electors from various states in an attempt to keep Trump in power despite losing the election. The indictment also mentions that Meadows informed White House staff about Trump’s electoral defeat shortly after it occurred.

Last year, Meadows attempted unsuccessfully to shift his Georgia case into federal jurisdiction; both lower courts denied this request and he has since appealed it up to the Supreme Court. In their recent filing regarding Arizona, Meadow’s attorneys contended that none of their client’s alleged actions were criminal and characterized them instead as receiving communications from individuals trying either to present ideas or update him on legal strategies related to Trump’s campaign efforts

[4472,38298,32869,23070,32076
post-2325407","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-arizona","tag-federal-court","tag-legal-battle","tag-meadows","tag-washington-examiner
["GET
