The motion also asks the high court to permit Arizona to require such proof for individuals submitting mail-in ballots and voting in presidential contests.<\/p>\n<p>Filed on Thursday by the Republican National Committee (RNC) and Arizona&rsquo;s GOP legislative leadership, the <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/Emerg._App._for_Stay_1723155858.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency application<\/a> asks SCOTUS to issue a stay on a Aug. 2 decision by a three-judge panel on the 9th Circuit Court of Appeals, which prohibited enforcement of provisions in a 2022 state law requiring individuals provide documentary proof of citizenship (DPOC) when registering via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">state voter registration forms<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-6fbc5c8ca5c92206d70fd99ab5770957 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-6fbc5c8ca5c92206d70fd99ab5770957\"><\/div>\n<p>That decision reversed a <a href=\"https:\/\/thefederalist.com\/2024\/07\/19\/court-lets-arizona-reject-would-be-voters-who-fail-to-prove-citizenship-on-state-registration-form\/\" target=\"_blank\" rel=\"noreferrer noopener\">July 18 ruling<\/a> by the court&rsquo;s motions panel allowing the law to take effect, according to <a href=\"https:\/\/azfreenews.com\/2024\/08\/ninth-circuit-strikes-arizona-proof-of-citizenship-requirements-in-reverse-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">AZ Free News<\/a>. The motions panel&rsquo;s decision overturned a May district court ruling that deemed the law illegal.<\/p>\n<p><a href=\"https:\/\/www.influencewatch.org\/non-profit\/mi-familia-vota\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mi Familia Vota<\/a> and <a href=\"https:\/\/www.influencewatch.org\/non-profit\/voto-latino\/\" target=\"_blank\" rel=\"noreferrer noopener\">Voto Latino<\/a> are among several left-wing groups challenging the statute&rsquo;s legality. <\/p>\n<p>In requesting SCOTUS allow the DPOC requirement to be used in the Grand Canyon State&rsquo;s November elections, the RNC and Arizona Republicans cited the <a href=\"https:\/\/ballotpedia.org\/The_Purcell_Principle\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Purcell<\/em> principle<\/a>, which, as described by Ballotpedia, is a legal doctrine &ldquo;establishing that courts should not change election rules during the period just prior to an election because it could confuse voters and election officials.&rdquo; The principle originates from the 2006 Supreme Court case <em>Purcell vs. Gonzalez<\/em>, which centered on an Arizona voter ID requirement. <\/p>\n<p>&ldquo;This Court has repeatedly instructed that the <em>Purcell<\/em> principle bars federal courts from enjoining the enforcement of state election laws with an election impending,&rdquo; the filing reads. &ldquo;The principle recognizes the important interests state officials have in protecting their elections and avoiding voter confusion. But the Ninth Circuit turned this principle against the enforcement of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-house-republicans-demand-investigation-into-bidens-order-to-promote-voter-registration\/\" title=\"EXCLUSIVE: House Republicans Demand Investigation Into Biden\u2019s Order To \u2018Promote Voter Registration\u2019\">state election integrity laws<\/a>.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-8e3ab7dcf4d4fb0ab74d1fe3349d4d6c fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-8e3ab7dcf4d4fb0ab74d1fe3349d4d6c\"><\/div>\n<p>Applicants argue the imminence of the November contest justifies the &ldquo;need for prompt relief&rdquo; and that resolution of the matter &ldquo;concerns the form and printing deadline of ballots: to implement its prohibition on voting in presidential elections by individuals who have not provided documentary proof of citizenship, Arizona must either not print the presidential candidates on federal only-ballots, or configure its tabulation machines not to count presidential votes on federal only ballots.&rdquo;<\/p>\n<p>In Arizona, individuals who do not provide DPOC when registering to vote are&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a>&nbsp;to do so as &ldquo;federal-only voters&rdquo; and cast ballots in federal elections. That allowance is due to a 2013 Supreme Court ruling known as&nbsp;<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/570\/1\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Arizona v. Inter Tribal Council of Ariz., Inc<\/em>.<\/a> <\/p>\n<p>&ldquo;Requiring proof of citizenship is common sense and fundamental to preserving the integrity of our elections &mdash; especially in our country&rsquo;s most important presidential election,&rdquo; RNC Chair Michael Whatley said in a <a href=\"https:\/\/gop.com\/press-release\/rnc-files-application-in-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. &ldquo;This application in the Supreme Court is pivotal to ensuring that Arizonans&rsquo; votes are not cancelled by noncitizens.&rdquo;<\/p>\n<p>Applicants have requested SCOTUS to issue a stay allowing the aforementioned DPOC requirements to take effect before Aug. 22.<\/p>\n<div class=\"fdrlst__b89e9-eba6c200dc6215db3cdc5543208e9073 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-eba6c200dc6215db3cdc5543208e9073\"><\/div>\n<p>Justice Elena Kagan is the &ldquo;circuit justice&rdquo; <a href=\"https:\/\/www.supremecourt.gov\/about\/circuitassignments.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">tasked<\/a> with handling emergency stay applications from western states.
