In her letter to interim Labor Secretary Julie Su, Foxx accused her of obstructing lawful oversight by failing to provide requested information and data to the Committee on Education & Workforce. Foxx stated that her committee is investigating efforts by the administration to eliminate independent contractor status and classify more workers as employees, which would increase government control over them. Su has until August 22 to respond. As chair of the committee, Foxx noted that new criteria established on March 11 determine legal protections and compensation for independent workers without prioritizing any single factor. These criteria include aspects such as profit potential, financial investment in work, permanence of employment relationships, employer control over work processes, essentiality of tasks for business operations, and worker skill levels. In her letter, Foxx expressed frustration that Su’s responses from May 17 did not include any requested data necessary for reviewing DOL’s final rule on independent contractors or informing potential legislation on this issue. The committee seeks historical instances of misclassification since President Biden took office and details about enforcement investigations related to misclassification within various industry sectors. There are approximately 70 million individuals who support themselves as independent contractors in America. Additionally, Su’s department faced criticism regarding a rule affecting farmworkers under the H-2A program that was said to prioritize foreign nationals’ interests over those of U.S citizens; this prompted letters from congressmen representing agricultural states like North Carolina’s David Rouzer and accusations from Kansas Attorney General Kris Kobach about circumventing Congress’s authority established by the National Labor Relations Act of 1935

https://www.washingtonexaminer.com/wp-content/uploads/2024/07/uber-lyft-california-supreme-court.webp
[4384,37653,32312,37654
post-2321795","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","tag-committee","tag-gig-workers","tag-government-control","tag-labor-rights
https://www.washingtonexaminer.com/wp-content/uploads/2024/07/uber-lyft-california-supreme-court.webp
["GET
