The judge found that these provisions, which were aimed at\u2062 restricting voter behavior \u2062and free speech, violated the First \u200dAmendment rights of\u2063 Arizonans. Specifically, the\u2064 EPM, issued by \u2064Secretary of State Adrian Fontes, was criticized for infringing\u2062 upon rights related to observing polling places and interacting at election sites.<\/p>\n<p>The court asserted that the EPM overreached in its guidelines regarding acceptable conduct during elections, effectively criminalizing activities that are\u200c protected by both the state\u200c and U.S. constitutions. free speech are &ldquo;unenforceable,&rdquo; a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-supreme-court-takes-up-trump-lawsuit-days-ahead-of-electoral-college-vote\/\" title=\"Wisconsin Supreme Court Takes Up Trump Lawsuit Days Ahead of Electoral College Vote\">state judge ruled<\/a> on Monday. <\/p>\n<p>Writing for the Maricopa County Superior Court, Judge Jennifer Ryan-Touhill <a href=\"https:\/\/azfree.org\/wp-content\/uploads\/2024\/08\/AZ-Free-Enterprise-Club-v.-Fontes-Court-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">determined<\/a> that the 2023 Election Procedures Manual (EPM) issued by Secretary of State Adrian Fontes, a Democrat, contains guidance that infringes upon Arizonans&rsquo; First Amendment right to free speech. <\/p>\n<div class=\"fdrlst__b89e9-0eca8e351623f466bb86300eb3feb9fa fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-0eca8e351623f466bb86300eb3feb9fa\"><\/div>\n<p>&ldquo;The EPM&rsquo;s language has restricted what the Secretary finds acceptable regarding behavior, both speech and acts. Our state constitution guarantees a right to speak freely and is only restricted for an abuse of that right,&rdquo; Ryan-Touhill wrote.<\/p>\n<p>In Arizona, the EPM provides guidance to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuit-both-the-how-and-the-what-of-democrat-election-chiefs-rulebook-violate-arizona-law\/\" title=\"Lawsuit: Democrat Election Chief&#039;s Rulebook Violates Arizona Law\">election officials relating<\/a> to mail ballots, voter registration, and other election-related matters. The secretary of state is <a href=\"https:\/\/www.azleg.gov\/ars\/16\/00452.htm\" target=\"_blank\" rel=\"noreferrer noopener\">required<\/a> to produce the guidance by Dec. 31 of every odd-numbered year and receive approval from the governor and attorney general before it can be finalized for use in elections.<\/p>\n<p>In its <a href=\"https:\/\/azfree.org\/wp-content\/uploads\/2024\/02\/EPM-Complaint-FINAL-AS-FILED-02.09.2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">initial lawsuit<\/a> filed against Fontes in February, the Arizona Free Enterprise Club (AFEC) alleged the EPM&rsquo;s restrictions on activities such as &ldquo;watching drop boxes, speaking to people at election sites, and photographing activity at election sites&rdquo; criminalizes conduct &ldquo;which is plainly protected by the First Amendment and article 2, sections 5-6 of the Arizona Constitution.&rdquo; That allegation is in reference to provisions within the <a href=\"https:\/\/apps.azsos.gov\/election\/files\/epm\/2023\/EPM_20231231_Final_Edits_to_Cal_1_11_2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">EPM<\/a> permitting local election officials to develop measures inhibiting individuals&rsquo; ability to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-district-court-rules-in-favor-of-monitors-constitutional-right-to-oversee-ballot-drop-boxes\/\" title=\"Arizona District Court Rules in Favor of Monitors&#039; Constitutional Right to Oversee Ballot Drop Boxes\">observe ballot drop boxes<\/a> and classifying behavior at polling sites, such as &ldquo;raising one&rsquo;s voice or taunting a voter or poll worker,&rdquo; as potentially &ldquo;intimidating conduct.&rdquo;<\/p>\n<p>AFEC filed an amended complaint in April, according to Monday&rsquo;s decision. America First Policy Institute and Arizona resident Philip Townsend are also plaintiffs in the case. <\/p>\n<div class=\"fdrlst__b89e9-b020c5696c0dac7e2dfde42f12a8d55b fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-b020c5696c0dac7e2dfde42f12a8d55b\"><\/div>\n<p>Ryan-Touhill <a href=\"https:\/\/azfree.org\/wp-content\/uploads\/2024\/08\/AZ-Free-Enterprise-Club-v.-Fontes-Court-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> that guidance included in the section of the EPM governing conduct at polling locations &ldquo;goes too far&rdquo; by attempting to police the behavior of both election officials and the general public. She further determined those provisions constitute &ldquo;speech restrictions in violation of our Arizona Constitution,&rdquo; and that the EPM &ldquo;misstates or modifies [state] statutes, and fails to identify any distinction between guidance and legal mandates.&rdquo;<\/p>\n<p>&ldquo;[M]any of the prohibitions listed in the EPM are free speech and protected by both the Arizona Constitution and the U.S. Constitution,&rdquo; Ryan-Touhill wrote. &ldquo;What, for example, constitutes a person communicating about voter fraud in a harassing manner? Or, for that matter, &lsquo;posting&rsquo; a sign in an intimidating manner?&nbsp; How does a person either do this behavior &mdash; whatever it means &mdash; or avoid it?&nbsp; And what content printed on a t-shirt might be offensive or harassing to one and not another? What if the t-shirt says, &lsquo;I have a bomb and I intend to vote!&rsquo;? Where does the Secretary draw the line?&rdquo;<\/p>\n<p>In determining plaintiffs &ldquo;have proven a strong likelihood of success on the merits&rdquo; of the case, the court declared the EPM provisions restricting Arizonans&rsquo; speech &ldquo;unenforceable&rdquo; and prohibited their enforcement &ldquo;during the pendency of this litigation.&rdquo;<\/p>\n<p>The court did, however, grant Fontes and Attorney General Kris Mayes&rsquo; motions to dismiss plaintiffs&rsquo; allegations against the EPM&rsquo;s guidance on voter registration, the state&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-say-arizonas-2020-disaster-is-a-lesson-learned-washington-examiner\/\" title=\"Republicans say Arizona&#039;s 2020 disaster is a lesson learned- Washington Examiner\">active early voter list<\/a>, and early voter signature verification.<\/p>\n<div class=\"fdrlst__b89e9-4db5966fe27bcc22f828a617c6f491ff fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-4db5966fe27bcc22f828a617c6f491ff\"><\/div>\n<p>&ldquo;The judge correctly realized that certain portions of Secretary Fontes&rsquo; illegal and radical manual were nothing more than a brazen attempt to destroy the integrity and transparency of state elections,&rdquo; AFEC President Scot Mussi <a href=\"https:\/\/azfreenews.com\/2024\/08\/judge-rules-arizonas-election-procedures-manual-to-be-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> said in a statement. &ldquo;Secretary Fontes and his team of leftwing ideologues must conform the entire manual to state law as is their statutory duty.&rdquo;<\/p>\n<p>Fontes&rsquo; office has pledged to appeal the ruling, according to <a href=\"https:\/\/www.12news.com\/article\/news\/local\/arizona\/arizona-judge-blocks-speech-restrictions-in-elections-manual-adrian-fontes\/75-91dcdeef-b54b-4c39-aeab-95322ed0a097\" target=\"_blank\" rel=\"noreferrer noopener\">local media<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-b1a3dbeb43966b3135cb023d1a5bac9b fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-b1a3dbeb43966b3135cb023d1a5bac9b\"><\/div>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
