his legally-required duties &ldquo;to ensure that foreign citizens are removed from Maricopa County&rsquo;s voter rolls.&rdquo; Richer &mdash; a staunch opponent of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/paxton-urges-gop-state-lawmakers-to-tighten-election-integrity-laws\/\" title=\"Paxton Urges GOP State Lawmakers to Tighten Election Integrity Laws\">election integrity efforts<\/a> in Arizona &mdash; <a href=\"https:\/\/thefederalist.com\/2024\/07\/31\/primary-voters-in-arizonas-largest-county-oust-leftist-backed-elections-chief\/\" target=\"_blank\" rel=\"noreferrer noopener\">lost<\/a> his reelection bid during Arizona&rsquo;s primary elections last week.<\/p>\n<div class=\"fdrlst__b89e9-f4b6e15831b03166bb43fb64ad4a3a7c fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f4b6e15831b03166bb43fb64ad4a3a7c\"><\/div>\n<p>&ldquo;This lawsuit seeks to restore public trust in our State&rsquo;s electoral system by holding Recorder Richer accountable for his failures and to ensure that the list maintenance required by the law and common sense &mdash; is performed,&rdquo; the legal filing reads. <\/p>\n<p>Plaintiffs are represented by America First Legal (AFL) and a law firm headed by former Arizona Assistant Attorney General Jennifer Wright. <\/p>\n<p>The issue seemingly began last month when AFL sent <a href=\"https:\/\/aflegal.org\/america-first-legal-sends-legal-demand-letter-to-all-15-arizona-counties-threatening-legal-action-if-they-do-not-take-action-to-stop-illegal-aliens-from-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">letters<\/a> to Arizona&rsquo;s 15 county recorders demanding they fulfill their statutory obligation to verify the citizenship of the state&rsquo;s Federal-Only voters. In Arizona, individuals who do not provide documentary proof of citizenship (DPOC) when registering to vote are <a href=\"https:\/\/thefederalist.com\/2024\/01\/12\/elon-musk-rightly-says-arizona-doesnt-verify-federal-voter-citizenship-but-the-feds-dont-let-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted<\/a> to do so as &ldquo;Federal-Only Voters&rdquo; and cast ballots in federal elections. That allowance is due to a 2013 U.S. Supreme Court ruling known as <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/570\/1\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Arizona v. Inter Tribal Council of Ariz., Inc<\/em>.<\/a><\/p>\n<p>In 2022, then-Gov. Doug Ducey signed legislation requiring individuals to show DPOC when registering via <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">state voter registration forms<\/a>. That law also tasked county recorders with &ldquo;perform[ing] monthly list maintenance to confirm the citizenship of all Federal-Only Voters,&rdquo; according to the lawsuit.<\/p>\n<div class=\"fdrlst__b89e9-e6d55a0d83b868409d6d4f6cff611d5b fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e6d55a0d83b868409d6d4f6cff611d5b\"><\/div>\n<p>Enforcement of the law was <a href=\"https:\/\/arizonadailyindependent.com\/2024\/08\/02\/free-enterprise-club-vows-to-appeal-questionable-ninth-circuit-reversal-in-mi-familia-vota-v-arizona\/\" target=\"_blank\" rel=\"noreferrer noopener\">halted<\/a> by a three-judge panel on the 9th Circuit Court of Appeals last week. Defendants in the case are reportedly planning to appeal the decision to the Supreme Court. <\/p>\n<p>According to <a href=\"https:\/\/aflegal.org\/america-first-legal-sues-maricopa-county-in-arizona-for-refusing-to-take-action-to-stop-illegal-aliens-from-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">AFL<\/a>, Richer responded to the group&rsquo;s July 16 letter through an attorney, &ldquo;brazenly stating,&rdquo; as AFL described &ldquo;that he would not be taking any action&rdquo; and claiming his office &ldquo;is already following the law about verifying the citizenship of voters.&rdquo; Plaintiffs <a href=\"https:\/\/media.aflegal.org\/wp-content\/uploads\/2024\/08\/05220036\/Strong-Communities-v.-Maricopa-County-II-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">contest<\/a> the accuracy of that assertion, arguing in their suit that Richer &ldquo;has failed to perform&rdquo; proper list maintenance as required by state and federal law by neglecting to take mandated action to ensure only eligible U.S. citizens are on Maricopa&rsquo;s voter rolls.<\/p>\n<p>&ldquo;Because it is illegal for foreign citizens to register to vote in federal elections, any foreign citizen who is registered to vote is ineligible,&rdquo; the lawsuit reads. &ldquo;Therefore, federal law requires County Recorders to &lsquo;perform list maintenance&rsquo; and to engage in &lsquo;reasonable efforts&rsquo; to ensure that foreign citizens are not registered to vote.&rdquo;<\/p>\n<p><strong>[RELATED:[RELATED:<a href=\"https:\/\/thefederalist.com\/2024\/06\/25\/how-states-can-use-existing-laws-to-find-foreign-nationals-on-their-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">How States Can Use Existing Laws To Find Foreign Nationals On Their Voter Rolls<\/a>]<\/strong><\/p>\n<div class=\"fdrlst__b89e9-e7aa02ae89884c5fc9ff3a32d36a53ee fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e7aa02ae89884c5fc9ff3a32d36a53ee\"><\/div>\n<p>When pressed for comment on the plaintiffs&rsquo; allegations, a representative from Maricopa County&rsquo;s recorder&rsquo;s office told The Federalist that Richer &ldquo;has not yet been served with the lawsuit and so has not had opportunity to review it and therefore cannot comment about it.&rdquo;<\/p>\n<p>&ldquo;The Maricopa County Recorder&rsquo;s Office, however, prioritizes and prides itself on maintaining accurate, up-to-date voter rolls,&rdquo; the representative said. &ldquo;Under Recorder Stephen Richer, voter list maintenance has remained a top priority, removing more than 400,000 voters from the rolls since January 2021.
