So it is worth celebrating when they fail.<\/p>\n<p>On Tuesday, the United States Court of Appeals for the Fifth Circuit <a href=\"https:\/\/abc3340.com\/resources\/pdf\/b2002ad7-24dd-4fd8-8b03-31d1f2778e8e-2350632CV1.pdf\" target=\"_blank\" rel=\"noopener\">sided with<\/a> Republican Gov. Greg Abbott of Texas in a case involving Abbott&rsquo;s July 2023 decision to install a floating barrier in the Rio Grande River near Eagle Pass, Texas, as part of an effort to stem the influx of immigrants crossing illegally into the United States.<\/p>\n<p>The Biden administration, desperate to keep the border open, immediately sued Abbott. Citing the <a href=\"https:\/\/www.fisheries.noaa.gov\/inport\/item\/59646#:~:text=The%20Rivers%20and%20Harbors%20Act,and%20other%20construction%20and%20excavation.\" target=\"_blank\" rel=\"noopener\">Rivers and Harbors Appropriation Act of 1899<\/a>, federal officials demanded removal of the floating barrier.<\/p>\n<p>A district court then granted a preliminary injunction against Texas, which the full appeals court stayed pending appeal.<\/p>\n<p>In other words, the question of whether <a href=\"https:\/\/www.westernjournal.com\/another-state-joins-texas-authorizes-state-local-cops-soon-begin-arresting-illegal-immigrants\/\" target=\"_blank\" rel=\"noopener\">Texas<\/a> violated the RHA by illegally obstructing navigable waters has remained in the courts for the past year.<\/p>\n<p>  <script> \t\t\t\tif( ! getCookie( 'ff_subbed' ) ) if( typeof FFADS.replace_ict !='undefined' ) if( FFADS.replace_ict ) eval( FFADS.replace_ict ); \t\t\t<\/script> <\/p>\n<p>The entire case, in fact, involves a degree of obvious diabolical deception.<\/p>\n<p>After all, the Biden administration does not give two hoots about the RHA, and everyone knows it. Federal officials sued Abbott not to protect river navigation, but to <a href=\"https:\/\/www.westernjournal.com\/2024-election-biden-says-quiet-part-loud-reason-border-invasion\/\" target=\"_blank\" rel=\"noopener\">keep the border open<\/a>.<\/p>\n<p>Still, the appeals court had to proceed as if RHA and not open borders constituted the real issue.<\/p>\n<p>&ldquo;We ask: Can the United States likely prove during trial that Texas violated the RHA? That question turns on another: Can the United States likely prove that the barrier is located within a navigable stretch of the Rio Grande? Because the RHA extends only to navigable waters, our answer to this question may &mdash; and in our view does &mdash; dispose of the first,&rdquo; the appeals court wrote.<\/p>\n<p>In other words, the Biden administration could not even prove the river&rsquo;s navigability in that relevant stretch.<\/p>\n<p>It appears, therefore, that the federal government intended primarily to keep Texas tied up in court over something palpably absurd.<\/p>\n<p>&ldquo;Accordingly, we now DISSOLVE the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-blocks-january-6-committee-access-to-trump-white-house-documents\/\" title=\"Appeals Court Blocks January 6 Committee Access To Trump White House Documents\">stay pending appeal<\/a>, REVERSE the district court&rsquo;s order granting a preliminary injunction, and REMAND with instructions to vacate the preliminary injunction and for further proceedings consistent with this opinion,&rdquo; the appeals court wrote.<\/p>\n<p>Thus, the barrier remains.<\/p>\n<p>On the social media platform X, <a href=\"https:\/\/www.westernjournal.com\/greg-abbott-warns-biden-walking-right-biggest-blunder-border-battle-texas\/\" target=\"_blank\" rel=\"noopener\">Abbott<\/a> celebrated.<\/p>\n<p>&ldquo;The Federal Court of Appeals for the Fifth Circuit just ruled that Texas can KEEP these buoys in the water securing our border.
