Candidates of all parties would be forced to run in a single primary, in which the &ldquo;top four vote-earners&rdquo; would advance to the RCV-run general election, according to Ballotpedia.<\/p>\n<div class=\"fdrlst__b89e9-dd0a62e983a8e68233f02fec6a95152b fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-dd0a62e983a8e68233f02fec6a95152b\"><\/div>\n<p>The proposed ballot measure would effectively negate a law <a href=\"https:\/\/thefederalist.com\/2023\/04\/03\/idaho-takes-an-axe-to-ranked-choice-voting-in-elections-and-north-dakota-and-arizona-could-follow-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a> last year by the Idaho Legislature barring the use of RCV.<\/p>\n<p>Under ranked-choice <a href=\"https:\/\/thefederalist.com\/2023\/10\/31\/ranked-choice-voting-is-the-monster-under-the-bed-of-american-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">voting<\/a>, voters rank candidates of all parties in order of preference. If no candidate receives more than 50 percent of first-choice votes in the first round of voting, the last-place finisher is eliminated, and his votes are reallocated to the voter&rsquo;s second-choice candidate. This process continues until one candidate receives a majority of votes.<\/p>\n<p>Labrador argues that Idahoans for Open Primaries, the ballot measure&rsquo;s primary supporter, employed &ldquo;misleading&rdquo; language and practices when gathering signatures for the initiative by referring to the sought-after system as an &ldquo;open primary.&rdquo;<\/p>\n<p>The attorney general claims defendants did this in spite of a ruling on the initiative by the high court last year. In that decision, the court&rsquo;s majority <a href=\"https:\/\/idahocapitalsun.com\/2023\/08\/10\/idaho-supreme-court-rules-against-ag-raul-labrador-in-open-primary-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">instructed<\/a> Labrador to rewrite his original title for the initiative and <a href=\"https:\/\/attorneygeneralofidaho-my.sharepoint.com\/personal\/isaac_considine_ag_idaho_gov\/_layouts\/15\/onedrive.aspx?id=%2Fpersonal%2Fisaac%5Fconsidine%5Fag%5Fidaho%5Fgov%2FDocuments%2FVerified%20Petition%20%2D%20Idahoans%20for%20Open%20Primaries%2F2024%2D07%2D24%20Petition%20for%20Writ%20of%20Prohibition%20or%20Mandamus%2Epdf&amp;parent=%2Fpersonal%2Fisaac%5Fconsidine%5Fag%5Fidaho%5Fgov%2FDocuments%2FVerified%20Petition%20%2D%20Idahoans%20for%20Open%20Primaries&amp;ga=1\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a>, as Labrador also does in the suit, that the measure&rsquo;s use of the term &ldquo;open primary&rdquo; &ldquo;fail[s] to accurately describe the primary system proposed by the Initiative.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-8af7aa585526b49c9c607af54a35a067 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-8af7aa585526b49c9c607af54a35a067\"><\/div>\n<p>&ldquo;The coalition&rsquo;s pervasive uses of the slogan &lsquo;open primaries,&rsquo; after this Court ruled it inaccurate, are knowing &lsquo;false statement[s] or representation[s]&rsquo; that violate&rdquo; state statute, the lawsuit reads. &ldquo;All the coalition&rsquo;s signatures were obtained in violation of this statute and &lsquo;are null and void.&#8217;&rdquo;<\/p>\n<p>Labrador also accuses Idahoans for Open Primaries of using &ldquo;deceptive marketing&rdquo; and of neglecting to inform voters the proposal would institute RCV for general elections.<\/p>\n<p>&ldquo;[U]nlike the &lsquo;open primaries&rsquo; slogan, &lsquo;ranked-choice voting&rsquo; is nowhere to be seen on the coalition&rsquo;s clipboards, banners, t-shirts, stickers, or website home page,&rdquo; the lawsuit reads. &ldquo;Indeed, it has been relegated to an afterthought in the coalition&rsquo;s promotional efforts.&rdquo;<\/p>\n<p>In the lawsuit, the attorney general clarifies that &ldquo;[r]anked-choice voting receives so little attention in Idahoans for Open Primaries&rsquo; promotional materials because it is highly unpopular and, when tried in other jurisdictions, often quickly repealed.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-7214ea693d7fd0edf2fe61151c75250e fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-7214ea693d7fd0edf2fe61151c75250e\"><\/div>\n<p>By adding &ldquo;a ranked-choice voting proposal to a comparatively more popular top-four primary proposal, Idahoans for Open Primaries hopes to secure votes from citizens who don&rsquo;t notice that the initiative has anything to do with ranked-choice voting,&rdquo; or those &ldquo;who support a top four primary strongly enough to vote for the bundled pair,&rdquo; according to the lawsuit.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2023\/10\/31\/ranked-choice-voting-is-the-monster-under-the-bed-of-american-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ranked-Choice Voting Is The Monster Under The Bed Of American Elections<\/a>]<\/strong><\/p>\n<p>Another issue raised in the suit is Idaho&rsquo;s &ldquo;single-subject rule&rdquo; for <a href=\"https:\/\/ballotpedia.org\/Laws_governing_the_initiative_process_in_Idaho\" target=\"_blank\" rel=\"noreferrer noopener\">initiatives<\/a>, which, according to a prior court ruling, <a href=\"https:\/\/casetext.com\/case\/amer-fed-of-labor-v-langley\" target=\"_blank\" rel=\"noreferrer noopener\">requires<\/a> &ldquo;a common object, and that all parts of a statute relate to and tend to support and accomplish the indicated object.&rdquo; Labrador argues that the initiative&rsquo;s attempt to institute a top-four primary and RCV-run general election constitutes &ldquo;two distinct objects,&rdquo; and subsequently violates the &ldquo;single-subject&rdquo; provision.<\/p>\n<p>&ldquo;A top four primary has nothing to do with how votes are tabulated in the general election, and its implementation is unrelated to adopting a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/glenn-youngkin-wins-gop-nomination-for-governor-of-virginia\/\" title=\"Glenn Youngkin Wins GOP Nomination For Governor Of Virginia\">ranked-choice voting system<\/a>,&rdquo; the lawsuit reads. <\/p>\n<p>Labrador has requested the Idaho Supreme Court issue &ldquo;a peremptory or alternative writ of prohibition&rdquo; instructing the secretary of state &ldquo;not to include&rdquo; the initiative title and number on the &ldquo;certified ballot&rdquo; distributed to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-our-vote-matters-is-suing-facebook-dominion-mark-zuckerberg-certain-state-officials-others-for-infringing-upon-right-to-vote-assemble-and-speak-freely-you-can-jo\/\" title=\"Group \u201cOur Vote Matters\u201d Is Suing Facebook, Dominion, Mark Zuckerberg, Certain State Officials, Others for Infringing Upon Right to Vote, Assemble and Speak Freely \u2013 You Can Join Too\">local election officials<\/a>, or &ldquo;a peremptory or alternative writ of mandate ordering the Secretary of State &hellip; to declare that all signatures supporting the initiative are invalid and withdraw his filing, acceptance, and certification of the initiative so it does not appear on the final certified ballot.&rdquo;<\/p>\n<p>The attorney general asked the court to &ldquo;expedite&rdquo;
