The court stayed an injunction that had forced the state to register those applicants as federal-only voters.<\/p>\n<p>The 9th Circuit Court of Appeals panel <a href=\"https:\/\/www.azsenaterepublicans.gov\/_files\/ugd\/2f3470_b0c9c2c190424627a0a51b20c7ed1672.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that &ldquo;appellants &hellip; have satisfied the standard for a stay pending appeal with respect to the portion of the injunction barring enforcement of A.R.S &sect; 16-121.01(C). &ldquo;<\/p>\n<div class=\"fdrlst__b89e9-f1aa8c753f0f093b3202a192793416b4 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f1aa8c753f0f093b3202a192793416b4\"><\/div>\n<p>Section 16-121.01(C), which the court ruled may be enforced, <a href=\"https:\/\/www.azleg.gov\/ars\/16\/00121-01.htm\" target=\"_blank\" rel=\"noreferrer noopener\">stipulates<\/a> that &ldquo;any application for [state] registration shall be accompanied by satisfactory evidence of citizenship &hellip; and the county recorder or other officer in charge of elections shall reject any application for registration that is not accompanied by satisfactory evidence of citizenship.&rdquo;<\/p>\n<p>The ruling means that county recorders are no longer required to register an applicant as a federal-only voter if he tried to register with a state form but could not prove his citizenship. The panel did deny Republicans&rsquo; request to prevent individuals who used a federal registration form from voting in the presidential race and voting by mail.<\/p>\n<p>Arizona Senate President Warren Petersen celebrated the ruling as a &ldquo;victory for election integrity.&rdquo;<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"nlg\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">&#128680;BREAKING: Today, the Ninth Circuit Court of Appeals ruled in favor of election integrity! Only U.S. citizens should be&hellip; <a href=\"https:\/\/t.co\/IjNCv9lSmz\">pic.twitter.com\/IjNCv9lSmz<\/a><\/p>\n<p>&mdash; AZSenateRepublicans (@AZSenateGOP) <a href=\"https:\/\/twitter.com\/AZSenateGOP\/status\/1814027272053215461?ref_src=twsrc%5Etfw\">July 18, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>&ldquo;Only U.S. citizens should be allowed to vote in our elections,&rdquo; Petersen said in a statement shared on X. &ldquo;It sounds like common sense, but the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules-2\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">radical left elected officials<\/a> in our state continue to reject this notion, disrespecting the voices of our lawful Arizona voters.&rdquo;<\/p>\n<div class=\"fdrlst__b89e9-2b33fb7e8060a405e8f84e1f24821ea9 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-2b33fb7e8060a405e8f84e1f24821ea9\"><\/div>\n<p>Arizona voters approved Proposition 200 in 2004 which required documentary proof of citizenship and photo identification to vote. The Supreme Court <a href=\"https:\/\/thefederalist.com\/2024\/01\/19\/ballots-cast-without-proof-of-citizenship-exploded-after-lawfare-crippled-arizona-election-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled in 2013<\/a>, however, that states could not require proof of citizenship to register to vote in federal elections and must use the standardized federal form, which simply asks each applicant to check a box affirming he is a citizen. Arizona responded by creating a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-can-reject-voter-registrations-without-citizenship-proof-court-rules-3\/\" title=\"Arizona can reject voter registrations without citizenship proof, court rules\">separate state registration form<\/a> which does require voters to provide documentary proof of citizenship.<\/p>\n<p>A 2018 consent decree, however, forced the state to still register voters who used a state form but didn&rsquo;t proof of citizenship as a federal-only voter. Federal-only voters may vote in presidential elections.<\/p>\n<p>During the 2020 presidential race, in which President Joe Biden <a href=\"https:\/\/www.cnn.com\/election\/2020\/results\/state\/arizona\/president\" target=\"_blank\" rel=\"noreferrer noopener\">won<\/a> the state by 10,457 votes, 11,600 federal-only ballots were cast, according to <a href=\"https:\/\/azfreenews.com\/2021\/09\/over-11600-no-proof-of-citizenship-required-federal-ballots-cast-in-2020-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">AZ Free News<\/a>. There are currently more than 35,000 Arizonans who are registered to vote via a federal-only ballot, according to <a href=\"https:\/\/www.kawc.org\/news\/2024-07-18\/decision-by-9th-court-provides-clarity-about-citizenship-and-voter-registration-in-arizona\" target=\"_blank\" rel=\"noreferrer noopener\">KAWC<\/a>.<\/p>\n<p>In 2022, <a href=\"https:\/\/thefederalist.com\/2024\/03\/01\/court-affirms-arizonas-need-to-keep-noncitizens-off-voter-rolls-but-makes-it-harder-to-do-so\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a> Republicans passed <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/laws\/0099.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">HB 2492<\/a>, which includes Section 16-121.01(C) and states that potential registrants must have &ldquo;provided satisfactory evidence of citizenship&rdquo; in order to register to vote using a state form. <\/p>\n<div class=\"fdrlst__b89e9-518a97f82377b38ee1f7013afd8320ec fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-518a97f82377b38ee1f7013afd8320ec\"><\/div>\n<p>Now, a voter who fails to prove he is a citizen when trying to register with a state form will not be automatically permitted to still vote in federal elections. Voters who initially register with a federal form, however, are still not required to provide documentary proof of citizenship.<\/p>\n<p>Thursday&rsquo;s decision overruled a May <a href=\"https:\/\/www.documentcloud.org\/documents\/24852451-bolton-may-ruling\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> from the District Court for the District of Arizona that had found the statute violated federal law. <\/p>\n<p>Left-wing voting groups such as Mi Familia Vota had <a href=\"https:\/\/www.democracydocket.com\/cases\/arizona-citizenship-requirement-challenge\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued<\/a> the state in 2022, naming Democrat Secretary of State Adrian Fontes as a defendant, to challenge the statute. Petersen is also named as a defendant, as is Attorney General Kris Mayes, in the consolidated case.
