The majority of judges on the U.S. Court of Appeals for the 5th Circuit determined that Section 241 of the Mississippi Constitution, which disenfranchises those convicted of specific felony offenses, does not violate the U.S. Constitution. The court stated that overturning Section 241 would interfere with the state’s legislative and citizen’s rights to determine voting qualifications, and that such decisions should be made at the state level rather than by federal courts. The ruling comes after a previous decision by a three-judge panel that the voting ban violated the Eighth Amendment, which was later vacated by the full panel of the court.
