The suit also\u200b alleged that because voting is not\u200c a right &ldquo;every\u2064 voter should expect [their] vote not to be wiped out by a vote that [is] cast contrary to law,&rdquo; claiming the legislature &ldquo;forcibly \u200cdiluted&rdquo; voters&rsquo; rights.<\/p>\n<p>But \u2063Du said\u2063 that was not enough to prove harm.<\/p>\n<p>&ldquo;This theory asks the Court to simply assume\u200b that changes in\u2062 voting procedures have\u200d an \u2064effect on election results\u200b and \u200dcertainly does not\u2062 support a conclusion that those effects will harm \u200da party if standing is improper,&rdquo; Du wrote, adding that &ldquo;without a causal\u200b chain, theory \u200cdoes not \u2062show a \u2063concrete\u200c and particularized injury-in-fact \u2064that is fairly traceable to the\u200c challenged conduct and\u2063 redressable in a judicial \u200cforum.&rdquo;<\/p>\n<p>The \u200bjudge\u2063 also noted that \u200bthe RNC could not\u200d show the\u2063 four-day extension hurt any particular \u200ccompetitive \u200ddisadvantage.<\/p>\n<p>&ldquo;The other theory\u2063 more specific to Nevada involves the four-day receipt window \u200bfor ballots sent \u2063by mail without a postmark,&rdquo; Du\u2064 wrote.\u2063 &ldquo;There\u200b is no basis\u200b for the court to agree that these votes, giving\u200d Nevada&rsquo;s relatively small population and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/what-is-going-on-minnesota-and-wisconsin-both-had-89-90-turnout-something-that-is-highly-unlikely\/\" title=\"What is Going On? Minnesota and Wisconsin BOTH had 89%-90% Turnout -- Something That Is Highly Unlikely\">presidential election turnout<\/a>, will illegally \u200cdilute Organization Plaintiffs&rsquo; votes in Nevada or any federal election, much \u200dless in a way that is \u2064traceable to the Chief Election Officer\u200c letting\u200c counties \u2062tally these ballots among all the others proper for counting, or indeed\u200b to other Nevada \u2063state officials interpreting and enforcing Nevada law in line with that interpretation.&rdquo;<\/p>\n<p>    While the state has\u2064 created a window for counties to\u200d accept \u2064ballots \u200dup \u200bto four\u200d days after Election \u200bDay, state law also still provides that any \u200cofficially postmarked ballot cast on \u2062or before\u2064 Election \u200cDay\u200c is \u2063to be counted, Du noted.<\/p>\n<p>&ldquo;Nevada law also \u200bspecifies exactly who\u200c decides whether\u2064 a voter&rsquo;s ballot is stamped with an official United States Postal Service (USPS) cancellation mark proven \u200bto get\u200c it in the mail by Election \u200dDay,&rdquo; alleged electoral injuries is too speculative to support standing,&rdquo; Du <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/07\/rnc-vs-burgess-order.pdf\">ruled<\/a>.<\/p>\n<p>After President Joe Biden <a href=\"https:\/\/apnews.com\/article\/election-2020-joe-biden-donald-trump-elections-courts-c9674bbf1090515bfad0920344f17037\" target=\"_blank\" rel=\"noreferrer noopener\">won<\/a> Nevada in 2020 by 33,596 votes, the state legislature officially extended the deadline for which counties could accept mail-in ballots post-marked by Election Day to four days after Election Day. The statute is <a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/the-evolution-of-absentee-mail-voting-laws-2020-through-2022\" target=\"_blank\" rel=\"noreferrer noopener\">similar<\/a> to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nevada-law-allowing-late-ballots-to-be-counted-is-unconstitutional-lawsuit-alleges\/\" title=\"Lawsuit claims Nevada&#039;s late ballot counting law is unconstitutional\">temporary pandemic-related measure<\/a> that extended the mail-in ballot deadline to seven days post-election in 2020. It also permits ballots &ldquo;whose date of postmark cannot be determined&rdquo; to be accepted so long as they arrive before 5:00 p.m. on the third day after Election Day, according to the ruling. <\/p>\n<p><strong>[READNEXT:[READNEXT:<a href=\"https:\/\/thefederalist.com\/2020\/12\/03\/trump-lawyers-claim-widespread-election-fraud-in-nevada-and-theyre-about-to-have-their-day-in-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump Lawyers Claim Widespread Election Fraud In Nevada, And They&rsquo;re About To Have Their Day In Court<\/a>]<\/strong><\/p>\n<p>The RNC and Trump campaign argued the extension &ldquo;violates federal law&rdquo; that establishes a uniform Election Day.<\/p>\n<div class=\"fdrlst__b89e9-3685375b8be1cdccf7c949910d151abd fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-3685375b8be1cdccf7c949910d151abd\"><\/div>\n<p>&ldquo;The result of Nevada&rsquo;s violation of federal law is that timely, valid ballots are diluted by untimely, invalid ballots, which violates the rights of candidates, campaigns, and voters under federal law,&rdquo; the suit filed in May <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/NV_Election_Day_Complaint_filed_05.03.20243_1714757420.pdf?_gl=1*rwk76x*_gcl_au*MTQ2MTg4NjgwNy4xNzE0NTA5Njk1&amp;_ga=2.243593413.1772150727.1715002494-1335934802.1714509696\" target=\"_blank\" rel=\"noreferrer noopener\">alleged<\/a>. <\/p>\n<p>&ldquo;Dilution of honest votes, to any degree, by the casting of fraudulent or illegitimate votes violates the right to vote,&rdquo; it continues.<\/p>\n<p>Republicans pointed to the inclination Democrats have toward using mail-in ballots in the state, noting in their suit that during the 2020 general election, 60.3 percent of Democratic Nevada voters voted by mail compared to just 36.9 percent of Republican voters.<\/p>\n<p>Du, an Obama appointee, has a history of siding with leftist election priorities. During 2020, she permitted Fair Maps Nevada to <a href=\"https:\/\/ballotpedia.org\/Miranda_Du\" target=\"_blank\" rel=\"noreferrer noopener\">continue collecting<\/a> voter signatures to get a question on the ballot regarding the creation of a Nevada redistricting commission, despite the deadline having passed. Du argued the state stay-at-home order prevented Fair Maps Nevada from being able to collect the necessary signatures. Although the measure did not ultimately make it on the ballot, if passed it &ldquo;would have transferred the power to draw the state&rsquo;s congressional and legislative districts from the&nbsp;<a href=\"https:\/\/ballotpedia.org\/Nevada_State_Legislature\">state legislature<\/a>&nbsp;to a seven-member&nbsp;<a href=\"https:\/\/ballotpedia.org\/Independent_redistricting_commissions\">independent redistricting commission<\/a>,&rdquo; according to Ballotpedia. Du also rejected a challenge from True the Vote in 2020 which sought to prevent the state from having an all-mail primary election. Du argued the motion lacked standing and ruled that &ldquo;protecting the health and safety of Nevada&rsquo;s voters &hellip; in light of the COVID-19 pandemic&rdquo; by using <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nevada-allowed-to-continue-counting-ballots-received-after-election-day-judge-rules\/\" title=\"Nevada allowed to continue counting ballots received after Election Day, judge rules\">widespread mail balloting outweighed concerns<\/a> about potential dilution of votes, according to <a href=\"https:\/\/thenevadaindependent.com\/article\/judge-rejects-conservative-groups-attempt-to-block-planned-all-mail-primary\" target=\"_blank\" rel=\"noreferrer noopener\">The Nevada Independent<\/a>.
