It comes after <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ksd.151881\/gov.uscourts.ksd.151881.76.0.pdf\">multiple<\/a> <a href=\"https:\/\/www.politico.com\/news\/2024\/06\/24\/courts-block-biden-student-loan-repayment-plan-00164771\">federal courts<\/a> blocked Biden\u2019s <a href=\"https:\/\/thefederalist.com\/2022\/09\/19\/biden-just-admitted-his-student-loan-forgiveness-scheme-is-illegal\/\">illegal<\/a> student loan forgiveness plan. <\/p>\n<div  class=\"fdrlst__b89e9-024dfd920eba7a6123b76d90617b1371 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-024dfd920eba7a6123b76d90617b1371\"><\/div>\n<p>\u201cIn recent weeks, several federal courts have issued rulings in lawsuits brought by Republican elected officials \u2026 trying to block Americans from accessing all the benefits of the most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/over-4-million-borrowers-enroll-in-bidens-save-plan\/\" title=\"4M+ Borrowers Join Biden&#039;s SAVE Plan\">affordable student loan repayment plan<\/a> in history,\u201d Cardona wrote. \u201cPresident Biden and I are determined to lower costs for student loan borrowers \u2026 no matter how many times Republican elected officials try to stop us.\u201d<\/p>\n<p>The letter accuses Republicans of \u201csiding with special interests\u201d and \u201cblocking\u201d aid to Americans, insisting that Biden \u201cwill not stop fighting.\u201d<\/p>\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\"  class=\"wp-block-file__embed\" data=\"https:\/\/thefederalist.com\/wp-content\/uploads\/2024\/07\/StudentAid.gov_Letter.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of StudentAid.gov_Letter.\"><\/object><a id=\"wp-block-file--media-f43becf4-9d0a-4881-9998-dedf6633bf11\" href=\"https:\/\/thefederalist.com\/wp-content\/uploads\/2024\/07\/StudentAid.gov_Letter.pdf\">StudentAid.gov_Letter<\/a><a href=\"https:\/\/thefederalist.com\/wp-content\/uploads\/2024\/07\/StudentAid.gov_Letter.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-f43becf4-9d0a-4881-9998-dedf6633bf11\">Download<\/a><\/div>\n<p>Student loan forgiveness is a <a href=\"https:\/\/thefederalist.com\/2024\/04\/09\/bidens-latest-student-loan-bailout-has-election-year-bribe-written-all-over-it\/\">trademark<\/a> of Biden\u2019s presidency and 2024 reelection campaign and a frequent talking point from the White House and the campaign trail. <\/p>\n<p>\u201cMy MAGA Republican friends in the Congress, elected officials, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-explodes-over-scotus-ruling-on-student-loans-the-court-misinterpreted-constitution\/\" title=\"Biden Explodes Over SCOTUS Ruling On Student Loans: \u2018The Court Misinterpreted Constitution\u2019\">special interests stepped<\/a> in and sued us, and the Supreme Court blocked it. They blocked it. But that didn\u2019t stop me,\u201d Biden said in a February <a href=\"https:\/\/x.com\/theblaze\/status\/1760505111481065911?s=20\">press conference<\/a>. <\/p>\n<div  class=\"fdrlst__b89e9-183777d3f4945c714a98375b7141f407 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-183777d3f4945c714a98375b7141f407\"><\/div>\n<p>But it is illegal for an executive branch employee, such as Cardona, to express partisan election sentiments in an official capacity. Biden <a href=\"https:\/\/www.congress.gov\/nomination\/117th-congress\/78\/5\">nominated<\/a> Cardona to serve as U.S. Secretary of Education in January 2021, and the Senate <a href=\"https:\/\/www.help.senate.gov\/chair\/newsroom\/press\/senate-votes-to-confirm-dr-miguel-cardona-to-serve-as-education-secretary\">confirmed<\/a> Cardona in March.<\/p>\n<p>Hatch Act prohibitions are less stringent upon Senate-confirmed political appointees, but it <a href=\"https:\/\/www.doi.gov\/ethics\/political-activity\">remains illegal<\/a> for them to participate in partisan political activity in an official capacity. <\/p>\n<p>\u201cPolitical activity refers to any activity directed at the success or failure of a partisan group or candidate in a partisan election,\u201d an <a href=\"https:\/\/www.hill.af.mil\/News\/Article-Display\/Article\/2368341\/permitted-and-prohibited-political-activities-for-most-federal-employees\/\" target=\"_blank\" rel=\"noreferrer noopener\">ethics guide<\/a> from the federal government explains. \u201c<a href=\"https:\/\/www.doi.gov\/ethics\/political-activity\" target=\"_blank\" rel=\"noreferrer noopener\">Presidentially<\/a> appointed, Senate confirmed personnel (PAS) are subject to special Hatch Act rules. \u2026 They too, however, may only participate in partisan political activity in a purely personal (not official) capacity.\u201d <\/p>\n<p>Users on X expressed confusion at receiving a blatantly political email from a government agency. <\/p>\n<div  class=\"fdrlst__b89e9-8b4c7052aff0ea50d67420d701d9b412 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-8b4c7052aff0ea50d67420d701d9b412\"><\/div>\n<p>\u201cI was really confused on why this was sent to me from the Department of Education regarding my own student loans attacking Republicans,\u201d one student loan borrower <a href=\"https:\/\/x.com\/NotK_US\/status\/1812601176980111794\">wrote<\/a>. \u201cTypically emails from the DOE is just telling [me] that I made a payment.\u00a0 But this was extremely political attacking Republicans.\u201d<\/p>\n<p>\u201cSomeone really messed up,\u201d <a href=\"https:\/\/x.com\/swatter911\/status\/1812601464218591688\">another<\/a> tweeted.<\/p>\n<p>The Department of Education did not immediately respond to The Federalist\u2019s request for comment.<\/p>\n<div  class=\"fdrlst__b89e9-446eed64fa0e65aa9c2a92bfac52b4ac fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-446eed64fa0e65aa9c2a92bfac52b4ac\"><\/div>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Monroe Harless is a summer intern at The Federalist.
