The effect of this Order is confined to this proceeding,\u201d wrote Cannon, who was <a href=\"https:\/\/trumpwhitehouse.archives.gov\/presidential-actions\/president-donald-j-trump-announces-judicial-nominees-11\/\" target=\"_blank\" rel=\"noopener\">nominated to the bench<\/a> by Trump in 2020.<\/p>\n<p>\u201cBoth the Appointments and Appropriations challenges as framed in the Motion raise the following threshold question: is there a statute in the United States Code that authorizes the appointment of Special Counsel Smith to conduct this prosecution? After careful study of this seminal issue, the answer is no,\u201d she said.<\/p>\n<p>\u201cThe Special Counsel\u2019s position effectively usurps that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-throws-out-unconstitutional-docs-case-against-trump\/\" title=\"Judge Throws Out &#039;Unconstitutional&#039; Docs Case Against Trump\">important legislative authority<\/a>, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers,\u201d the judge wrote.<\/p>\n<p>\u201cIf the political branches wish to grant the Attorney General power to appoint Special Counsel Smith to investigate and prosecute this action with the full powers of a United States Attorney, there is a valid means by which to do so,\u201d Cannon said.<\/p>\n<p>\u201cThe Framers gave Congress a pivotal role in the appointment of principal and inferior officers. That role cannot be usurped by the Executive Branch or diffused elsewhere\u2014whether in this case or in another case, whether in times of heightened national need or not,\u201d she wrote.<\/p>\n<p>Cannon noted that a proliferation of special prosecutors has come with little oversight.<\/p>\n<p>\u201cIn the end, it seems the Executive\u2019s growing comfort in appointing \u2018regulatory\u2019 special counsels in the more <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-check-no-buzz-aldrin-did-not-tweet-the-apollo-11-moon-landing-was-faked\/\" title=\"FACT CHECK: No, Buzz Aldrin Did Not Tweet The Apollo 11 Moon Landing Was Faked\">recent era<\/a> has followed an ad hoc pattern with little judicial scrutiny,\u201d she wrote.<\/p>\n<p>In a Monday post on his <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/112791026080012056\" target=\"_blank\" rel=\"noopener\">Truth Social<\/a> platform, Trump said, \u201cAs we move forward in Uniting our Nation after the horrific events on Saturday, this dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts \u2014 The January 6th Hoax in Washington, D.C., the Manhattan D.A.\u2019s Zombie Case, the New York A.G. Scam, Fake Claims about a woman I never met (a decades old photo in a line with her then husband does not count), and the Georgia \u2018Perfect\u2019 Phone Call charges.\u201d<\/p>\n<p>\u201cThe Democrat Justice Department coordinated ALL of these Political Attacks, which are an Election Interference conspiracy against Joe Biden\u2019s Political Opponent, ME. Let us come together to END all Weaponization of our Justice System, and Make America Great Again!\u201d he said.<\/p>\n<p>The documents case against Trump began with an August 2022 <a href=\"https:\/\/www.westernjournal.com\/judge-presiding-trump-documents-case-smacks-special-counsel-jack-smith\/\" target=\"_blank\" rel=\"noopener\">FBI raid<\/a> on his Mar-a-Lago property in Palm Beach, Florida, in which boxes of documents were seized.<\/p>\n<p>The former president was later indicted on multiple counts of improper possession of classified documents.<\/p>\n<p>Smith is also the prosecutor in a case that charged Trump with election interference.
