The appointment of Smith led to an armed raid on Mar-a-Lago and Trump being indicted on 40 federal charges. Cannon ruled that Smith&#8217;s\u200c appointment violated the Appointments Clause of\u200c the United\u2062 States Constitution and therefore the indictment was dismissed. The ruling highlighted the importance \u200cof Congress&#8217;s role in determining the appointment of officers and criticized\u200d the transfer of legislative authority to the executive branch. Cannon stated that\u2064 if \u200bthe political branches want to grant the Attorney\u200c General the \u200bpower to appoint a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">special counsel<\/a> with prosecutorial powers, there\u2064 is a valid means to\u2064 do \u2062so. the dismissal of the indictment was based on the unconstitutional nature of Smith&#8217;s appointment as Special Counsel.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Judge Aileen Cannon on Monday threw out the lawfare prosecution against former President Donald Trump for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-launches-2024-presidential-bid\/\" title=\"Trump Launches 2024 Presidential Bid\">allegedly mishandling classified documents<\/a> after finding the Biden administration unconstitutionally appointed Special Counsel Jack Smith.<\/p>\n<p>As part of the Biden Justice Department\u2019s effort to jail the president\u2019s political opponent, Attorney General Merrick Garland appointed Special Counsel Jack Smith to prosecute Trump. The appointment served as the pretext for the armed 2022 raid on Mar-a-Lago \u2014 where the use of deadly force was authorized \u2014 and led to Smith indicting Trump in June 2023 on 40 federal charges related to his alleged mishandling of classified documents.<\/p>\n<p>Cannon postponed the trial indefinitely in May, and she heard arguments from Trump\u2019s attorneys in June alleging Smith\u2019s appointment was unconstitutional under the Appointments Clause.<\/p>\n<p>Cannon <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/07\/trump-classified-documents-dismissed-aileen-cannon.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">agreed<\/a> in an order on Monday.<\/p>\n<p>\u201cFormer President Trump\u2019s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is <strong>GRANTED <\/strong>in accordance with this Order,\u201d Cannon ruled. \u201cThe Superseding Indictment is <strong>DISMISSED <\/strong>because Special Counsel Smith\u2019s appointment violates the Appointment\u2019s Clause of the United States Constitution.\u201d<\/p>\n<figure><\/figure>\n<p>Trump\u2019s team questioned whether, according to the Order, \u201cthere [is] a statute in the United States Code that authorizes the appointment of Special Counsel Smith to conduct this prosecution?\u201d<\/p>\n<p>\u201cAfter careful study of this seminal issue, the answer is no,\u201d Cannon ruled. <\/p>\n<p>\u201cNone of the statutes cited as legal authority for the appointment \u2026 gives the Attorney General broad inferior-officer appointing power or bestows upon him the right to appoint a federal officer with the kind of prosecutorial power wielded by Special Counsel Smith,\u201d the ruling states.<\/p>\n<p>Cannon ruled Congress is granted via the Constitution a \u201crole in determining the propriety of vesting appointment power for inferior officers.\u201d<\/p>\n<p>\u201cThe Special Counsel\u2019s position effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers,\u201d Cannon ruled. \u201cIf the political branches wish to grant the Attorney General power to appoint Special Counsel Smith to investigate and prosecute this action with the full powers of a United States Attorney, there is a valid means by which to do so.\u201d<\/p>\n<p>Cannon ruled Smith\u2019s appointment also \u201cviolates the Appropriations Clause \u2026 but the Court need not address the proper remedy for that funding violation given the dismissal on Appointments Clause grounds. The effect of this Order is confined to this proceeding.\u201d<\/p>\n<p>Supreme Court Justice Clarence Thomas <a href=\"https:\/\/thefederalist.com\/2024\/07\/01\/clarence-thomas-challenges-jack-smiths-legitimacy-as-trump-makes-same-argument-in-florida\/\" target=\"_blank\" rel=\"noreferrer noopener\">recently raised<\/a> the same argument in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-thomas-challenges-legitimacy-of-jack-smiths-appointment\/\" title=\"Justice Thomas Challenges Legitimacy Of Jack Smith&#039;s Appointment\">concurring opinion affirming presidents<\/a> have \u201cat least presumptive immunity\u201d for official acts.<\/p>\n<p>Thomas argued that Attorney General Merrick Garland\u2019s appointment of Smith to prosecute Trump as part of the Biden administration\u2019s lawfare efforts may have been unconstitutional because he is \u201cnot sure that any office for the Special Counsel has been \u2018established by Law\u2019 as the Constitution requires.\u201d<\/p>\n<p>\u201cIf there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President,\u201d Thomas opined. \u201cIf this unprecedented prosecution is to proceed, it must be conducted by someone duly authorized to do so by the American people.
